APPEALS LITHIA WATER FOUNTAIN OSFA LOADING ZONE NORTH MAIN BIKEWAY IBEW RECOGNITION LIQUOR LICENSE REQUEST Having led the Pledge of Allegiance, Mayor Medaris called the meeting to order at 7:30 p.m. on the above date in Council Chambers. Present were Howard, Acklin, Peterson and Laws. Dale was five minutes late and Sims was absent. Councilmember Acklin requested that minutes of the regular meeting of June 2, 1981 be corrected on page 3, second pp by inserting "not" before justifiable. Laws moved to approve as corrected; Acklin seconded the motion which passed unanimously on voice vote. City Administrator read letter from the American Legion requesting permission to serve beer during certain period on the Fourth of July and recommended approval saying there has been no problem in the past. Acklin so moved; Howard seconded and the motion passed unanimously on voice vote. A Petition from Edwin Chapman requesting installation of sidewalks on Laurel Street and request by Public Works Director to install sidewalks on Winburn Way was presented. Laws suggested the Parks Commission be given the privilege of input. (Resolution later on agenda to set public hearing for July 7, 1981 at 7:30 P.M.) Appeal petitions on Lithia Homes Development on Granite Street were presented and date for a public hearing discussed. Almquist read a memo from the Mayor reconnnending se~ting a special Tuesday evening aside for Granite Street appeals alone and after some discussion Laws moved to set public hearing for July 14, 1981 at 7:30 P.M. in the Council Chambers. Acklin seconded and the motion passed without opposi- tion on voice vote. A memo was presented from Director of Public Works requesting that designation for historical significance be applied for to AWWA. Laws moved that permission to submit application be approved; Acklin seconded the motion which passed unanimously on voice vote. A recommendation from the Traffic Safety Commission regarding two-hour parking zones on Pioneer Street was considered and Peterson moved to approve; Acklin seconded. On voice vote all YES. (Resolution to be brought back at next meeting). Recommendation to extend bikepath from Laurel Street to Church Street from the Bikeway Committee was considered and the danger of deep curb on edge of much used North Main was discussed. Laws moved to table recommendation indefinitely and Howard seconded the the motion. On voice vote all AYES with the exception of Peterson who oppoaed. Almquist read letter from IBEW relative to agreement on propoeed bar- gaining unit and Laws move to authorize signatures on agreement; Acklin seconded the motion which passed unanimously on voice vote. Council considered a seasonal dispenser Class A for new outlet known as Cedarwood Inn Motel and the Police Department approved aame after checking. Almquist was asked by Howard to check on ~e occupancy factor of incompletion of landscaping. Almquist said he would report back at next meeting. Laws moved to approve; Dale seconded and passed with all AYES. 6/9/81 P.1 LIQUOR LICENSE REQ. VINTAGE INN UTILITY SERVICES REORG. REAL PROPERTY TRANSFER TAX GASOLINE TAX PUBLIC FORUM BURN PERMIT BUSINESS L~CENSE Revocation for Fraud Liquor License application for Seasonal Dispenser license was presented and Acklin moved to approve; Dale seconded and on voice vote all AYES. Memorandum from Director of Finance Nelson was reviewed concerning reorganization of Utility Services section of the Finance Department. Dale moved for approval of concept; Laws seconded and on voice vote motion passed without opposition. City Administrator Almquist recommended amending the Property Transfer Tax ordinance by adding subsections #15 & 16 to include language which would provision for payment of tax "where a deed is recorded in compliance with a contract of sale and the tax has been previously paid in connection with that contract of sale"(#15). The other amend- ment would add #16 Where a contract of sale or Earnest Money Receipt was executed prior to the effective date of this Ordinance." In Section 4.36.120 added to the first sentence after the word "time" to read "the memorandum of contract, deed or instrument"...etc. Laws moved to put question of recommended amendments on the agenda and Peterson seconded the motion which passed with all AYES on voice vote. Almquist read amendments as part of first reading and Peterson moved to second reading as amending; Laws seconded the motion which passed unani- mously on roll call vote. Council deferred second reading to June 16 1981 meeting. The City Administrator read a letter from Ashland School Board request- ing that governmental bodies be excluded from the gasoline tax. Council discussed the appropriateness of such amendment and considered a recom- mendation by Almquist that the governmental body pay the increased cost from dealer and then apply for ~soline tax refund at the end of the year. Acklin moved to put such amendment on the agenda; Dale seconded and the motion passed unanimously on voice vote. The amendment which was read as part of first reading was as follows - "601.175 Sales to Governmental Agencies - Governmental agencies having fuel dispensing devices within the City purchasing fuel from dealers licensed here- under may apply for a refund annually for fuel purchased pursuant to Section 6.06.200 and Administrative Rules promulgated by the Director of Finance and approved by the City Council". Laws moved to pass to second reading; Peterson seconded the motion which passed unanimously on roll call vote. Council deferred second reading to June 16 meeting. Realtor Representative Kelso expressed thanks to Council for deferring second reading of Property Transfer Tax. First reading was given an ordinance relative to burn permit fees and discussion ensued. Need for increase of secretary to administer burn permits was discussed. Chapman said he would like to see more inspect- ion by Fire Department because residents are reluctant to turn their neighbors in for illegal burning. Acklin moved to second reading; Peterson seconded the motion. Howard, Dale, Acklin and Peterson voted YES, and Laws opposed on roll call vote. RESOLUTION PUBLIC FORUM ITEM PROCLAMATION ADJOURNMENT City Recorder First reading was given an o~dinance amending the penalty provisions relative to the sale of coal for space heating and Laws moved to second reading; Peterson seconded the motion which passed unanimously on roll call vote, A resolution restricting parking on Oak Street between "B" Street and "C" Street and providing a penalty was read and Acklin moved to adopt; Howard seconded the motion which passed unanimously on roll call vote. A Resolution abolishing the Airport Fund was read and Laws moved to adopt; Acklin seconded the motion which passed unanimously on roll call vote. A Resolution transferring appropriations within funds was read and Peterson moved to adopt; Acklin seconded the motion which passed with- out opposition on roll call vote. A Resolution providing for improvement by construction of sidewalks on Eo side of Laurel Street (SPRR South 215 ft.) and E. Side of Winburn Way (Playground entrance North 358 feet) was read. Type of sidewalk finish was discussed and Acklin moved to adopt as read and that Parks Commission review for their recommendation; Peterson seconded the motion which passed unanimously on roll call vote. Mayor Medaris said he meant to bring up contribution request for fire- works by Chamber of Commerce item during Public Foram. Chief Lively reported on concern of Oregon State Police because of the proximity of I-5 to the fireworks display and said that the City police will assist the Oregon State Police along with the Sheriff's department in an effort to move cars along I-5 where they have previously parked to view the exhibit. The matter of a contribution from the City was held over until the next meeting. Mayor Medaris read a proclamation declaring the month of June 1981 as "BURGLARY PREVENTION MONTH".
