HomeMy WebLinkAbout1994-0907 SPECIAL MTGMINUTES OF SPECIAL MEETING Wednesday, September 7, 1994 CALLED TO ORDER Meeting was called to order in the Council Chambers by Mayor Golden at 7:05 p.m. ROLL CALL Councillors Laws, Reid, Hauck, Acklin, Winthrop, Arnold were present. PUBLIC HEARINGS (Continued from Regular Meeting of Tuesday, September 6, 1994): 2. Planning Action 94-104: Appeal from a decision of the Planning Hearings Board, approving a request for a sign placement variance for a business at 10 Water Street (Applicant: Grady and Susan Golden). Applicants Susan and Grady Golden, 10 Water Street, reviewed reasons for their variance request. City Attorney Paul Nolte advised Council that the variance can only be allowed if each criterion is met. Speaking in opposition: Terry Skibby, Historic Commission, 611 Beach Street; Rick Harris, co-owner Kelso Realty and former Historic Commission member. Grady and Susan Golden reiterated their reasons for the variance request. Councillors Laws/Acklin m/s to deny appeal. Roll call vote: Laws, Reid, Hauck, Acklin, Arnold, 1516'; Winthrop Y/ESf. Motion passed. Councillors Laws/Arnold m/s to reconsider vote. Voice vote: all AYES. Councillors Laws/Acklin m/s to uphold appeal and deny variance. Roll call vote: Hauck, Winthrop, Reid NO; Acklin, Laws, Arnold YES. Tie vote. Mayor Golden voted NO. Motion pa,_.g.>s~_.~.. Councillors Winthrop/Hauck m/s to approve the findings of the Planning Commission in PA 94-104. Roll call vote: Hauck, Reid, Acklin, Winthrop YES; Laws, Arnold NO. Motion passed. Draft ot' "An Ordinance enacting a 0.40% real property transfer tax and dedicating the revenue from the tax to watershed/forest interface fire prevention and suppression and to affordable housing." ~i Mhmtcs',9-7-gd .spl-pg. 1 ) Councillors Winthrop and Hauck reviewed the background developed to prepare this Ordinance. Associate Planner Kelly Madding presented information regarding the Affordable Housing market in Ashland now. Fire Chief Keith Woodley reviewed City's Forest Management Plan and the funding plan suggested for its implementation. City Attorney Nolte presented information on the financial implications of this Ordinance on properties and property owners and how the fund would be implemented. Mayor Golden read letters from Barbara Bamford, 450 Wiley Street and Liz Vesecky and Herschel King of 791 Faith Avenue. City Attorney Nolte distributed a copy of a Resolution that would be used if Council wished to deny the Ordinance form and refer this issue to the November 8 election. Councillors Laws/Arnold m/s to place a measure based on the proposed Ordinance in November. Motion withdrawn. (r:Minute~s\9-7-94.spl-pg. 3) Councillors Laws/Winthrop m/s to keep percentages in Ordinance as presented. Roll call vote: Hauek, Arnold, Reid, Aeklin NO; Laws, Winthrop YES. Motion was denied. Councillors Arnold/Laws m/s to make percentages at 40% fire, 60% affordable housing and those percentages to be met every five years. Roll call vote: Laws, Hauek, AekHn, Winthrop, Arnold YES; Reid NO. Motion passed. Councillors Arnold/Laws m/s to amend Ordinance to include insertion made by the City Attorney on page 3, paragraph 17 to allow transfer upon marriage to new spouse. Voice vote all AYES.. Councillors Hauck/Arnold m/s to insert 4.40,030, page 2, paragraph G, add "but does not include leases." Voice vote all AYES. City Attorney Nolte advised Council Resolution would have date of 5/1/90 filled in on page 1 and 4.040.070 change date of effectiveness to December 1, 1994 and 4.040.080 change date of expiration to November 30, 2014. Councillors Arnold/Winthrop m/s to adopt Resolution 94-57 of Ordinance that includes all changes in language and dollar amounts noted by City Attorney.
