HomeMy WebLinkAbout3285 Amending AMC 2.62.030 to Provide a Chain of Command in the Event of an Emergency ORDINANCE NO. 3285 AN ORDINANCE AMENDING AMC 2.62.030 TO PROVIDE FOR A CHAIN OF COMMAND IN THE EVENT OF AN ETTVIERGENCY Annotated to show deletions and additions to the Ashland Municipal Code sections being modified. Deletions are bold-linfd4hi-4m-gh, and additions are bold underlined. WHEREAS,Article 2. Section 1 of the Ashland City Charter provides: Powers of the City. The City shall have all powers which the constitutions, statutes, and common law of the United States and of this State expressly or impliedly grant or allow municipalities, as fiffly as though this Charter specifically enumerated each of those powers, as well as all powers not inconsistent with the foregoing, and, in addition thereto, shall possess all powers hereinafter specifically granted. All the authority thereof shall have perpetual succession. WHEREAS, the City wishes to outline a chain of command in the event the City manager was unable to act due to absence or incapacity. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. 2.62.030—Declaration and Ratification of Emergency. A. The, declaration by the City Manager of a state of emergency shall: 1. State the nature of the emergency. 2. Designate the geographical boundaries of the area subject to the emergency controls. 3. State the duration of time durim,,which the area so designated shall remain an emergency area. 4. State any special regulations imposed as a result of the state of emergency. B. The ratification by the Council may also authorize additional specific emergency powers for zn the duration of the emergency period set forth in the declaration. C. If the City Manager is unable to act due to absence or incapacity, then the duties listed in this chapter shall be performed in the following order of succession: 1. Deputy City Manager 2. Fire Chief 3. Police Chief 4. Emergency Management Coordinator 5. Incident Commander(sl ORDINANCE NO. 3285 Page 1 of 2 SECTION 2. Severability. Each section of this ordinance, and any part thereof, is severable, and if any part of this ordinance is held invalid by a court of competent jurisdiction, the remainder of this ordinance shall remain in full force and effect. SECTION 3. Codification. Provisions of this Ordinance shall be incorporated in the City Code and the word "ordinance"may be changed to "code", "article", "section", "chapter"or another word, and the sections of this Ordinance may be renumbered, or re-lettered,provided however that any Whereas clauses and boilerplate provisions (i.e. Sections 3-5)need not be codified and the City Recorder is authorized to correct any cross-references and any typographical errors.
