A RESOLUTION RELATING TO SOLID WASTE NIANAGEMENT SERVICE RATES
AND REPEALNG RESOLUTION 2025-14
RECITALS:
A. The Franchise Agreement for Solid Waste Management and Collection Services was
adopted by the City Council as Ordinance No. 3090 (AMC 9.50) in 2013 and the
associated Administrative Operations Standards and Rules most recently adopted by
Resolution No 2014-23 (the"Agreement");
B. AMC 9.50.050(C)Francise Term establishes the franchise agreement to be granted for a
period of ten years,beginning December 1, 2013,with subsequent seven-year terms
renewing annually, unless prior notice of request to terminate is submitted by either the
City or the franchisee a minim-um of(90) days prior to the renewal date.
C. AMC 9.50.050(H) Establishment and Modification of Service Rates and Fees
establishes that rates shall be set by Council resolution that considers the following
goals:
a. Rates shall be adjusted annually equal to a specified Consumer Price Index
change.
b. Rates shall be adequate to provide an operating margin equal to 10-percent of
franchise-wide gross revenues. However,the City shall not be required to change
rates if the expected operating margin in the next future year falls between eight
(8%) and twelve percent(12%) of gross revenues.
D. The City holds a Franchise Agreement for Solid Waste Management and Collection
Services with Recology Ashland, Inc.
E. Neither the City nor Recology provided prior notice of request to terminate.
F. Recology has requested a rate increase of 8.75% effective July 1"', 2026.
G. The City concurs with the documentation provided by Recology that a service rate
increase of 8.75% is above the specified CPI rate of 2.9%,but that the rate increase will
allow Recology to stay within the operating margin cap as specified in the Ashland
Municipal Code.
THE CITY OF ASHLAND HEREBY RESOLVES AS FOLLOWS:

SECTION 1. Solid Waste Management Service rates and fees are hereby increased by 8.75%,
effective July 1, 2026.
SECTION 3. Resolution No. 2025-14 is hereby repealed in its entirety.
SECTION 3. This resolution is effective upon adoption.
