HomeMy WebLinkAbout1989-1205 AIRPORT FINDINGSAdopted 12-5-89 Readopted 1-16-90 BEFORE THE ASHLAND CITY COUNCIL JACKSON COUNTY, OREGON November 21, 1989 IN THE MATTER OF PLANNING ACTION #89-155, REQUEST FOR ) ANNEXATION AND ZONE CHANGE FOR 22.64 ACRES OF LAND ) NORTHEAST OF THE ASHLAND MUNICIPAL AIRPORT ON DEAD ) INDIAN ROAD. ) APPLICANT: CITY OF ASHLAND ) ) FINDINGS, CONCLUSIONS AND ORDERS RECITALS: 1) Tax lots 308, 309, 310, and 312 of 391E 12 are comprised of 22.64 acres of land northeast of the Ashland Municipal Airport and has a Comprehensive Plan designation of Public Facilities. Proposed zoning to be E-l; Employment. 2) The applicant is requesting Annexation and Zone Change for 22.64 acres of land located northeast of the Ashland Municipal Airport. A site plan is on file at the Department of Community Development. 3) The criteria for approval of an Annexation are found in 18,108,190 and are as follows: A. That the land is within the City's Urban Growth Boundary. B. That the proposed zoning and project are in conformance with the Clty,s Comprehensive Plan. C. That the land is currently contiguous with the present City limits. D. That public services are available or can be made available to the site. E. That a public need for additional land, as defined in the City,s Comprehensive Plan, can be demonstrated. 4) The Planning Commission following proper public notice, held a Public Hearing on September 13, 1989, at which time testimony was received and exhibits were presented. The Planning Commission recommended approval of the application subject to conditions pertaining to the appropriate development of the site. 5) The City Council, following proper public notice, held a public hearing on November 21, 1989, at which time testimony was received and exhibits were presented. Now, therefore, The City Council of the City of Ashland finds and concludes as follows: SECTION 1. FINDINGS 1.1 The City Council hereby incorporates by reference the Staff Report noted as "Exhibit A", the Site Plan submitted by the applicant noted as "Exhibit B" , the Planning Commission minutes from the public hearing on this proposal held on September 13, 1989!, noted as "Exhibit C", and the City Council minutes from the public hearing on this proposal held on November 21, 1989, noted as "Exhibit D". SECTION 2. CNCLUSORY FINDINGS 2.1I The City Council finds that it has received all information necessary to make a decision based on the Report, public hearing testimony and the exhibits received. Staff 2.2 The City Council finds that the request for Annexation and Zone Change of 22.64 acres of land located northeast of the Ashland Municipal Airport meets all criteria found in the Annexation Chapter 18.108.190. The City Council hereby makes the following findings: That the land is within the City,s Urban Growth Boundary. All of the 22.64 acres are located within the UGB. B. That the proposed zoning and project are in conformance with the City,s Comprehensive Plan. The Comprehensive Plan has indicated this area for Public Facilities. These are best accommodated by the E-1 zoning. C. That the land is currently contiguous with the present City limits. The properties are contiguous with the City Limits adjacent to the south. D. That public services are available or can be made available to the site. Water service is available to this area and can be extended to this site. Sewer service, when necessary, will be extended. Sewer will not be required for the development of hangar facilities. E. That a public need for additional land, as defined in the City,s Comprehensive Plan, can be demonstrated. The Airport Master Plan, adopted by the Comprehensive Plan as the ruling document for this area, indicates that this land is needed for the future and continued development of the Ashland Municipal Airport. SECTION 3. DECISION 3.1 Based on the record of the Public Hearing on this matter, the City Council concludes that the proposal for Annexation and iZone Change for 22.64 acres of land is supported by evidence confined in the whole record. Therefore, based on our overall conclusions, and upon the proposal being subject to each of the following conditions, Planning Action #89-155 is hereby approved. The following are the conditions of approval: 1) That a boundary survey of the properties be completed prior to second reading of the ordinance annexing the land. 2) That all lands near Emigrant Creek shall be subject to the Physical and Environmental Constraints Ordinance. 3) That all uses proposed for this property shall be subject to all requirements of the Ashland Land Use Ordinance and the Airport Master Plan. day of December, 1989.
