FINDINGS,
CONCLUSIONS
AND ORDERS
RECITALS:
1) Taxlot 5200 of 391E 15AA is located on Park Street and is zoned R-
2, Multi-Family Residential.
2) The applicant is requesting a Site Review for the construction of a
30 unit apartment complex. Site improvements for the site are outlined
on the site plan on file at the Department of Community Development.
3) Criteria for the approval of a Site Review are found in Chapter
18.72,050 of Ashland's Municipal Code. This Chapter regulates the
necessary improvements to any site that is being changed in use or ex-
panded. The criteria require that all applicable City ordinances have
been and will be met, that all requirements of the Site Review Chapter
be met and that the site design complies with any guidelines that the
City Council may have adopted for implementation of this chapter.
4) The City Council following proper public notice, held
a Public Hearing on October 4, 1988, at which time testimony
was received and exhibits were presented. The City Council
approved the application subject to conditions pertaining to the
appropriate development of the site.
Now, therefore,
The City Council of the City of Ashland, finds, concludes
and recommends as follows:
SECTION 1. FINDINGS
1.1 The City Council hereby incorporates by reference
the Staff Report noted as "Exhibit A", the Site Plan submitted
by the applicant noted as "Exhibit B" and the minutes from
the public hearing on this proposal held on August 24, 1988,
noted as "Exhibit C".
SECTION 2. CONCLUSORY FINDINGS
2.1 The City Council finds that it has received all
information necessary to make a decision based on the Staff
Report, public hearing testimony and the exhibits received.
2.2 The City Council finds that the proposal for the
construction of a 30-unit apartment complex meets all relevant
criteria of the Site Review Chapter 18.72.
A number of concerns were brought up by neighboring property owners
regarding the development's compliance with City design
guidelines. First, the City Council believes that the
proposal is for an apartment complex consisting of two separate
buildings, with units 1-22 being structurally attached and being
one structure and units 23-30 constituting a second detached
structure. The Council believes this interpretation is consistent
with the definition of a structure found in Chapter 18.08,750 of
the Ashland Municipal Code. Second, concerns were raised regarding
the method of drainage for the site. It is standard procedure that
the applicant submit a drainage plan for approval to the Department
of Public Works prior to any construction occurring. The Public
Works Department has indicated that adequate public facilities
exist to accommodate any run-off from the proposed development.
Third, the revised site plan submitted by the applicant shows the
53 required off-street parking spaces, of which guest parking is
incorporated. This proposal is not a Performance Standards
development and, therefore, does not have to provide additional
guest parking as required in Chapter 18.92,020 (6) of the Ashland
Municipal Code.
The City Council finds that other concerns of neighbors
regarding handicap parking, bicycle rack installation and the
screening of the flag drive have been adequately addressed by the
applicant and included in the conditions for approval of this
proposal.
SECTION 3. DECISION
3.1 Based on the record of the Public Hearing on this
matter, the City Council concludes that the proposal
for a 30-unit apartment complex is supported by evidence in the
whole record.
Therefore, based on our overall conclusions, and upon the
proposal being subject to each of the following conditions,
we approve Planning Action #88-095. Further, if any one or
more of the conditions below are found to be invalid, for
any reason whatsoever, then Planning Action #88-095 is denied.
The following are the conditions and they are attached to
the approval:
1. That all landscaping be installed prior to the issuance of a
certificate of occupancy for any structure.
2. That hydrant requirements of the Ashland Fire Department be
met prior to the issuance of a building permit.
3. That all accessways and parking be paved prior to the issuance
of a certificate of occupancy for any structure.
4. That a drainage plan be submitted for review and approval by
the Public Works Department at the time of building permit
application.
5. That all electrical service be installed as required and to the
standards of the City Electric Department.
6. Recommend that all units be built to the City's energy
efficient standards.
7. That two handicap parking spaces be indicated on the revised
site plan. Spaces to be a minimum of twelve feet wide.
8. That two bicycle parking areas be designated on the site plan
and racks installed prior to issuance of a certificate of occupancy
for any structure.
9. That any Talent Irrigation District rights that are associated
with lines or ditches crossing this property be protected.
10. That there be one designated parking space per unit.
11. That the applicant attempt to attain pedestrian access to
Normal Street or Siskiyou Blvd via an easement.
12. That the special setback requirement between principal
structures comply with the Ashland Municipal Code.
13. That the fascia of the carports be constructed of wood and be
supported on 6'x 6' or greater wood posts, as opposed to metal.
14. That a solid site obscuring fence be installed along the flag
drive prior to the beginning of construction.
