ASHLAND CITY COUNCIL
MARCH 20, 1990
PLEDGE OF ALLEGIANCE
Mayor Catherine Golden led the Pledge of Allegiance and called the
meeting to order at 7:30 P.M. on the above date in the Council
Chambers. Donovan, Reid, Williams, Acklin, Winthrop, and Arnold were
present.
APPROVAL OF MINUTES
The minutes of the Regular Meeting of March 6, 1990 were approved as
presented.
CONSENT AGENDA
Acklin moved to approve the Consent Agenda which consisted of the
following: 1) Minutes of Boards, Commissions & Committees; 2)
Petition requesting formation of a Local Improvement District on
Ashland Loop Road between Morton and Terrace Streets (Resolution
setting public hearing later on agenda; 3) Monthly Departmental
Reports. Reid seconded the motion which carried on voice vote.
PUBLIC HEARINGS:
Peachey Road/Paradise Lane Annexation
Associate Planner John McLaughlin explained that the applicants are
requesting annexation and zone change of approximately 16 acres in the
Peachey Road/Paradise Lane area, and a Comprehensive Plan map change
from Single-Family Residential to Open Space for the area in the
ravine east of Paradise Lane. The Planning Commission recommends
approval of the annexation and that the property north of Peachey Road
to be zoned R-i-10-P and the property south of Peachey be RR-.5-P.
Also that the portion of Ross Lane west of Garden Way not be improved
and be deleted from the Transportation Map and replaced with a bikeway
and pedestrian path dedication. On a question from Reid, City Admin.
Almquist explained that council policy is to recommend adjacent
properties be annexed so it is done in an organized manner. Winthrop,
Reid, Donovan and Golden made site visits. Reid talked with
neighbors, and Golden talked with Tom Olbrich and Don Rist.
Tom Olbrich, 904 Garden Way, is against the annexation and said the
criterion is not met for public need of this type of additional land.
Don Rist, speaking for David Barrett who is one of the applicants,
said the zoning should be R-l-10. David Barrett, 1050 Paradise Lane,
asked that the annexation be approved and the zoning be R-l-10. A
letter was read from Lyle Reeder, 1660 Peachey Road, in support of the
annexation because of failing septic systems on neighboring

properties. Ray Casebeer, 1654 Peachey Road, said he and his
daughter, who lives at 1656 Peachey Rd., both have septic problems and
requested approval of the annexation. Bruce Barrett, applicant, said
the septic lines are bad and should be inspected by the County. Kerry
Lay, 965 Garden Way, supports the Planning Comm. recommendations of
lower density and Ross Lane remaining bike and pedestrian way. Larry
Katz, 1106 Paradise, feels Peachey Rd. should be paved if annexation
is approved, wants Paradise Lane to remain a country lane, and asked
that fire protection be addressed. Olivia Parrish, 913 Garden Way,
spoke against the annexation. Judy Paulsen, applicant, 1590 Peachey,
spoke in favor of the annexation and said her plans will not change
the quality of life in the area. Mary Pat Smith, 1981 Mohawk, said
buildable land is very hard to find. Judy Burns, 1104 Paradise, spoke
against. Gail Bronkin, 1609 Ross Lane, asked that Paradise, Peachey
and Ross Lane not be paved. Grace McGee, 393 Courtney, said property
owners have to pay taxes, not other area residents who walk there.
Tom Cox, 450 Guthrie, spoke for Mildred Benesch who owns property in
the area, in support of the request. He said the parcel is well
suited for building, and Ross Lane should remain closed. Scott
Groshong, 1506 Pinecrest Terr., read a letter from Len and Marlene
Wilbur, 1550 Pinecrest, asking for 1/2 acre minimum lot size, stop
signs at Walker, Peachey and Pinecrest, and a stop light at Walker and
Siskiyou. Groshong also asked that Ross Lane not be paved. Lay read
a letter from Mel and A1 Jason, 1605 Ross Lane, in support of leaving
Ross Lane unpaved. There being no further comment from the audience,
the public hearing was closed.
Acklin said County policy encourages residents to hook up to city
services when available. Winthrop said hookup will be expensive
without developing the land. Arnold feels the criterion for public
need for this type of land has not been met. Reid feels owners should
not be denied the right to hookup to services, and also recommended
doing annexations one at a time. On a question from Williams,
McLaughlin said tax lot 7804 does have access for fire protection.
Donovan doesn't think there is enough developable land and supports
down-zoning. Williams moved to approve the Planning Commission
recommendations and adopt their Findings, Conclusions and Orders.
Acklin seconded the motion. Golden said no one in the subject area
spoke in favor of open space at the public meetings on that subject.
The motion passed as follows on roll call vote: Donovan, Reid,
Williams, Acklin, and Winthrop, YES; Arnold, NO.
Scenic Drive L.I.D.
Public Works Director Hall explained that the two property owners
involved requested the street be improved by private contract, not
through the L.I.D. process. The public hearing was opened, no
comment.~- Reid moved to approve the request and not adopt the
ordinance forming the L.I.D., Donovan seconded and the motion carried
on voice vote.'

UNFINISHED BUSINESS
Use of Granite Street for Logging Purposes - City Admin. Almquist told
of two meetings held with area residents about the logging plans.
There is a severe fire danger and the timber should be removed while
still merchantable. The agreement with Superior Lumber Co. will
reduce the cutting on their land by 1/3. Pilot cars will be used and
the street will be watered for dust control. Traffic control will be
used at Granite and N. Main Streets. Bob Dunn, 65 Granite, is
concerned about the Forest Service removing their dead and dying trees
and Almquist said they will not be using Granite Street. Jed Meese,
88 Granite, told of recent problems with construction on Granite and
thinks Winburn Way should be used instead. Meece asked about closing
the street in the evening hours, and not starting until 8:30 A.M.
Yvonne Rose-Merkel, 73 Granite, asked about the number of trucks per
day and Hall said 15-20 for approximately two weeks. Winthrop moved
to request that the pilot cars go as slowly as possible, the street be
swept and watered, and signs be posted to close the street between
Nutley and High to non-residential traffic in the evenings. Acklin
seconded the motion which carried on voice vote.
Agreement with Superior Lumber Co. - Winthrop asked that the wording
in parenthesis on page 11 be eliminated, and it was agreed to do so.
Reid expressed concern about large, old-growth trees being preserved,
and that the Sierra Club be involved in selection. Winthrop agreed
these concerns are valid but the project must move ahead. Almquist
will check with Superior regarding the 8:30 A.M. start time. Arnold
moved to authorize the Mayor and City Recorder to sign the agreement,
Winthrop seconded the motion which passed unanimously on roll call
vote.
Request from Camp Fire Council - David Fisse, Board of Directors
member, asked that the Superior Land be used for Camp Fire camp after
purchase by the City. Winthrop said to wait and see what use the City
might develop, and Arnold wants the property to be operated and
controlled by the City and available to all residents.
NEW & MISCELLANEOUS BUSINESS:
Lithia Park Village P.U.D. - A letter was received from Mark Cooper
asking about the status of the development. Salter gave the
background and told of current legal action, and said he will prepare
a draft response and get Cooper's and Attorney Mike Jewett's input.
Recycle Center - Reid moved to place this item on the agenda, Donovan
seconded all AYES on voice vote. Donovan showed the plans for the
recycling center on Water Street and asked that $1250 be appropriated
for building materials only. Ashland Sanitary Service will match that
amount and the work will be done by volunteers. Donovan moved to
approve the request, Reid seconded and the motion carried on voice
vote.

PUBLIC FORUM: No response.
ORDINANCES, RESOLUTION8 & CONTRACTS:
Children in Vehicles - Second reading by title only of an ordinance
amending the Municipal Code with respect to children confined in
vehicles. Acklin moved to adopt same, Winthrop seconded and the
motion passed unanimously on roll call vote. (Ord. #2568)
Tolman Creek Rd. Annexation P.H. - First reading of an ordinance
dispensing with an election and calling a public hearing for April 17,
1990 on a proposed annexation on Tolman Creek Rd. Donovan moved to
second reading, Winthrop seconded and the motion passed unanimously on
roll call vote.
Ashland Loop Rd. L.I.D.P.H. - A Resolution was read setting a public
hearing for April 3, 1990 on the improvement of Ashland Loop Road from
Viewpointe Terrace Subdiv. Easterly to end of pavement, and from
Morton Street approximately 100 feet South. Winthrop moved to adopt
same, Arnold seconded the motion which passed unanimously on roll call
vote. (Reso. #90-09)
Walker St. Parking - A Resolution was read prohibiting parking on the
West side of Walker Avenue from E. Main St. to Siskiyou Blvd. and
establishing two one-way bikelanes on Walker. Winthrop moved to adopt
same, Arnold seconded and the motion passed unanimously on roll call
vote. (Reso. #90-10)
Third Street One-way - A Resolution was read establishing Third Street
southbound as one-way between Lithia Way and E. Main St. (Reso. #90-
11)
Crosswalk on B St. at 5th St. - A Resolution was read establishing a
crosswalk on B Street at the West side of 5th Street. Arnold moved to
adopt same, Winthrop seconded and the motion passed unanimously on
roll call vote. (Reso. #90-12)
Access for Handicapped - A Resolution was read declaring the City's
commitment to full access for the handicapped. Arnold moved to adopt
same, Donovan seconded and the motion passed unanimously on roll call
vote. (Reso. #90-13)
OTHER BUSINESS FROM COUNCIL MEMBERS: None.
