CHAMBER - VISITOR'S BUR. HISTORIC PRESERVATION BARNES APPEAL OF PA #79-117 PUBLIC FORUM After leading the Pledge of Allegiance Mayor Prickett called the meeting to order at 7:30 P.M. on the above date in the Council Chambers. Phelps, Sims, Medaris and Laws were present. Hamilton and Ragland were noted as absent. Phelps moved to approve minutes of the regular meeting of Septem- ber 18, 1979 and Sims seconded the motion. On voice vote motion carried by unanimous vote. A memorandum and map were submitted for the improvement of Glenn Street from North Main Street to Willow Street and it was noted that an ordinance was later in the agenda. Mayor Prickerr opened the public hearing and there were no comments, either pro or con, from the audience. Laws moved to accept minutes of boards, commissions and committees and Medaris seconded the motion which passed unanimously on voice vote. A letter from the Board of Directors of the Chamber of Commerce was read indicating they would be returning unused portion of budget allocated for Visitor and Convention Bureau in the amount of appro~ imately $2600. Mayor Prickett said he would be happy to accept on behalf of Council, no action necessary. A letter from the State Historic Preservation office was read for information only stating receipt of nomination form for (a) First National Bank, Vaupel Store and Oregon Hotel. No action necessary. The City Administrator reported that Gerald W. Barnes had withdram the appeal he had filed on September 27, 1979 and read a letter from Barnes stating he had received assurance by applicants Schliel lng et al that an easementfor public access along Ashland Creek of at least 15 feet from the Creek bank would be granted for pedestri~ walkway for access to be dedicated to the City. Staff was asked t. follow through on the drawing of necessary documents. Laws report ed he had researched ballot titles in past elections regarding greenway properties and brought up the $10,000 of revenue sharing funds which the citizens.had approved saying it had not been used for greenway land acquisition and suggested greenway land acquisi- tion be made an agenda item for the next meeting. Councilman Simssmoved to place land donation from Tolliver on the gend; ~ seconded and Council agreed on voice vote. Sims then a a sz~ moved to accept donation of land from Howard Tolliver; Phelps seconded the motion. Mayor cautioned against placing of items without background data on the agenda during public forum. On roll=call vote, motion passed unanimously. IMPROVEMENTS PROTEST Mayor Prickett asked that appointment of City Administrator Almquist to act as Planning Director during selection of replacement for Box be made. Sims moved to place on agenda; Phelps seconded and on roll call, passed unanimously. Laws moved for approval of appoint- ment; Phelps seconded and on roll call vote motion carried without opposition. Jan Rich, representing Southern Oregon Citizens Against Toxic Spraying reported that BLMplans on spray program and use of 2-4-D in watershed area and suggested monitoring water in T.I.D. Rich recommended that Council inform Jackson County of it's concern and ask that BLM use dye in all Sprays in watershed for identification purposes. Rich reported that Talent has had their water tested and asked that Ashland test before and after spraying to let people know outcome as soon as possible if there is evidence of toxic materials as result of herbicidal spraying. Alsing explained the City is not now using T.I.D. water for drinking and that the water- shed area is not under control of BLM but of the Forest Service and that he was concerned that people would become unnecessarily con- cerned and alarmed by such reporting. Rich corrected her statement by saying she meant to say Howard Prairie,(source of T.I.D.) and spraying is taking place within 800 feet of the lake. Sims ex- plained his concern saying that residual effects can continue to be present and that it wouldn't necessarily mean fatal poisoning but a gradual buildup of the toxins in the system over a period of time. Sims asked that subject be made an agenda item for the next meeting to formulate steps which can be taken to preclude problem. Alsing said that tests are made each year by Umpqua Labs as prescribed by the Safe Drinking Water Act and this is the lab being recon~nended for testing. Ken Mickelson, P & R Director invited Council to Greenway meeting Parks & Recreation is holding next Wednesday night with Planning Commission at 7:30 P.M. Kent Erskine asked to speak on the Glenn Street Improvements saying he missed the public hearing on the issue earlier in the evening because it was reported as though it was in the middle of the agenda according to the local paper. Mayor Prickett expressed con- cern that Erskine would be allowed to speak when others had not done so and explained position to Erskine. Erskine said he had signed a petition against the paving and filed it with the Recorder. Laws moved to reopen public hearing because no one had left the room and it wasn't as though it were after the fact; Phelps seconded and motion passed with unanimous voice vote. Erskine said he is against proposed improvements because other property owner had divided his lot into three parcels for development and 'he (Erskine) had the total cost to bear which witllzcreate a burden on his financial capabilities. 10/2/79 Pg. 2 Regular M~eting Ashland City Council ~'6/2/19 P.4 SOROPTIMISTS AGREEMENT ON SENIOR VAN BIKEWAY COMMITTEE DEPARTMENTAL REPORTS ADJOURNMENT Nan E. Franklin City Recorder Phelps ~ved to authorize ~yor and Recorder to sign agreement as presented; Laws seconded and on roll call, all YES. Deferred until return of Councilman~gland at next meeting.
