IN THE CITY OF ASHLAND, OREGON
NOTICE is hereby given that on Tuesday, June 30, 1992, an
election will be held in the City of Ashland, Jackson
County, Oregon.
The following shall be the ballot title for the measure
submitted to the electors:
Caption:Three-year serial levy to purchase two fire engines.
Question: Shall City of Ashland levy'S220,000 each year for three
years outside the tax base, for fire engines beginning
1992-937
Explanation: The City of Ashland needs to replace two fire
engines, model years 1962 and 1973. The levy would va-ry from
$180,000 to $220,000 over the three years. This serial levy
would provide up to $220,000 per year and raise a total of
$600,000 over the three-year period. The estimated tax rate
would be 25.73 cents per thousand or $38~60 annually on 'a
$150,000 home. This levy would be outside the 6% limitation as
imposed bySection 11, Article XI of the Oregon Constitution.
This levy is subject to the other governmental purposes'limit of
Section 11b, Article XI of the Oregon Constitution.
The June 30, 1992 election will be conducted by mail.

Explanatory Statement:
This proposed three year serial levy is for the purpose of
replacing two aged and unreliable firefighting vehicles. Both
vehicles are pumpers, meaning they pump water on fires in
emergency situations. One was manufactured in 1962 and the other
in 1973. Heavy use of these vehicles has resulted in their
depreciation and increased breakdowns requiring frequent repairs.
The fire department has identified a need to replace these
vehicles with four-wheel drive firefighting vehicles to improve
emergency response capabilities in upper elevations and wildland
areas of the City.
Drought conditions in Southern Oregon over the past seven years
have increased the need for the prompt and reliable response of
fire department equipment to fire alarms within the City. Rapid
control of fires is crucial to prevent the spread of fire into
adjacent structures and wildland areas. Increased fire alarm
responses create additional burdens on the old firefighting
vehicles.
New state and federal safety guidelines require improved
firefighting vehicle safety to reduce the number of firefighter
deaths and injuries which occur in equipment-related accidents.
New firefighting vehicle designs reduce firefighter deaths and
injuries, and improve efficiency of firefighting operations. A
recent review by the Insurance Services Office, which establishes
fire insurance ratings upon which some fire insurance premiums
are based, reinforced the need for the City to maintain the
service integrity of its firefighting vehicles.
While the Fire Department has established a replacement account
for capital equipment replacement projects, ~hese monies are only
sufficient to cover the cost of replacing the emergency medical
response vehicles within the depa~'~men~. The cost of fire
equipment has dramatically increased as a result of safety
regulations and liabili%y issues, forcing a need for funding
outside of the department's annua) operating budget.
If this levy is authorized by the voters of Ashland, the first
firefighting vehicle will probably arrive in 3uly. 1993.

(2) After an initiative or referendum pe-
tition is submitted for signature verification,

250.035 Form of ballot title. (1) The
ballot title of any measure to be initiated or
referred shall consist of:
(a) A caption of not more than 10 words
which reasonably identifies the subject of the
measure;
(b) A question,, of not more than 20 words
which plainly phrases the chief purpose of
the measure so that an affirmative response
to the question corresponds to an affirmative
vote on the measure; and
(c) A concise and impartial statement of
not more than 85 words summarizing the
measurd and its major effect.
(2) The ballot title shall not resemble, so
far as probably to create c?ffusion, any. title
previously filed for a measure to b,e submit-

310.390 Ballot title for le~, in excess'

(1) Notwithstanding ORS 250.035, the ballot
title of any measure which authorizes a tax
levy in addition to the tax base provided in
section 11, Article XI of the Oregon Consti-
tution or which establishes a new tax base
shall consist of:
(a) A caption of not more than 10 words
by which the measure is commonly referred;
(b) A question of not more than 20 words
which plainly states the purpose of the
measure, and is phrased so that an a~rma-
rive response to the question corresponds to
an a~rmative vote on the measure; and
(c) A concise and impartial statement of
not more than 175 words, explaining the
chief purpose of the mdasure and Wing rea-
sons ibr the measure.
(2) The statement in the ballot title re-
quired in this section shall be plainly worded
and factual and shall avoid as far as practi-
cable the use of technical terms. The state-
ment shall not advocate a yes or a no vote
on the qncstion. The statement shall state
whether the tax levy is subject to the limits
of sectiou 11b, Article XI of the Oregon
Constitution, and whether the revenues to be
raised will be used exclusively for educa-
tional and support services or for other gov-
ernmental purposes.
(3) For a measure which establishes a
new tax base for a metropolitan service dis-
trict organized under ORS chapter 268, the
caption shall state that the measure estab-
lishes a tax base. The caption may identify
the functions or activities to be ~unded
the tax base and such identification shall n~t
make the caption insufficient, not concise or
unfair under ORS 255.155. The question shall
include the name of the district, the dollar
amount of the proposed tax base and the fis-
cal year in which the tax base will first be
effective. Except as provided in this sub-
section, the remainder of this section applies
to a measure which establishes a new tax
base for a metropolitan service district.
(4) When the vote is taken bv the elec-
tors of a road district or other aistrict not
using printed ballots in holding its elections,~
the oral statement of the question as shown'
by the records of the elections or the
meetings at which they are held is sufficient

310.395 Ballot statements; excluded
levies. (1t Notwithstanding any other law
and when not inconsistent with or otherwise
provided for in the Oregon Constitution,
whenever a proposed tax levy, whether a
continuing fixed levy, continui~g levy or levv
for a single year, is submitted to a vote
~the people by this state or any countv,
municipality, district or body to (vhich tl~e
power to levv a tax bas bee~ delegated, the
statement in'the ballot title for the measure
kubmitted shall state the total amount of
money to be raised bv the proposed levy, in
collars and cents. If'the statement in the
hallot title for the measure submitted in-
cudes an estimated tax impact, it shall be
~sed on the most current estimate of as-
sessed value fi'om the county assessor. The
measure shall bear the statentent: '~he esti-
mated tax cost for this measure is an ESTI-
~IATE ONLY based on the best information
available fi'om the county assessor at the
'ime of estimate."
(2) Subsection (1) of this section does not
apply to a levy described in ORS 280.060
(*)(b). For a levy deschbed in ORS 280.060
(1)(b), an estimate of the total amount of
money to be raised for each year of the pro-
posed levv shall be stated in dollars and
cents. If ~he levy described in ORS 280.060

Any elector dissatisfied with the ballot title, may petition the
Circuit Court seeking a different title and stating the reasons
the title filed is insufficient, not concise or unfair. Petition
must be filed not later than the seventh business day after title
was filed with City elections officer. (ORS 250.296).

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Ashland City Council will hold a
public hearing for citizens and representatives of other units of
local governments on February 18, 1992 at 7:30 P.M. in the Council
Chambers, 1175 E. Main Street, Ashland, Oregon to communicate the
effect of a proposed increase in cu~rrent tax levy authority on
other units of local government. The proposal is to levy $220,000
per year for three years outside the tax 'base for the purpose of
purchasing two fire engines for the Ashland Fire Department. Voter
approval is necessary for any increase in the tax levy for this
purpose.

The City of Ashland needs to replace two fire
engines, model years 1962 and 1973. The levy would vary from
$180,000 to $220,000 over the three years. This serial levy
would provide up to $220,000 per year and raise a total of
$600,000 over the three-year period. The estimated tax rate
would be 25.73 cents per thousand or $38.60 annually on a
$150,000 home. This levy would be outside the 6% limitation as
imposed by Section 11, Article XI of the Oregon Constitution.
This levy is subject to the other governmental purposes limit of
Section 11b, Article XI of the Oregon Constitution.
