LAND USE PROTOCOL/STUDY SESSION
SPECIAL MEETING
ASHLAND CITY COUNCIL
JUNE 7, 1995
Study session at 11:15 a.m. held as notified 6-05-95.
Present were Mayor Golden, Councilors Winthrop, Hagen, Laws,
Thompson, Reid, Assistant City Administrator Christianson, City
Recorder Christensen, City Attorney Nolte and Planning Director
McLaughlin.
City Attorney Paul Nolte reviewed Land Use Protocol with City
Council members. Topics covered included; 1) The importance of
an impartial tribunal; 2) What is an ex parte communication?; 3)
Ex parte rule modified by the legislature; 4) Bias banned; 5)
Bias precludes participation; 6) council has authority to prevent
participation by biased member; and 7) Proposed amendments to
chapter 18,108 address bias.
Discussion regarding annexations and that annexations are land
use decisions subject to the requirement for a fair hearing.
Topics covered included; 1) The parties have a right to an
impartial tribunal; 2) Ex parte contacts must be disclosed; and
3) Councilors who are biased should not participate in the
decision,
City attorney pointed out that Annexations are also political
decisions not subject to the requirements of land use decisions.
Topics covered included; 1) The parties do not have a right to an
impartial tribunal; 2) Ex parte contacts need not be disclosed;
and 3) Councilors who are biased may participate in the decision,
subject to the restrictions in the governmental ethics statues.
Questions by Council to City Attorney and Planning Director was
in reference to Land Use Protocol.
