The following shall be the ballot title's for the measure's submitted to the electors: CITY OF ASH!_.4ND 15-1. REPEALS FOOD AND BEVERAGE TAX QUESTION: Shall the food and beverage tax adopted by the voters in March, 1993 be repealed? SUMMARY: The food and beverage tax was adopted by the voters in March 1993. The tax is imposed on food and beverages sold in restaurants and other similar facilities. The tax is required to be used for acquisition of open space lands and easements and for state mandated sewage treatment methods. A yes vote will repeal this tax. 15-2. REDUCES FOOD AND BEVERAGE TAX IF STATE SALES TAX ADOPTED QUESTION: If state sales tax is adopted, shall food and beverage tax be reduced 4% eliminating sewage treatment funds? This measure reduces from 5% to 1% the tax on prepared food and beverages sold in restaurants or sold in grocery stores and bakeries for immediate consumption in the event the statewide sales tax passes. The measure has been filed by the city council as a competing measure to the measure which would repeal the tax altogether. If both measures are adopted by the people, whichever measure receives more votes prevails (the measure receiving the fewer votes will not become law). If this measure (the one reducing the tax) is adopted and receives more votes than the one eliminating the tax, the tax would be reduced only if the state sales tax is adopted by a vote of the people in November, 1993. The state sales tax, if adopted, would be imposed at a rate of 5% which would be in addition to the food and beverage tax of 1%. Purpose of Reduced Tax. If the tax is reduced to 1%, it is required to be used for the purchase of open space and park lands for the city. That part of the tax eliminated by this measure was required to be used for improvement to the city's sewage treatment methods mandated by the State of Oregon Department of Environmental Quality. No part of the reduced tax will go towards improving sewage treatment. Open Space Park Proaram. In 1990 the people of Ashland voted to amend the city charter to create the Open Space Park Program. The charter amendment provides for the Park Commission to recommend priorities to the City Council for the purchase of park land. The Park Commission made such recommendations and in 1991 the City Council adopted a comprehensive plan which identified certain parcels for purchase and development. Effect of measure. Two properties have been purchased or are in the process of being purchased for parks and open space which are to be paid for from the tax. Continued funding for purchase of these properties and other park and open space parcels will be available from this tax. There will be no funding from this reduced tax for sewage treatment. If the tax is reduced, restaurant customers and purchasers of prepared food for immediate consumption from grocery stores and bakeries will pay a 1% city tax instead of 5% city tax.
