IN THE MATTER OF PLANNING ACTION #88-095, APPLICANT
ADROIT CONSTRUCTION, INC.
) FINDINGS,
) CONCLUSIONS
) AND ORDERS
RECITALS:
1. The above application was previously approved by
the Ashland City Council.
2. Subsequent thereto an appeal was taken to the Land
Use Board of Appeals with the Land Use Board of Appeals remanding
the matter to the Ashland City Council to determine the application
of Ashland Zoning Ordinance 18.72,100.D(4), which states that
"Pedestrian Access. All buildings shall provide pedestrian access
from the street to the building frontage in at least one location.
Such pedestrian access shall minimize conflicts with automobiles
by such means as sidewalks."
3. A public hearing on this question was held before
the Ashland City Council on May 16, 1989, at which time testimony
and exhibits were presented and received. The Ashland City Council
approved the application.
NOW, THEREFORE, the Ashland City Council, finds and
concludes as follows:
SECTION 1. FINDINGS
1.1 The Ashland City Council incorporates and adopts
the site plan submitted at such public hearing.
SECTION 2. CONCLUSORY FINDINGS
2.1 The Ashland City Council finds that it has received
all information necessary to make a decision.
2.2 The Ashland City Council finds that the requirements
of Ashland Zoning Ordinance 18.72,100.D(4), are satisfied by the
site plan submitted, which shows that a separate sidewalk 3 feet

in width will be constructed adjacent to the driveway from the
development and to Park Street and over that 25 foot wide flag
strip area with the sidewalk leading to the buildings to be constructed
by the applicant. Said sidewalk shall be bordered by a fence
on each side. Accordingly, this will minimize conflict between
pedestrian access and vehicular traffic.
2.3 The previous approval in all other respects remains
in full force and effect.
SECTION 3. DECISION
3.1 Based on the record of the public hearing on this
matter, the Ashland City Council concludes that the requirements
of Ashland Zoning Ordinance 18.72,100.D(4) are satisfied and met.
Therefore, based upon the foregoing and upon each of
the following conditions, the application is approved. Further,
if any one or more of the conditions below or originally contained
in the approval of this matter are found to be invalid, for any
reason whatsoever, then Planning Action 88-095 is denied. The
following are the conditions:
1. All previous conditions contained in the approval
originally given to this application. ~"'~"~'>~
2. Construction of the sidewalk as set forth in detail
above.
