HomeMy WebLinkAbout1990-0515 REG MINMINUTES OF THE REGULAR MEETING ASHLAND CITY COUNCIL MAY 15, 1990 ROLL CALL Mayor Catherine Golden called the meeting to order and led the Pledge of Allegiance at 7:30 P.M. on the above date in the Council Chambers. Donovan, Reid, Williams, Acklin, Winthrop and Arnold were present. APPROVAL OF MINUTES The following amendments were made to the minutes of the April 19, 1990 meeting. Page one, last paragraph, should reflect that the hospital receives money primarily from hospital services not parks and public safety. Page five, first paragraph, end of second line should read Acklin, Donovan, Arnold and Williams voted no. Same page, second to the last sentence, last paragraph should read "Reid made site visit, and she and Acklin had ex-parte' contacts with Kurt from Sentry Market". Page eight, first paragraph, Reid said she didn't think the need for more land was shown. Page three, third paragraph of the April 24 minutes, the first sentence should read "Winthrop expressed need to bring parcels in at times of proposed development". The minutes of the regular meeting of May 1, 1990 and the amended minutes of April 19 and 24 were approved. SPECIAL PRESENTATIONS Proclamations - Mayor Golden read a proclamation declaring the week of May 19-22 as "A.I.D.S. AWARENESS WEEK"; and another declaring May 22 as "GRETCHEN RUMBAUGH DAY" for her efforts in educating people about the disease. B.P.A. - George Gwinnutt, B.P.A., updated the Council on the Power Resource Acquisition Program. Mayor Golden read a letter to Jim Jura, Administrator, commending B.P.A. for being honored by the Natural Resources Defense Council on Earth Day as an environmental leader among North American utilities, and for endorsing the Valdez Principles as a guide to BPA's day to day operations. A resolution was read endorsing these principles as modified for the City of Ashland. Arnold moved to adopt same, Reid seconded, all YES on roll call vote. (Reso. #90-21) CONSENT AGENDA Acklin moved to adopt the Consent Agenda as follows: Monthly Departmental Reports, liquor license request, letter from SOSC expressing gratitude for contribution to "International Art Show for the end of World Hunger,,, and Appointment of Ken Gosling to the Bicycle Commission. Arnold seconded, all AYES on voice vote. Regular Meeting - Ashland City Council - May 15, 1990 - Page One PUBLIC HEARINGS Appeal of P.A. No. 89-149, Elizabethan Bowl at O.S.F.A. - Planning Dir. Fregonese explained that the applicants, Oregon Shakespearean Festival Association, requested an extension to June 5, 1990, in light of the fact that the State Historic Preservation Office has not had a chance to review the plans. Winthrop asked the appellant, Sharon Thormahlen if June 5 would be convenient, and 'she said yes. Acklin moved to continue the hearing to June 5, Arnold seconded and the motion passed on voice vote. UNFINISHED BUSINESS Ashland Sanitary Service - Lois Wenker, Ashland Sanitary Service, introduced Consulting Engineer Neil Allangi, Sweet-Edwards/EMCON, who gave the background of the solid waste program in Oregon, and said studies are being done at the landfill regarding impacts on ground and surface water. Enforcement of DEQ regulations will mean more stringent operational controls and responsibility for maintaining the landfill for 30 years past closure. On a question from Reid, Wenker said at closure the landfill will be seeded, and the site will remain a transfer station and recycling depot. The total estimated cost of the closure will be approximately $7,200,000 based on a 12-year life. The Sanitary Service is requesting an increase in regular residential service from $6.00 per can per month to $12.00, the extra to be put in a fund for disposal costs. Acklin said the Committee recommends that Council adopt the proposed rate increase with annual reviews, grant the 15-year franchise to cover the 12-year life before closure, and ask Staff to bring back ordinances reflecting these recommendations. She so moved. She said the rate increase will give additional incentive to recycle and in a year the impact of the steeper rates on Sanitary Service operations will be known. Donovan seconded. Winthrop and Arnold would like more information. Wenker will provide the engineering report to them. The motion passed unanimously on roll call vote. C.P. National Franchise/SOSC - City Attorney Salter reviewed his memo included in the agenda packet. Arnold requested Salter to do more research on this issue and advise if the City can levy this tax. No further action taken. NEW & MISCELLANEOUS BUSINESS Shuttle Bus Service - Carl Oates, 351 Granite St., spokesman for the Transportation Advisory Committee, expressed concern about growing traffic in the downtown area and the resultant noise and air pollutionl He said funding for the shuttle service, beyond fares, could be from R.V.T.D., State economic development grants, etc. He recommended that the Council move to eliminate acquisition of additional parking lots in the downtown area, use current funds Regular Meeting - Ashland City Council - May 15, 1990 - Page Two Shuttle Bus Service (Continued) for funding a trial shuttle bus from June 7 to Labor Day; and direct City Staff to work with interested groups to bring about a full-time shuttle beginning in September. He told of possible routes on E. Main and Siskiyou Blvd., and Reid asked that he consider extending to Emigrant Lake in the summer. Donovan said $100,000 is available for a second parking lot site, which site would only yield 15-18 parking spaces. He said he will be willing to work with Oates and meet with Sherm Flogstad, R.V.T.D. Arnold likes the concept. Acklin thanked Oates for his time and efforts. Richard Ernst, 975 Walker, likes the idea. Jackie Florey, League of Women Voters, said they studied the shuttle service and endorsed the concept. Bill White said it will reduce pollution. Orange Ave. L.I.D. - Public Works Dir. Hall said staff recommends improvement of the full length of the street from Laurel to Helman Streets. Staff was directed to bring back a resolution setting a public hearing. Street Improvements/Sidewalk Requirements - Hall reviewed his memo included in the agenda packet. Reid said it is important that the City Engineering Division is aware that sidewalks are a priority. PUBLIC FORUM Robert Johnson, N. Mountain Ave., would like more of that street paved in light of the dust pollution problem. ORDINANCES, RESOLUTIONS & CONTRACTS Tolman Creek Road Annexation (Watson & Associates) - Second reading by title only of an ordinance annexing a contiguous area to the City of Ashland. Acklin moved to adopt same, Williams seconded, and the motion passed on roll call vote with Reid and Arnold dissenting. (Ord. #2576) Second reading by title only of an ordinance withdrawing annexed property from Jackson Co. Fire Dist. No. 5. Acklin moved to adopt same, Winthrop seconded, and the motion passed on roll call vote with Reid and Arnold dissenting. (Ord. #2577) Second reading by title only of an ordinance rezoning annexed property from Jackson County F-5 to City of Ashland E-1. Winthrop moved to adopt same, Acklin seconded, and the motion passed on roll call vote with Reid and Arnold dissenting. (Ord. #2578) Natural Gas User Tax - Second reading by title only of an ordinance imposing a 2% utility user tax on the users of natural gas pursuant to Section 3 of franchise Ordinance No. 2363. Williams moved to adopt same, Donovan seconded, the motion passed unanimously on roll call vote with Reid dissenting. (Ord. #2579) Regular Meeting - Ashland City Council - May 15, 1990 - Page Three Amend Chapter 18.108 - Procedures - First reading by title only of an ordinance amending the Municipal Code pertaining to procedures. Williams moved to second reading, Winthrop seconded, all YES on roll call vote. (Copies furnished pursuant to City Charter). Liquor License Review - First reading by title only of an ordinance amending Chapter 6.32 of the Ashland Municipal Code relative to liquor license review. (copies furnished pursuant to City Charter). Donovan requested that this item be delayed to the next meeting. All agreed. Construction Activity Hours - First reading of an ordinance amending the Municipal Code pertaining to hours of operation for construction activities on weekends and Holidays. Construction to begin at 8:00 A.M. Acklin moved to second reading, Winthrop seconded, all YES on roll call vote. State Revenue Sharing Eligibility - A resolution was read certifying municipal services for State Revenue Sharing eligibility. Winthrop moved to adopt same, Donovan seconded, all YES on roll call vote. (Reso. #90-22) Proclamations - Proclamations declaring the following were approved: May 20-26 as "National Public Works Week"; and May 13-19 as "National Historic Preservation Week".
