ASHLAND CITY COUNCIL
October 3, 1995
CALLED TO ORDER
Mayor Golden called the meeting to order at 7:00 p.m., Civic Center Council Chambers
ROLL CALL
Councilors Laws, Reid, Hauck, Hagen and Thompson were present.
APPROVAL OF MINUTES
The minutes of the Regular meeting of September 19, 1995 and Special meeting of September 18, 1995
were approved as presented with the following change; page 3, paragraph 3, motion should reflect current
zoning.
SPECIAL PRESENTATIONS AND AWARDS
1. Proclamation declaring the week of October 2-9, 1995 as "Recycling Awareness Week?
2. Proclamation declaring the week of October 9-15, 1995 as "National Fare Prevention Week.
Proclamations were read by Mayor Golden.
CONSENT AGENDA
1. Minutes of Boards; Commissions and Committees.
2. Monthly Departmental Reports for September, 1995.
3. City Administrator's monthly report for September, 1995.
4. Designation of voting delegate for League of Oregon Cities' annual conference,
November 10-12, 1995.
Councilors Hauck and Reid m/s approval of the Consent Agenda. Voice vote aH AYES. Motion
passed.
SPECIAL AGENDA ITEM
1. Election of Council member to Position No. 5 for term ending December :51, 1996.
After discussion by Council regarding candidates Carole Wheeldon, Marty Levine and Lee Carrau there
was consensus that the best candidate would be Carole Wheeldon. Council noted Ms. Wheeldon's
knowledge and experience in various city committees which they felt would best serve the Council.
Councilors Reid and Hagen m/s to elect Carole Wheeldon as the new Council member for position
No. 5. Voice vote all AYES. Motion passed.
PUBLIC HEARINGS
1. Appeal for a decision of the Planning Commition approving a Site Review and Outline Plan for
a 16 lot, 16 unit multi-family development under the perform_auce standards option for the
property located at 955 B Street (Fred Cox, applicant; Philip Lang, appellant).
Mayor Golden read guidelines regarding Planning Action.
PUBLIC HEARING: OPEN 7:20 p.m.
Mayor reported that Philip C. Lang requested that this appeal be postponed and read into the record a letter
with this request. (letter attached)
Applicant Fred Cox agreed to extend the 120 day limit and allow Mr. Lang to present his appeal
personally.
Councilor Reid requested from Council a forum to discuss a plan which would connect the two
neighborhoods involved in this project. It was clarified for Council that there is no condition of
requirement for this type of suggestion.
The Public Heating for this appeal was set for October 17, 1995 which would put before the City Council a
request for site review and outline plan approval for 16 lot, 16 unit multi-family development under the
performance standards option for the property located at 955 B Street.

NEW AND MISCELLANEOUS BUSINESS
1. Letter from City of Monmouth, requesting City of Ashland support by writing letter of French
President Chirac, urging reconsideration of resumption of nuclear testing.
Consensus by Council to support letter urging consideration of resumption of nuclear testing.
ORDINANCES. RESOLUTIONS & CONTRACTS
1. Second reading by title only of "An Ordinance adding Chapter 2.41 to the Ashland Municipal
Code establishing contribution and spending limits for candidates for City offices and for City
measures."
Councilors Hauck and Thompson m/s approve adoption of Ordinance # 2766. Roll call vote: Laws
NO; Hauck, Hagen, Reid and Thompson YES. Motion passed 4-1.
2. Second reading by title only of "An Ordinance amending AMC 14.08.030, clarifying standards for
connecting to sewer outside the City."
Councilors Hauck and Reid m/s approve adoption of Ordinance ~2767. Roll call vote: Hagen, Laws,
Hauck, Reid and Thompson YES. Motion passed.
First reading by title only of "An Ordinance permitting only woody debris in any authorized
outdoor f'we by amending AMC 10.30.010, rede~nlng the season for outdoor burning by
amending AMC 10.30.020 for the purpose of reducing f'we hazards in the City of Ashland and
declaring an emergency."
Council discussion regarding concern Councilors Reid and Hagen had with the ordinance not providing a
sunset clause. Councilor Reid requested that the ordinance be amended to include a two year sunset clause.
Hershei King/791 Faith/In favor of sunset clause.
Councilors Reid and Laws m/s approve amendment to proposed Ordinance. Discussion: Council
discussed how it wouldn't take two years to discover any problems and questioned whether amendment was
necessary. Councilor Laws felt that any extension to the burning season should be only long enough to
deal with the interface situation and then go back to the original burning season. Voice vote all AYES.
Motion passed.
Assistant City Administrator Peggy Christiansen read the ordinance in full with approved amendment for
first reading.
Councilors Hauck and Hagen m/s approve to second reading. Roll call vote: Reid, Thompson, Hagen,
Laws and Hauck YES. Motion passed.
4. First reading of "An Ordinance amending section 3.08.080 of the Ashland Municipal Code by
deleting the utility discount benefit as an employee benefit."
It was clarified for Council that negotiations were still taking place with unions and the goal is to
discontinue the discount for all employees on November 1, 1995.
Councilors Hauck and Hagen m/s approve to second reading. Roll call vote: Hauck, Reid, Laws,
Thompson and Hagen YES. Motion passed.
Councilor Laws questioned Assistant City Administrator as to whether she was doing the negotiations with
the unions. After confirming that this was happening, Councilor Laws reminded the council that at the
time of recruiting and discussion of role of Personnel Director, the goal was that the Personnel Director
would not be the labor negotiator.
OTHER BUSINESS FROM COUNCIL MEMBERS
Councilor Hagen spoke regarding planning applications and requested that plans for new developments
include surrounding existing developments so as to show context.
Councilor Thompson questioned who acknowledged letters received in their packets. Mayor confirmed that
she would respond to most letters, but Council is welcome to also respond.
Councilor Reid commented on how nice the renovation of the building on Siskiyou Boulevard was.

Re.: Planning Action 95-044 - Appeal
Dear Mayor & City Councilmembers:
] am writing this letter apart from my. appeal statement because it is a
separate issue - but I want it "on record" because it may become an issue
in future levels of appeal.
This proposed development was heard by the Planning Commission on June 13th.
I opposed the development at that hearing, and filed an appeal within the
required 15 day period.
No City Council appeal was set between that time and October 3rd. I understand
that the developer was in Hawaii on vacation. Thus his needs were accomodated.
In the second week of September I was informed by phone by Mr. Molnar that
the appeal was set for October 3rd. I verbally agreed over the phone, but
immediately upon hanging up and going to enter the date in my appointment
book, I found that that was "Erev Yom Kippur" - the Jewish holiest holiday begins
at sundown on October 3rd. I immediately notified Mr. M~nar that my unchangeable
plan was to be out of town (back in the Bay Area) to observe the holiday.
Nevertheless, Mr Molnar informed me on September 22nd (approx. 10 days later)
that.the date could not be changed, that materials had been mailed out, notices
sent etc. A call to the City Manager elicited the response that the City
was up against a 120 day limit, and that money had been spent on mailings and
notices, so nothing would be done. He advised me to put my appeal in writing.
I believe that. the deprivation oY the opportunity to be physically present,
to present my objections verbally, and engage in give-and-take, seriously
prejudices my position. I think that this failure to accomodate to my
commitments, after having done so for the developer's vacation, is unfortunate
and prejudicial.

The Ashland City Council Tues-
day voted unanimously to bring
Carole Wheeldon into its ranks, cit-
ing her knowledge and experience
with city planning issues.
"We need someone that can hit
the ground running," said Council-
man Ken Hagen. Councilors also
noted the fact that Wheeldon has
lived in Ashland longer than the

While ultimately voting for
Wheeldon, Councilman Don Laws
expressed concern that she would
not bring any diversity~ to the coun-
oil. "She has all of the strengths and
all of the weaknesses that the coun-
oil has ... I was hoping to elect him
(Levine) to give the council more
balance." Councilman Steve Hauck
~.iterated those concerns, saying it
was difficult for him to decide be-
tween Levine and Wheeldon.
A 17-year resident of Ashland,
Wheeldon is currently costume
manager with the Oregon Shake-
speare Festival. She also serves on
I~e citizens' budget committee and
~ transportation advisory com-
mittee. She is married to David
I~audoin and has two children,
Fletcher Beaudoin and Simon
Wheeldon.
Wheeldon replaces Rob
Winthrop, who resigned effective
Oct. 1, citing time constraints and
personal responsibilities.
Also Tuesday, the coun~jl ap-
proved a revision of the city~ ~open
burning ordinance, adding a sunset
provision that will repeal ale ordi-
nonce in two years. The n~w ordi-
