Salter Levies re Parks, Band and Cemetery The question has been raised as to whether the levies fixed. by the Charter for the parks, band and cemetery may be increased due to the change in the methoE of determining the true cash value of assessed property. The answer is that legally they may be increased although in different ~ ~ ra~-o~,,. . ORS 310.125 reads in part as follows: "Special rule for c0mpu%ing maximum amount of certain continuing levies; Purpose. (1) Effective for the fiscal year 1962-63 and subsequent fiscal years, the authorized amount of any conti~uing property tax levy described in subsection 2 of this section shall be computed by multiplying the current true cash value ,'3f taxable'property to which the voted millage or percentage is to be applied by the ratio assigned by the Department of Revenue applicable to the County of the taxing unit involved as of january 1 of the calendar year in which the continuing levy was approved by the voters of the unit." .~ Thus, we multiply true cash value by the ratio assigned by the Department of Revenue. ...... With respect to cemeteries, Charter provides for a levy of 1 mill on each dollar (Article 18, Section 1) and this was adopted in 1928. The Department of Revenue has assigned a ratio of .66 to that year and accordingly 66/100 (.66) mills may be assessed on each dollar of true cash value. -1- Memorandum to %he Mayor and Members of the City Council March 8, 1976 ~. · Concerning parks, the Charter provides for a levy of ~.5 mills on the dollar (Article 19, Section 3) and this was adopted in 1951. For that year the Department of Revenue has assigned a ratio of .52 and thus we multiply ~b~ .52~times 4.5 mills and that results in a legally permissable levy of 2.34 miils on the dollar. Concerning bands, the Charter provides for a levy of .6 mills on the dollars (A~%icle 21, Section 1) and'that was · adopted in' 1938. For that year the'Department has assigned· a ratio of .70 which multiplied times' .6 equals a legally permissible levy of .42 mills on the dollar. Accordingly, the law will permit the current levies to be raised from the present level, 'which is basically using 25% of the true cash value. ~ If'you ha~e any further questions, please advise. (Ord. 626 §30, 1916). 10.6~.310" Park officers--Obedience required. No person shall refuse a request to obey any reasonable direction of the park officers or employes. (Ord. 626 §3]., 1916). 10.68.320 Park officers--Interference with prohibited. Nothing contained herein shall prevent the performance of any act or service by the park officers or employes which has been duly authorized by the park commission in charge. (Ord. 626 §32, 1916). 10.68.330 Camping. No person shall camp within the park limits within the City of Ashland, or on the park side of any street adjacent to the parks. (Ordinance 1891, 1976) 10.68.340 Playground restrictions. No person over the age of sixteen (16) years shall be allowed to use any of the apparatus placed in the children's playgrounds. (Ordinance 626 Section 33, 1916). 10.68.350 Violation--Penalty. ~ . Any person who violates any provision of this chapter is, upo conviction thereof, pun- ishable as prescribed in Section 1.08 010. B. The park commission may also exclude any person who violates any provision of this chapter, or any such rule or reg- ulation, from any city park, for a period of not more than ten (10) days. C. The ordinance codified in this chapter shall take effect and be in full force upon the expiration of ten (10) days after its adoption by the council and approval by the mayor. (Ordi- nance 1810 (part), 1974; Ordinance 626'Section 35, 1916). 10.68.360 Band shell. A. The management and control of the G.S. Butler Memorial Band Shell shall be under the super- ~ vision and direction of the park commission of the city, which commission is authorized to make such rules and regulations not in conflict with the charter or ordinances of the city as it may think necessary and advisable for the better control, management,' and supervision of the G.S. Butler Memorial Band Shell. 127 Revised Au&~st, 1976 Public Peace, Morals and Safety 10.72.010--10.72.020 B. The park commission shall not be obligated to allocate funds for the maintenance and repair of said band shell. The funds for maintenance and repair shall be provided by the annual budget of the city. (Ord. 1109 (part), 1949; Ord. 626 Sec. 36, '~916) 10.68.370 Parking Limitations. Enclosed are copies of a suggested budget for 1977-78. It is only a Staff proposal, and you or the Band Board might wish to modify it. (I would not, however, recommend changing the "Unappropriated Balance" proposal). The necessary tax rate would be 11¢ per $1,000. You might consider reducing the tax levy by 1¢, but this action ~ ~ ~n9 '.,~;~ i~ht cause problems. (We normally levy taxes in increments of 1¢ per $1,000, so we do not recommend reducing the levy by a fraction of a cent). I would be glad to discuss the proposed budget with you and/or the Band Board, if you so desira. In any event, we will need an approval budget from L.~e Band Board not later than February 14, 1977. Concerning timekeeping, payroll, W-4's and the like, you might wish to contact Gerrie Garrett in the Accounting Division. She is the person who prepares payrolls, and she will assist you in these matters. Among other items, she will need to know the rate of your salary as Band Director, and your Oregon Public Employees Retirement System number. Please let me know if I can be of assistance. The answer is that it cannot. The law is quite c]_esr that the owner of a Copyright is protected from his music being photocopied. The Copyright las~ for twenty-eight years and can be renewed for an additional twenty-eight years.
