HomeMy WebLinkAbout1979-0417 REG MINMINUTES OF THE REGULAR MEETING ASHLAND CITY COUNCIL April 17, 1979 ROLL CALL APPROVAL OF MINUTES MINUTES OF BOARDS, COMM- ISSIONS & COMMITTEES FOSTER SEWER CONNECT REQUEST - OUTSIDE CITY LMTS MURPHY NOISE REQUEST FOR BLUEGRASS FESTIVAL "CLEAN AIR WEEK" PUBLIC FORUM Mayor Prickerr led the Pledge of Allegiance and called the meeting to order at 7:30 P.M. on the above date in the Council Chambers at City Hall. Phelps, Medaris, Hamilton and Ragland were present. Sims arrive a few minutes late. Laws was absent. Medaris asked for corrections in the minutes of the April 3, 1979 meeting on page 3, second paragraph to show that in answer on David Hoffman~s request for clarification on the status of the Hill amendment, Planner Box said it still stands and would be read later in the meeting. Medaris also asked that on page 6 under Council Liaison Reports that vote be shown on Sims motion to authorize up to $200 for an employs or staff member to attend Conservation Confer- ence. "Passed unanimously" shoald be added, Phelps moved to approve minutes as cerrected; Ragland seconded and on voice vote, all YES. Ragland moved to accept minutes of boards, commissions and committees and Hamilton seconded the motion. Passed unanimously on voice vote. James Mulhall, Attorney with Davis, Ainsworth et ~1 spoke oh behalf oz applicant after the City Administrator reviewed the request and pre- sented a map showing the location of commercial center on Dead Ind- ian Road contiguous to the City on two sides. After discussing the need for the sewer connect Mayor Prickett recommended annexation to the City so that planning, landscape etc. controls can be placed on present and future development because of lack of stringent controls by the County, Phelps expressed concern of adjacent flight pattern and safety and agreed with Mayor~s recommendation. Phelps moved to deny request; Ragland seconded and on roll call, passed unanimously. Ragland moved to deny request; seconded by Phelps and passed without opposition on roll call vote. City Administrator Almquist read a letter from the City of Medford relative to observation of "Clean Air Week" in the Rogue Valley from April 29 to May 5. Almquist read a proclamation to declare "Clean Air Week" in the City of Ashland during that week in which criteria for observation was set down. Phelps moved to authorize signature of Mayor and Recorder; Medaris seconded and on roll call, motion passed unanimously. Almquist reported that the Parks & Recreation Commission had recom- mended demolition of deteriorated house on Wade property now owned by the City and that City Attorney Salter approved the proposal to let out bids for same. Ragland moved to authorize Staff to proceed with proposal; Medaris seconded and on roll call, all YES. Will Stump of 160 Alida asked to speak on Building Department status and the Mayor asked him to include comments when the subject came up later on the agenda. 4/17/79 Pg, 1 Regu~ar~-~eeting Ashland City Council 4/17/79_ Fg. 2 _ BUILDING DEPARTMENT ASHLAND AIRPORT EXPANSION CALHOUN WATER SERVICE REQ. PP&L RE: HYDROELECTRIC GEN. Almquist reviewed the matter of securing a qualified building inspect- or saying the most qualified individual declined the position and said we have until May 1 to turn the inspection process over to the State and County to supply. Almquist said at this point recruitment has not gone outside the State of Oregon, and in the absence of find- ing a qualified person that the present Building Official will spend two days a week until the problem is solved. Almquist suggested that the meeting be adjourned to next Tuesday night and advertise a public hearing to get input from the builders, developers and anyone within the community interested. Stump said it is not a good idea to turn the process over to the County because a lack of responsibility to this community, Stump then suggested that builders etc. be appraised of new codes etc. to preclude placing the inspector in a defensive position and suggested that a newsletter be sent out keeping builders aware of changes and procedures they are expected to follow. Stump recommended a more professional calibre of building department personnel. Conmissioner Don Schofield spoke on proposed Airport expansion as it relates to Bear Creek Greenway and said he has had calls from people who feel threatened by expansion to eventually provide for use by Jet airplanes. Schofield said the airport expansion project is in Jeopardy since the Con~nissioners have never formally accepted the Airport Master Plan. Mayor Prickett resented the statement sayin~ the City had agonized over the plan with many public hearings and had made the plan available to all interested agencies and at this point in time could hardly conceive of any Jeopardy and noted that the project is going to bid shortly. Rebecca DeBoer assured Council that an alternative can be work out as far as the Greenway is con- cerned. Cliff Chaney, Chairman of the Airport Committee assured the Commissioner that there are small planes which use Jet fuel and this is the reason for jet tanks being installed before apron construction. Mayor said that he would welcome questions after the Commissioners have read the master plan. Sims said that questions and answers on the plan could be generated'and used for final assurance to the public and added that there is a load limit of 12,000 pounds on the runway set down by FAA and other criteria making it unfeasible to entertain expansion for larger airplane use. Alsing noted that bids are being taken on the 27th and the job must be done by June 15th of the coming year or we may lose the funding. Alsing said that anything (fuel) that went into the creek would have to travel 3,000 feet. Almquist said the project has been through A95 Review and approved by County and the only place where a problem could develop is in the zoning but the plan has to be approved first. DeBoer said she resents the inference that the Greenway Committee will hold up the project and that concern was a legitimate one which can be worked out. Request for water service at 135 Mistletoe was read by Almquist who said applicant was out of town and could not present his request per- sonally. Phelps moved to table; Ragland seconded and on roll call, motion passed unanimously. A letter was read from PP&L relative to Ashlandis proposal to install a hydroelectric generator in the watershed and Mayor Prickerr asked that the City Administrator bring complete report to next meeting. 4/17/79 pg~ 2 Re~ular--weeting Ashland City Council 4/171~9 P~. 3 TRAFFIC COMMITTEE RECOMMENDATIONS COUNTY ZONING MAP & COMP PLAN - NORTH INTERCHANGE LEGISLATIVE CORRESPONDENCE Councilwoman Hamilton reveiwed three recommendations from the Traffic Safety Commission the first one being request for approval for the Rogue Valley Transportation buses to stop on the east side of Walker Avenue midway between Highway 99 and Greensprings (Hwy 66) Highway. Hamilton said it would not conflict with school children except once during the day and recommended approval. Hamilton reviewed the closure of Hitt Road and Carroll Corliss spoke saying that there are only two or three property owners involved and the road is otherwise just being used by trail bikers, four wheel drive rigs etc. which cause environmental damage and a noise nuisance. It was noted that support for proposal had come from Forest Service and BLM and Almquist said there would be no problem for the fire dept. as the locked gate proposed could be cut for entry and said fire trucks are equipped for such problems. Salter said unless every property owner approved the concept, there should Be a public hearing. Hamilton reported on the third recommendation which is to reduce speed on MAin Street and on Lithie Way/C Street because the signals are set and signed for as 30MPH and should be 20MPH according to the State which is tn control of the speed limit because it is a State highway (HWY 99). Phelps moved to accept #1 and #3 recommendations; Ragland seconded and on roll call, all YES. Ragland then moved to hold a public hearing to pursue vacation of Hitt Road. Medaris seconded and on roll call, all YES. Alm~uist was directed to bring back resolutior setting public hearing to vacate on Council's own motion. Mayor Prickett asked the Director of Public Works to check signal time set on Lithie Way. Richard Box, Planning Director, reviewed North Interchange proposals by County and noted a hearing is being held next Wednesday and urged that the City gets tt"s input into the record during that final hear- ing on the matter as it relates to the City"s planning. Box said the Planning Commission has shown concern with the Jackson Hot Springs area involving access problems and the entire area of mutual concern. Mayor directed Box to request postponement of the hearing until such time as Council could meet and hold a public hearing for assurance of public and input into plan. Ragland said he Had no objection to a public hearing but noted that during the earlier planning stages hear- ings were held and people did have the opportunity to speak at that time. Mayor Prickerr suggested that a meeting be held for this pur- pose on Friday afternoon should the County not wish to postpone their meeting. Hank Hampton spoke in support of public hearing. Mayor Prickerr said that the City Administrator had been corresponding with the Legislators on bills introduced which might affect different areas of City government and suggested that on any controversial sub- Ject that each member of Council be given a copy of a proposed letter or polled for opinions on matter of concern. 4/17/79 pg~ 3 Regular eting Ashland City Council 4/17~7Q Pg. 4 MAYOR~S APPOINTMENTS HILL AMENDMENT ORDINANCE WATER & SEWER RATE ORD. Phelps moved to confirm; Sims seconded and on roll call Phelps, Sims, Hamilton and Medaris voted in favor of appointment; Ragland opposed and the motion carried. The Mayor appointed Judy Schaefer to the Hospital Board and Phelps moved to confirm; Hamilton seconded and on roll call, all YES. Second reading by title only was given an ordinance amending the Ashland Comprehensive Plan (Hunter & Madeline Hill, Applicants) and Phelps moved for adoption; seconded by Hamilton and passed unani- mously on roll call vote. First reading by title only was given an ordinance copies of which had previously been furnished members in accord with City Charter and Ragland moved to second reading; Phelps seconded and on roll call passed unanimously. First reading by title only was given an ordinance copies of which had been previously furnished members in accord with City Charter and Medaris moved to second reading; Hamilton seconded and on roll call passed unanimously, First reading was given an ordinance dispensing with an election and calling a public hearing on a proposed annexation and withdrawal from Jackson County Fire District 5 and Hamilton moved to second reading; Medaris seconded and motion passed unanimously on roll call vote. A resolution was read transferring appropriations within Funds (Hospital). In the absence of the Finance Director for explanation Phelps moved to defer until next meeting at which the Hospital Admin- istrator could be present; Hamilton seconded and on roll call passed without opposition. The proposed airport lease was read by the City Administrator and Hamilton moved for Mayor's authority to sign; Ragland seconded and on roll call, all YES. Mayor recommended airport expansion be covered in monthly newsletter. A proclamation was read calling for "International Festival Week in Ashland" and Hamilton moved to sign proclamation; Ragland seconded and on roll call passed unanimously. Accepted on Ragland's motion and Hamilton~s second and passed without opposition on voice vote.
