HomeMy WebLinkAbout2026-23 Establishing an Alternative Procedure for Sale of City-Owned Real Property RESOLUTION NO. 2026-23 A RESOLUTION ESTABLISHING AN ALTERNATIVE PROCEDURE FOR SALE OF CITY-OWNED REAL PROPERTY RECITALS: A. WHEREAS,the City Council is permitted to adopt an "Alternative Procedure for Sale of City-Owned Real Property" according to ORS 221.727 and AMC 2.55.030, whereby the City Council may, "may, from time to time, adopt a resolution establishing a-procedure for the sale of individual parcels of a class of City-owned real properties, or any interest in the properties,under a single program established within the City for the sale of that class of properties. The City Manager may thereafter sell any parcel under that adopted procedure in lieu of the other procedures established in this chapter [AMC Chapter 2.55] and ORS 221.725." B. WHEREAS,the City Council desires to responsibly manage the City's real property portfolio by disposing of properties that no longer serve the public interest. The City Council recognizes that certain City-owed properties may no longer serve the public interest to keep and that the nature of certain properties are such that establishing an alternative procedure for their sale will promote administrative efficiency, reduce costs, and serve the City's long-term fiscal goals and interests. THE CITY OF ASHLAND HEREBY RESOLVES AS FOLLOWS: SECTION 1: The City Council finds that city-owned real property with any of the following characteristics fall within the class of properties eligible for disposition under this alternative procedure: 1. The property is small, undevelopable, isolated, or otherwise constrained parcels of real property with limited independent utility because of their size, configuration, location, topography, access, or other physical characteristics. The property may also provide functional, economic, or practical value to an adjacent or uniquely interested property owner. 2. The sale or exchange of the property is necessary or convenient to further a legitimate City purpose, including the City's interest to improve financial or operational efficiencies, including but not limited to eliminating ongoing maintenance obligations,reducing liability exposure, avoiding future management costs, resolving boundary or access issues, or receiving fair value or other consideration in exchange for the property. Marketing such parcels through a general competitive sale process may be unlikely to produce additional interested purchasers and may result in unnecessary costs to the City, administrative expense, and delay; SECTION 2: A proposed sale or exchange of property qualifying under Section 1 shall be presented to the City Council and shall be (a)publicly noticed and(b) provided a hearing. The City Council may then authorize the City Manager to negotiate and proceed with the proposed transaction when the Council determines the transaction is consistent with this Resolution. SECTION 3: For properties meeting the criteria established in Section 1,the City Manager is authorized and directed to use good-faith efforts to dispose of such properties. Depending on the nature of the property and the circumstances of the proposed transaction,the City Manager may utilize one or more disposition methods, including but not limited to public solicitation of bids or offers, posting available properties on the City's website or through other reasonable means of advertisement, direct negotiations with one or more prospective purchasers where the property's characteristics or circumstances support such an approach,negotiated exchanges of real property, or such other commercially reasonable methods as the City Manager determines are appropriate to maximize the public benefit and further the purposes of this program. SECTION 4: This resolution is effective upon adoption. This resolution was duly PASSED and ADOPTED this day of , and takes effect upon signing by the Mayor.
