AN ORDINANCE VACATING AN UNNAMED ALLEY OFF
BUSH STREET AND RESERVING A PEDESTRIAN ACCESS
AND PUBLIC UTILITY EASEMENT
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. On the date specified in section two of this ordinance, the public right-of- way,
which is an alley intersecting Bush Street and further described on the attached Exhibit A, is
vacated subject to: (1) a reservation of a Public Utility Easement 14.0 feet in width along the
entire length of the right of way being vacated with the north boundary of the easement being
contiguous to the north boundary of the alley, and (2) a reservation of a bicycle and
pedestrian easement five feet in width along the entire length of the right of way being
vacated. The owners, and their successors and assigns, of the properties adjacent to the
right of way (63 Bush Street and 159 North Main Street) shall maintain the bicycle and
pedestrian easement free of and clear of any objects including but not limited to temporary
structures, landscaping, refuse or recycling containers and vehicles. In addition the owners
shall not erect, place or permit any fence within the bicycle and pedestrian easement, it being
the intent of this easement reservation that the full width of this easement remain
unobstructed.
SECTION 2. The vacation of the right-of-way described in section one of this ordinance shall
become effective immediately after (1) the recording of mutual access easements for the
properties located at 63 Bush Street and 159 North Main Street, granting to the owners, their
successors and assigns, reciprocal easements for a shared driveway and for vehicular
maneuvering from parking spaces located on these properties; and (2) the removal of a small
shed and refuse and recycling containers located within the vacated right of way.

EXHIBIT A
Description of the Vacation of a Portion of an Alley off Bush Street in the City of
Ashland:
A portion of that sixteen foot wide alley situated in Block 25 of the City of Ashland,
Jackson County, Oregon, according to the Official Plat thereof adopted by the Ashland
City Council on November 5, 1888. Said vacation shall include the remaining 100 feet
of alley adjacent to Lots 3 & 4 of said Block 25.
RESERVING THEREFROM
A public utility easement, fourteen feet in width and situated along the length of the ally,
with the north boundary of the easement being contiguous to the north boundary of the
alley.
An easement for pedestrian and bicycle use, five feet in width and situated along the
length of the alley with the north boundary being contiguous to the centerline of alley.
