RECITALS
A. The City and Contractor previously entered into a Personal Services Agreement effective
March 30, 2026 (the"Agreement') for Contractor to provide land surveying services related
to the property line adjustment between 299 Ditch Road and 270 Skypark Drive, Ashland;
and
B. The City and Contractor wish to amend the Agreement to:
a) extend the term of the Agreement to reflect the intent of the original proposal.
b) increase the amount of compensation to be paid to Contractor.
c) include"Re: Letter to Complete Property Line Adjustment between 299 Ditch Road
and 270 Skypark Drive, Ashland" dated July 2, 2026.
AGREEMENT
NOW THEREFORE, in consideration of the mutual benefits and obligations set forth herein,
the parties agree as follows:
1. Amend the Completion Date as follows, with strikeout wording deleted and underscored
wording added:
Completion Date: 08/31/2026 nti1�z26
2. Amend the Contract Amount as follows, with strikeout wording deleted and underscored
wording added:
Contract Amount: $14,870.00 $1''�0

3. Amend the Contract to include"Re:Letter to Complete Property Line Adjustment
between 299 Ditch Road and 270 Skypark Drive, Ashland" dated July 2, 2026 as a
Supporting Document.
4. This Amendment No. 1 is effective upon being signed by both parties.
5. Except as specifically modified by this Amendment No. 1, the terms and conditions of
the Agreement remain in full force and effect.

Re: Letter to Complete Property Line Adjustment between 299 Ditch Road and 270 Skypark Drive,Ashland
Kevin:
Pursuant to your request and our coordination, I respectfully submit this summary letter on behalf of Neathamer
Surveying,Inc(NSI)to inform you of the additional work completed and work to complete versus the original contract
amount,and its associated cost. Said work is as follows:
1) Coordination with Shawn Kampmann to obtain information, and following NSI finding the three set
monuments with Shawn's surveyor caps on them, the approval to remove said monuments and set NSI
monuments in their place(as shown on the previously submitted final plat);
2) Coordination regarding the need to record a Quitclaim deed from the Smith's to the City of Ashland, so that
there is a transfer deed of ownership of the property dedicated to the city in 2006 (Parcel 4, Partition Plat
Number P-48-2006)to the City of Ashland. Create, and per review from Carmel Zahran, make edits to a
Quitclaim deed. Coordination with Brian Smith and sending a Quitclaim deed to him via U.S_Mail. Upon
receipt of signed Quitclaim deed, obtain a city signature (acceptance) and record it. Reflect recorded
document on the final plat;
3) Coordination with city staff to discuss possible alternate adjustments or platting options to result in the
easterly portion of the Heeter property to be in the ownership of the City of Ashland(versus the submitted
application);
4) Coordination with city staff regarding an existing sanitary sewer line through the Heeter property with no
existing easement in place. Field site visits to capture the topographic locations of existing manholes and
utility locates,as performed by city staff. Draft the location of easement within the Heeter property and add
notes to the final plat,and add verbiage within the final plat Declaration for dedication to the City of Ashland;
5) Estimated cost of additional services is$2,500.
It is my intent to submit a summary of the tasks and work completed,or to be completed,that were outside and beyond
the agreed to tasks per the original Purchase Order. If the information herein and above does not appear to be complete
or clear,please contact me and I will provide additional information.
