ASHLAND CITY COUNCIL
JANUARY 2, 1990
PLEDGE OF ALLEGIANCE
Mayor Catherine Golden led the Pledge of Allegiance and called the
meeting to order at 7:37 P.M. Donovan, Reid, Williams, Acklin,
Winthrop and Arnold were present.
MAYOR'S ANNUAL ADDRESS
Due to the length of the agenda, Mayor Golden will present her annual
address at the next regular meeting of the City Council.
APPROVAL OF MINUTES
Councilor Williams amended the fourth sentence, second paragraph on
page three to read: "Williams said concentration of open space is a
good idea, he is concerned about density, ...". The minutes of the
regular meeting of December 19, 1989 were approved as amended.
Recycling Depot Name
Donovan asked about the process for naming streets and alleys and City
Admin. Almquist said names are reviewed in order to avoid conflicts
which might be confusing to the Fire Department. Arnold moved to
table the item in order to review the process. Donovan seconded the
motion which passed unanimously on roll call vote.
SPECIAL PRESENTATIONS, PROCLAMATIONS, & AWARD8
City Admin. Almquist said the G.F.O.A. Award will be presented at the
next meeting.
Golden reported that Kathie Kennedy was not resigning from the
Planning Commission. She simply does not want her term extended to
April 30, 1990.
PUBLIC HEARINGS
Comp. Plan Map Change for Open Space (Mike Hillenga, Applicant)
Planning Director Fregonese explained that the open space designation
will devalue the land and the land meets the definition of open space.
A deed restriction in favor of prohibiting development until approval
by Council is required. The public hearing was opened and there was
no comment. Arnold moved to approve the zone change and adopt the
Planning Commission Findings. Reid seconded the motion which passed
unanimously on roll call vote.

Appeal of P.A. No. 89-168 (Fred Cox, Applicant)
Site visits were made by Winthrop, Reid, Williams, Arnold and Donovan.
Arnold declared ex-parte' contact with Paul Pavlich. Planning Dir.
Fregonese said the deadline for a decision is January 24, 1990. The
Planning Commission approved the project with the conditions noted in
their Findings. On a question from Williams, Fregonese said a deed of
quiet title is being prepared to define property line locations. On a
question from Arnold, Fregonese said lot coverage reductions based on
slope percentages are implemented through rezoning and reducing
density. The public hearing was opened. Sandra Sawyer, attorney for
the appellants, said she had not been notified of the meeting at which
the Findings were adopted, and concerns expressed at the public
hearing were not addressed in the Findings. She is concerned about
density of the project, and would like the road to be extended. She
said the area is a fill site and additional engineering and geological
studies need to be done. Allen Sandler, 1260 Prospect, feels growth
is out of control, and requested a sound study for the Roca Canyon.
He is also concerned about fire danger, density, and wants Roca Street
extended. Dick Pischel, 839 Roca, feels the zoning is incorrect for
the area, clustering should be considered, and T.I.D. water supply is
inadequate for landscape irrigation. Jenny Feinberg, 829 Roca, is
concerned about density, the noise issue, preserving the character of
the neighborhood, and that a hydrological study be done before
approving the project. Rick Harris, 759 Leonard, said the proposed
density is not consistent with the neighborhood. John Hoffstead, 783
Roca, said this is one of the last big open areas in Ashland, and is
concerned that traffic will end up in the SOSC parking lot. Paul
Pavlich, 829 Roca, feels there is a soil stability problem. He asked
that a letter from Bob Blanton, engineering geologist, be entered into
the record. Ellen Dennis, 759 Leonard, spoke of the density, noise
and character of the neighborhood. Ron Kinney, who dug the test holes
in the area, spoke in favor of the project.
Tom Ferrero, consulting geologist for the applicant, said his report
is preliminary and final data cannot be presented until the work is
done. Winthrop reported his firm had contacts with Ferrero on
previous projects. Clark Hamilton, one of the applicants, said the
density allows 20 homes, they have provided open space, and clustering
is not possible. On a question from Winthrop, he said clustering will
be incompatible with existing homes, and the slopes and floodplain do
not allow it. Acklin moved to continue the hearing until 10:00,
Winthrop seconded, all AYES on voice vote. Fred Cox, applicant, said
TID use won't affect the neighboring properties, and domestic water
will be used in landscape irrigation. Hamilton said the project meets
all requirements and is a good model for the open space proposal.
Golden asked about putting the street through and Cox said it will
take a great amount of fill to get a 15% grade. Pavlich asked that
the project be referred back to the Planning Commission. There being
no further comment from the audience, the public hearing was closed.
Public Works Dir. Hall said there is adequate water pressure in the
area. On a question from Arnold, Fregonese said there is no provision

to disallow density bonuses and reduce density. Winthrop said
clustering will not reduce density, he feels the zoning is incorrect,
and the conditions should be clarified. Acklin agreed and commended
the Planning Commission on their expertise and thoroughness. She
moved to uphold the Planning Commission decision, and proposed several
amendments to the Findings. Winthrop seconded the motion, and
proposed further amendments. The final amendments are as follows:
Condition #6 and #16 be combined to read as follows: "That a
hydrogeologic study be performed including information concerning the
adequacy of water and flood impacts regarding the ponds and waterfalls
proposed for the open space area at the time of Final Plan. The study
should also address the issue of removal of the culvert along Roca
drainage. The Commission reserves the right to remove the culvert at
the time of Final Plan." Condition #13 be amended to read as follows:
"That draft CC&R's be presented at Final Plan indicating maintenance
of common open space and common drives and that the CC&R's be reviewed
by the City Attorney." Condition #19 be amended to read as follows:
"That soils testing of the site be done to determine the quality and
stability of the soils, with the intent of discovering what the soil
is comprised of and the potential for any future problems." Condition
#23 be amended to read as follows: "That specific plans relating to
the recommendations of the geologic report concerning foundations,
retaining walls, streets, and other facilities be presented at the
time of Final Plan." Reid expressed concern about all parties being
notified of meetings at which Findings are to be adopted. Donovan
feels the zoning is incorrect, the road should not be extended, and
density bonuses should allowed. Arnold said the project is too dense
and should be restricted to 15 units. Williams feels density bonuses
should not be withdrawn and will support the motion. The motion
passed on roll call vote as follows: Donovan, Williams, Acklin, and
Winthrop, YES; Reid and Arnold, NO.
UNFINISHED BUSINESS
Drug-Free Workplace Policy
City Administrator Almquist reviewed the revised policy and stressed
the main objectives. He said the policy meets Federal requirements
and to date there have been no drug problems with City employees. The
resolution was read. Rick Harris commended Council on the policy and
said it should include addiction to cigarettes. Carl Oates, 351
Granite, said he supports the policy but feels the City did not admit
the problem in the 80's and needs to recognize it more in the 90's.
Reid said members of the Council and Staff worked on the problem in
various ways in the 80's. Richard Ernst, 975 Walker, feels this is a
step in showing the community that drugs are a problem. Lyman
Faulkner, 1320 Apple Way, feels the key enforcement factors in the
policy were omitted, i.e. pre-employment testing and for cause
testing. Jack Blackburn spoke against testing but supports the
policy. Acklin moved to adopt the resolution, Arnold seconded and the
motion passed unanimously on roll call vote. (Reso. #90-01)

Request for Re-consideration oZ P.A. #89-153
A letter was read from Jerry Toney, 4866 Grant Rd., Central Point,
requesting that the Council reconsider the site review for an
apartment complex off Sheridan Street. Fregonese said Toney will
submit a revised proposal which meets the code as interpreted at the
public hearing. Williams moved to grant the request and Donovan
seconded. Winthrop said he has concerns about the proposal and thinks
it should go back to the Planning Commission. Arnold agreed.
Williams feels the project should be reconsidered because of the code
interpretation issue. Winthrop said that issue is a good reason to
modify the decision on the appeal to deny without prejudice, and to
waive the application fee. The motion failed as follows on roll call
vote: Reid, Winthrop and Arnold, NO; Donovan and Williams, YES.
Acklin abstained. Winthrop moved to modify the decision in the
upholding of the appeal and deny the site review without prejudice and
waive the application fee. Donovan seconded the motion which passed
on roll call vote as follows: Williams, Winthrop and Donovan, YES;
Arnold and Reid, NO. Acklin abstained.
Donovan moved to continue the meeting for 1/2 hour, Winthrop seconded
and the motion failed on roll call vote as follows: Reid, Williams,
and Arnold, NO; Donovan and Winthrop, YES.
ADJOURNMENT
The meeting adjourned at 11:02 P.M.
