HomeMy WebLinkAbout1988-0405 REG MINMINUTES OF THE REGULAR MEETING ASHLAND CITY COUNCIL April 5, 1988 ROLL CALL Mayor L. Gordon Medaris led the Pledge of Allegiance and called the meeting to order at 7:45 P.M. on the above date in the Stevenson Union Arena, S.O.S.C. Elerath, Reid, Williams, Acklin, Laws and Arnold were present. APPROVAL OF MINUTES Acklin moved to approve the minutes of the regular meeting of March 15, 1988; Williams seconded the motion which passed unanimously on voice vote. MISCELLANEOUS BUSINESS: Set Public Hg. A request to set a public hearing on the 1988-89 1988-89 Budget Budget for May 17, 1988 at 7:30 P.M. was approved by the City Council. No further action necessary. Pavement Cut Winburn Way A letter was read from Public Works Director Hall requesting permission to cut pavement on Winburn Way for installation of a sewer line. Laws moved to approve the request; Arnold seconded the motion which passed unanimously on voice vote. Set Public Hg. Apeal of P.A. No. 88-025 A letter was received from Ron Kramer, 120 Wimer Street, appealing approval of P. A. ~88-025, a C.U.P. for proposed travellor's accommodation at 75 Wimer Street. The public hearing was set for April 19, 1988 at 7:30 P.M. All Councilors agreed. Set Public Hg. Satellite Dish Ord. A memo was read from the Planning Commission requesting a public hearing on an ordinance regulating satellite dishes. The hearing date of May 3, 1988 at 7:30 P.M., was agreed to by the Council. PUBLIC HEARINGS: Appeal of P.A. No. 88-012 - N.W. Natural History Museum City Attorney Ron Salter commented on the following: 1) Recommended the Council treat the controversial 5-4 vote of the Planning Commission as a 4-4 vote with no recommendation from that body to avoid having the issue remanded by LUBA should it be appealed to that Board. 2) The Mayor served on an advisory board of the applicant and not as an officer charged with management functions, therefore there is no conflict of interest. 3) Recommended the public hearing be continued until April 19, 1988 in light of questions from Richard Stevens, Land Use Planner in Medford, concerning the timeliness of the appeal notice. 4) Advised against a cross-examination of the opponents by proponents and vice-versa because land-use hearings adopted in 1978 have limited application to this hearing. 4/5/88 P. i Rec-~ar Meeting Ashland City Council 4/5/88 P. 2 PUBLIC HEARINGS: NW Natural Hist. Museum (Continued) Councilor Elerath moved to treat Planning Commission vote as 4-4 and Laws seconded the motion. Arnold asked if this would put Council in better stead and Salter said it would put burden of proof on applicant. Councilor Reid asked if this was a move to influence a future decision on an appeal and Salter said it was to clear the record to prevent a successful appeal later on. On roll call vote the motion carried as followed: Elerath, Williams, Acklin and Laws; YES; Reid and Arnold; NO. After a lengthy discussion of the validity of the notice of appeal, Arnold moved to find there was not a proper notice of appeal on the matter and to vacate the public hearing. Reid seconded the motion which passed as follows on roll call vote: Reid, Williams, Acklin, Laws and Arnold; YES; Elerath; NO. PUBLIC FORUM: Mountain Avenue Dust Problem Marie Moorehead, 310 N. Mountain Ave., asked Council to consider chip-sealing Mountain Ave. P.W. Director Hall said it has a good granite base and chip-sealing would last 2-3 years, and cost approximately $3-$3.50 per square yard. Councilor Williams told of the two- step process taken by property owners on Helman St. Robert Johnson, Mountain Ave., said the few property owners on Mt. Ave. could not afford to pay for paving. It was suggested he work with P.W. Dir. Hall to get costs of chip-sealing. Property Restric- tions on Deeds Ron Kelso, Kelso Realty, expressed concerns about restrictions on property not being recorded on deeds. Acklin moved to place this item on the agenda and Williams seconded the motion. Laws said it doesn't have to be on agenda if no action is taken and Acklin withdrew motion. Acklin said most restrictions are in files in the Planning Department. Planning Director Fregonese said items are on a deed when significant in terms of value, and items not on a deed are noted in Planning Action files which will soon be on the computer. There being no further comment from the audience, the public forum section of the meeting was closed. ORDINANCES, RESOLUTIONS & CONTRACTS: Land Dedication A resolution was read dedicating land on the South for Parks side of East Main St. between Garfield and California Streets for park purposes. Laws moved to adopt same and Arnold seconded the motion, which passed unanimously on roll call vote. (Ref. Reso. ~88-12) 4/5/88 P. 2 R_~ec- tar Meeting Ashland City Council 4/5/88 P. 3 OTHER BUSINESS FROM COUNCIL MEMBERS: A.P.A.C - Ad Hoc Memos from Councilor Laws and Mayor Medaris were read Committee concerning the Ashland Performing Arts Center. Laws requested a committee be appointed to investigate ways to secure the $500,000 matching State grant monies for A.P.A.C. Arnold moved to recommend appointment of the committee; Elerath seconded the motion which passed unanimously on voice vote. Those appointed were Councilors Laws and Williams, Lee Howard from the Budget Committee, Steve Sacks and John Schweiger, local businessmen, John Fregonese and Ken Mickelsen, City Staff, and a member of the A.P.A.C. Board of Directors. Arnold moved to approve the recommenda- tions, Laws seconded the motion which passed unanimously on voice vote. Council Appeal of P.A. 88-012 Natural Hist. Mus. Set Public Hg. Councilor Arnold moved to place on the agenda a Council appeal of Planning Action No. 88-012, a conditional use permit for the proposed Northwest Natural History Museum; Elerath seconded the motion which passed unanimously on voice vote. Arnold made a motion that the City Council appeal Planning Action No. 88-012 and set a public hearing for April 19, 1988; Elerath seconded the motion which passed unanimously on voice vote. Reset Public Hgo P.A. 88-025 Arnold moved to place on the agenda reconsideration of the date of the public hearing on the Kramer appeal, Acklin seconded the motion which passed unanimously on voice vote. Arnold made a motion to set the public hearing for May 3, 1988 at 7:30 P.M., Acklin seconded the motion which passed unanimously on voice vote. ADJOURNMENT The meeting adjourned at 9:05 P.M.
