HomeMy WebLinkAbout1979-0724 ADJOURNEDMinutes of Adjourned Meeting Ashland City Council July 24, 1979 ORDINANCE: CONDOMINI[tMS The meeting was held at 7:25 p.m. on the above date at Room 317, SOSC Stevenson Union. Present were Council- members Phelps, Sims, Ragland, Medaris and Laws. Mayor Prickett and Councilmember Hamilton was absent. Chairman Ragland called the meeting to order and asked for the second reading by title only of an ordinance requiring the issuance of a Conditional Use Permit for the construction or conversion of condominiums. Several people in the audience asked to speak prior to the reading. Vincent Oredson, Building Contractor, spoke in opposition of the ordinance saying he felt it would be hard to administer and would also be a burden on the builder. Oredson said it would be extremely difficult for a builder to address public need, etc. Councilman Sims said the intent of ordinance was directed to protect students and low income people. When apart- ments are turned into condominiumsit causes higher rent in the fewer apartments available, Sims explained. Jack Davis, Attorney, also spoke in opposition to the ordinance and said he was a specialist in the field of designing condominions and feels there is a need in Ashland for this concept. Davis said condos are less expensive than a regular home, easier to maintain and there is a safety factor living in a multi-family situation. John Zupan, Broker, spoke opposing the ordinance. He noted that LCDC has set goals for local governments to follow concerning condominiur~s and feels there is a definite need. Leo Zupan, Broker, said he is in favor of ordinance except not in favor of conditional use. The ordinance should be directed at conversions and suggested that more land be designated R-3. Councilman Laws explained that there is only a limited amount of R-3 land available and the use of R-3 for condos will increase the cost of rentals. He said there is not a free market for R-3 land in Ashland and it is being regulated for the best interest of the people of Ashland. 7/24/79 Pg. 1 FINDINGS OF FACT YOUTH HOSTEL MURAL: ADJOURNMENT City Administrator gave second reading by title only. Medaris moved to delete CUP requirement, motion died for lack of second. Laws movedto adopt., PhelDs seconded the motion which passed with Phelps, Sims, Ragland and Laws voting in favor, Medaris opposed. Phelps moved to adopt findings-of-fact relative to the granting of a Conditional Use Permit to establish a Youth Hostel at 421 Walker Ave., Sims second. Medaris said he wondered if legally Phelps could make motion since he didn't vote on the original approval. After a short discussion, Phelps withdrew his motion, Sims with- drew second. Sims moved to adopt findings, Laws second Medaris said he could not support the Youth Hostel in this location. He noted that the area is zoned R-1 and this type of use is illegal, also he stated the building was not a public building but a residence owned by SOSC. Medaris said the findings do not show that there would be no adverse effect on the neighborhood and public need has not been established so the findings should not be approved. Laws said there was no conflict of interest and felt Phelps could make motion and vote. On roll call vote motion to adopt findings passed with Phelps, Sims, Ragland and Laws voting yes, Medaris no. Ragland asked that council reconsider earlier action and allow Brian Freeman to complete a mural that he is painting on a wall on Water Street. Ragland explained that Freeman had taken proper steps and received permission from the City prior to starting the painting. Phelps moved for City to accept mural, Sims seconded.
