HomeMy WebLinkAbout1990-0403 REG MINMINUTES OF THE REGULAR MEETING ASHLAND CITY COUNCIL APRIL 3# 1990 ROLL CALL Mayor Golden called the meeting to order and led the Pledge of Allegiance at 7:30 P.M. on the above date in the Council Chambers. Donovan, Reid, Acklin, Winthrop and Arnold were present. Williams was absent. APPROVAL OF MINUTES Winthrop noted that the Council took no action concerning the Scenic Drive L.I.D. (page two of the March 20, 1990 minutes). The minutes of the Speical Meeting of March 12 and the amended minutes of the March 20, 1990 Regular Meeting were accepted. SPECIAL PRESENTATIONS Tree City U.S.A. - Tim Keith, State Forestry Department, said this is the fifth year in which Ashland has received a Tree City U.S.A. Award, and noted the requirements necessary to be so named. He then presented Council with a new flag and the Mayor with a fifth year award. CONSENT AGENDA Arnold asked that item 3, appeal from Sally Jones and Marc Meller concerning office project at Ashland Community Hospital (set public hearing for April 17, 1990), be pulled for discussion. Acklin moved to approve item 1) Minutes of Boarde, Commissions & Committes; and 2) Liquor license request from Robert C. Schultz dba Cafe Amadeus, 130 E. Main St. for Class C license, Reid seconded, all AYES on voice vote. Arnold expressed concern that many people were told the public hearing on the Open Space Plan would be held on April 17th. He moved to hold the public hearing on the proposed Open Space Plan on April 17th and the hearings for the appeal from Jones and Heller, along with the Tolman Creek Annexation and other agenda items on Thursday, April 19th. Donovan seconded the motion which passed on voice vote. PUBLIC HEARINGS: Procedures for Land-use Actions - Planning Director Fregonese said the proposed amendments are to make the document more clear and process non-controversial applications in a more timely manner, keeping the large issues before the Planning Commission. He reviewed the changes and said Type I's make up 50% of the Planning Actions. On a question from Winthrop, Fregonese said its important to be able to modify planning action applications during hearings, and he will copy the State law language into our ordinance. He cautioned Councilors to state everything concerning ex-parte' contacts and site visits prior Regular Meeting - Ashland City Council - April 3, 1990 - Page One Land-Use Action Procedures (Continued) to opening public hearings. The public hearing was opened. David Lane, 1700 E. Main, asked that the 7 day appeal time for affected residents be extended to 20 days for both staff permits and Type I applications. He is concerned that notices be sent to residents outside of the parameters now required for large projects which may impact areas outside of the immediate neighborhood, and that the wording "conformance with the Comprehensive Plan" be clarified. Fregonese said the word "conformance" has a long legal history in land-use planning and gives decision makers maximum flexibility and should be left, and posting signs of planning actions in neighborhoods will answer concerns about the scope of notices being sent. There being no further comment from the audience the public hearing was closed. Almquist said the ordinance will be published with amendments. Reid moved to leave the appeal process in place for Type I hearings, Winthrop seconded and the motion failed as follows on roll call vote: Donovan, Acklin, Winthrop and Arnold, NO; Reid, YES. Staff will work on the language and bring it back to Council. Ashland Loop Road L.I.D. - Public Works Dir. Hall said 100% of abutting property owners signed in favor, and he gave an overview of the project. The public hearing was opened and on a question from Sandy Fletcher, 609 Terrace, Hall said the paved portion would be extremely difficult and expensive to widen for walkways. Reid expressed concern about pedestrian walkways and asked that sidewalks be discussed at a meeting in May. The ordinance was read and Acklin moved same to second reading, Winthrop seconded and the motion passed unanimously on roll call vote. NEW & MISCELLANEOUS BUSINESS Ashland Marketplace C.U.P. - A letter was read from Judie Bunch, Ashland Marketplace, requesting a reduction in the C.U.P. from $425 to $150, in light of the Planning Staff's proposal to reduce fees for this type of planning action. Acklin moved to approve the request, Arnold seconded and the motion carried on voice vote. SOSC 2000 Master Plan Study Session - All agreed to hold the meeting on April 24, 1990. Central Area Zone Chanqe - City Attorney Salter said the time has passed in which an appeal can be filed to L.U.B.A. A public hearing was held by the City Council and Sharon Thormahlen, who requested this item be included on the agenda, did receive a notice of public hearing. Thormahlen said Staff should re-notice and hold another public hearing. Donovan said the Downtown Plan Advisory Committee looked at the rezoning and gave their approval. Thormahlen thanked the Council for an opportunity to be heard. Historic Commission Appointments - Winthrop moved to approve the appointments of M. Thomas Hunt, Mark Reitinger, and Keith Chambers to the Historic Commission to replace recent resignees. Reid seconded and the motion carried on voice vote. Regular Meeting - Ashland City Council - April 3, 1990 - Page Two PUBLIC FORUM - No response. ORDINANCES, RESOLUTIONS & CONTRACTS Tolman Creek Annexation P.M. - Second reading by title only of an ordinance setting a public hearing on the proposed annexation. Almquist said the item could be continued from the meeting on April 17th to the meeting on April 19th. Arnold moved to adopt same, Acklin seconded the motion which passed unanimously on roll call vote. (Ord. #2569) Peathey Rd./Paradise Lane Annexation - First reading by title only of an ordinance annexing 16 acres of land located near Peachey Rd. and Paradise Ln. Acklin moved to second reading, Donovan seconded and the motion passed unanimously on roll call vote. First reading by title only of an ordinance rezoning the annexed land from Jackson County RR- 5 to City of Ashland R-i-10-P and RR-.5-P. Donovan moved to second reading, Winthrop seconded and the motion passed unanimously on roll call vote. First reading of an ordinance amending the Comprehensive Plan Map from single family residential to open space and low-denisty residential. Winthrop moved to second reading, Acklin seconded and the motion passed unanimously on roll call vote. Ashland Loop Road L.I.D. - The ordinance was read earlier in the meeting. Swimming Pool Protection - Almquist reported that Councilor Williams was uncomfortable with the three-month compliance time and had suggested six months or one year. Reid thinks one year is too.long and Arnold said he is comfortable with the 90 days. On a question from Winthrop concerning self-closing latches, Almquist noted that the Building Official has some latitude in enforcing the ordinance. The Ordinance was read and Arnold moved to second reading. Acklin seconded and the motion passed unanimously on roll call vote. Earth DaY 1990 - A Resolution was read declaring April 22, 1990 as "Earth Day 1990" and designating that day for public activities which promote preservation of the global environment. (Reso. #90-14) OTHER BUSINESS FROM COUNCIL MEMBERS Acklin said she received a suggestion from Bob McCoy that the utility newsletter be used to inform people of changes such as the open burning law and the ordinance requiring fencing for swimming pools. Reid reported on the Earth Day activities. She said there are 30 booths so far, and Winburn from the Bandshell to Nutley will need to be closed that day. Public Wks. Dir. Hall reported on the Superior Lumber Co. logging operation. Almquist said Susan Brody of the L.C.D.C. will be here April 19th and would like to meet with the Council between 3:00 and 4:00 in his office. ADJOURNMENT The meeting adjourned at 10:30 P.M.
