have encroached the right-of-way and will need to be impre-veal and

could have a part in it. Alsing said we will want to find scme
middle ground and there will have to be some compromise and said he
would bring something back before too long. Alsing added that the
County would help financially. Greene said he has gone to the
County and that monies were earmarked if everyone signs for the im-
provement. Mayor closed the public hearing. Sims asked Alsiug
about distribution fac~lities and if there wculd be problems with
the water lines. Alsing said that a study is underway at this time
to look at future needs of water service and that its adequate at
this time. On Phelps question as to condition of Cedar Way and
Ashland Mine Road, Alsing said Ashland Mine should be classcd as an
arterial street 36 ft. in width. Sims asked Alsing about se~,rag~
overflow in the area in questdon aud was told by Alsjng that there
had been a pump problem. 0n future development of the water serv;,ce
needs, Almquist said a consultant had been asked to consrider daveleE
mental needs. Sims said the adjoining properties should ba cou-
sidered in the annexation so all property ox,mers could share in the
expense of water and other services. Systems development costs teerE
discussed and Council agreed that fees etc. must be looked into.
Fregonese agreed with need to plan for development costs. Phe!Vs
questioned the need for the annexation and said the documents
3ike any other documents and the finding don't give the informat:ion
necessary to base a decision on. Phelps said there are 340 dave]cp--
able acres ahready within the City whicb would take care o! the

Mayor Prickerr took issue with Phelps' information relative to avail..-
able land saying that its only developable if it is o~. the ~aarket at a
price so,~eone can afford and that vacant land doesn't necessarily
it available ]and. Laws moved that Council approve ann~ation and
con~tinns recorded by Planning Commission and accept findings with
documents submitted tonight cad that Staff be directed to draw up the
necessary papers and that Mr. Gre~lne be'refunded his second check;
Mealaria sec~.,nded. Sims m~>vcd to amend motion to include 9 lots in
e~pcnse of water mains etc., needed to further develop imu~diate area;
Phelps seconded. On the an~endment Phelps, Sims, Ragland, Mcdaris and
Hamilton voted YES. Laws opposed. On the original motion Phelps,
Sims, Ragland, Medaris, Laws and Hamilton all voted YES on roll call
vote. Motion passed as a~nended.
Laws moved to accept minutcs of Boards, Conunissions and Conunittees ~_~j
Hamilton moved to second the motion which passed on voice vote all-YES~
Staff recommended boring and bell hole cut and Ragland so moved; ~ha]ps
seconded and on roll call motion passed unanimously.
A letter was read from CPNUti!ities advising Council of emergency
pavement cut on Pinecrest Terrace at Oneida Circle for leak repair.
No action necessary.
A letter requesting Winburn Way closure for commencement exercises on
May 31, 1980 from 7:00 A.M. to 1:00 P.M. was considered and Medaris
moved to approve; Hamilton seconded and on roll call all YES.
A letter was read from the State Historic Preservation Office relative
to nomination of McMillan house at 110 8th Street to National Register
and the City Administrator advised Council that the matter will be
taken up at the next Historic Commission on March 5 and the next
Council meeting will be on March 4 so Almquist suggested that Council
act on condition of H.C. approval. Phelps moved for approval subject
to approval by Historic Commission; Ragland seconded and motion passed
unanimously on roll call vote.
City Adm. Almquist read a letter from John Seligmsn requestjng approval
to serve food prepared in the Merchant of Ashland kitchen from a welJ
designed and colorful cart in the first space of the parking lot
adjoining Orchard Lane. Allen Drescher representing the applicant
showed artist's conception of location and cart itself and explained
the background of Seligman as being owner and manager of Lithie !;rccery
chef at Mum's and Chata's in Talent and described his food item as
being of high quality, not a fast food. Letters of support of the
cept were submitted from six Ashland restaurant owners and the
of Commerce. The litter possibility was discussed at length.

asked what was going to be served and SeliDnan said the County wjl!

Almquist read a memorandum from Water Quality Supt. Fallen and La~.~s
moved to approve request with conditions outlined in memo; Ragland
seconded and on roll call passed unanimously.
A memorandum was read from Director of Finance Nelson submitting
audit fees from three firms including present auditor. Almq~:ist
expressed amazement at the differential in bids. Medaris agreed and
said T]schhauser's familiarity with the books and record of bavi~g
no substantial problem would favor retention of the firm. Medal is
said that Taylor's estimate of the Hospital audit may indicate tha~
the firm is not aware of the deadl~4na for their budget in o~-der to
apply for Hill-Burton funding etc. for services to disedwin!raged etc..
fundi~g. Nelson said he ha~ no problem with any of the firms and
would be able to satisfy the government iu any cese. Jerry B~;~'t~

Mayor Pr~ckett recommended a procedure to routinely reconsider audit
proposals every three years as business practice. Medaris said
would like to see Tir~cbhauser reta'ined and felt we should keep the
money in Ashlabd. On Ragland's question of Nelson as to whether we

~-l~e affirmative saying that righ~ was reserved. La~s moved to accept
Taylor's bid; Phelr~s secoaded. Sims said ha would like to make

Letter and lease p~oposa] by Sunshine Wood Froducts for use of C~ty-
owned ]and now ]eased by the Wrauglers was considered and Mayor rec-
ommended that committee be appointed to meet with Sunshine Wood Prod-.
ucts/Wranglers and bring back recommendation to Council. Leigh John-
son said there have been meetings w~th SunShine and that the Wra_ng--

Liquor license application by Charles R. Myrick £or Alejandro's
resturaunt of 131 East ~,~ain Street was considered and Sims asked the
Police Chief if he anticipated any problems and Lively said he did
not. Sims moved for approval; Phelps seconded and on roll call
motion passed unanimously.
Lowell. Smith of Cook's Reception requested he be allowed to serve
food after-hours at his establishment on Friday and Saturday nights
only for a trial. Smith stressed that no l~quor would be served.
Mayor Prickett expressed concern that people would converge to eat
and that problems of having a crowd at that time could put pressure
on Police Department manpower. Chief Lively agreed with the Mayor.
Smith said he will try it out if approved; otherwise would drop the
proposal if it created problems. Phelps moved to approve on trial
basis to October lst; Sims seconded. Ragland asked tbat Smith keep
Council posted as to results. Laws recommended that OLCC allow trial
through October and then review results. On roll call, all YES.
A memorandum from the City Administrator was read regarding recom-
mendation by Senior Program Board proposing tbe installation of
smoke detectors for low-income senior citizens. Almquist said the
Fire Department is anxious to do the work. Sims moved to approve
transfer of line item to cover expenditure; Phelps seconded. Laws
suggested that the proposal be changed to include people who now g~t
utility discount. Council agreed. On roll call, all YES.
A memorandum from City Surveyor relative to proposed vacation of
a strip of land on Vista Street was read and Almquist said there is
a resolution later on agenda, and said he would come back with more
information at the public hearing.
Ragland requested that public hearing be set for March 18, 1980
to consider bikepath on E. Main Street from L~thia Way to Californe~
Street. Ragland said ha wants the hearing after the Planning Com-
mission of March 12, ].980 snd is anxious to progress before any
later in the budget process.

Second reading by title only was given an ordinance levying assess-
ments in Street Improvement District #45 and Laws moved to adapt;
Ragland seconded and on roll call passed unanimonsJy.

A resolution was read setting a date for a public hearing on the pro-
posed vacatiou of a 1-3 foot strip of the right--of-way on V~sta Stree
for April. 1, 1980 and Laws moved to adopt; Phelps seconded and on
roll call, all YES.

Liaison Reports Phelps asked how the City handles houses which have been burned and
in disrepa]r and the City Admffnistrator Almquist said the building
code provides for abatement of dangerous buildings, and thai:. he
would check on the particular one on Siskiyou near Beach being re-
