STREET CUT REQUEST ASHLAND MILLS HOSTEL PUBLIC FORUM After leading the Pledge of Allegiance, Mayor Prickett called the meeting to order at 7:30 P.M. on the above date in the Council Chambers. Sims, Phelps, Medaris and Hamilton were present. Laws was absent.' Medaris asked that the last item on page one of the minutes be corrected to read "Laws seconded" in the second sentence. Medaris then asked that minutes for meeting'of September 18 be corrected on Da~e two relative to herbicidal sprays by adding the following to line three "which is used for drinking water". Phelps moved to approve minutes of the regu- lar.meeting of 9/18/79 as corrected; Ragland seconded and unanimously on voice vote. Ragla~d moved to accept minutes of all boards, committees and commiss- ions; Hamilton seconded and on voice vo~ethe motion passed unanimously. A letter was read relative to a request by California-Pacific Utilities to cut a hole on Carol Street to make service connections. Ragland moved that request be granted providing street be bored and cut valve hole over main. Phelps seconded and on roll call, all YES. A request to cut W. Nevada to bore a service at 142 W. Nevada was read from California-Pacific Utilities Company and Phelps moved approval pro- vided the cut is bored; Sims seconded and the motion passed unanimously on roll call vote. Phelps moved to accept report on the Ashland Mills Hostel and Sims seconded the motion, which passed unanimously on roll call vote. A1 Fusco appealed to Council and the Chief of Police for consideration as regards the Halloween damage by egg throwing and other acts of vandal- ism and suggested punishment for such acts. Fusco brought out the throw- ing of eggs specifically because of their acid content which not only sticks to the surface of buildings and vehicles etc., but which deterlet~ ates the paint causing unnecessary expenses to the victims of such acts. Phelps expressed concern that punishment and booking should take the place of acts which may be deterred by planning of activities for the young people on Halloween. Police Chief Lively said that an ordinance covering disorderly conduct could be implemented but said it is most difficult to pursue the violators because of the groups gathering to "celebrate". Lively added that a juvenile officer is on duty on Hall<~- ween but with him and added force it would be difficult if not imposs- ible to eliminate the incidents. It was recon~ended that schoo].s be encouraged to add the expense and damage aspects of Halloween along with the safety of the youngsters and that spots on radio and television in public service messages be given as regards concerns expressed by Fusco and the group he represents. Fusco reminded Council that a petition had been submitted last year containing signatures of one-hundred sixty persons. Fusco asked that consideration be given possible suspensj.on of egg sales to youngsters by retailers for a period of time - the day before and Halloweer~. James Welch of 183 E. EMMA & ELKADER PAVING BIKEPATH COMMITTEE HERBICIDAL SPRAYING Mayor Prickett said the City is naturally concerned about the behavior and effects on citizens but felt the responsibility should rest on the part of the parents who should give positive direction and monitoring to prevent destruction at this and any other time. Fusco suggested schools be asked to remind parents of problems and ask their cooperation in a notice they will be sending out. Chief Lively reported on his RIDE-ALONG program and invited Councilmem- bers to take advantage of opportunity.and suggested Halloween night may be a good time to observe action. Lively said that the Mayor has spent one evening which developed into one of much activity on the shift. Ragland suggested the item be place on next agenda for full report. Dick Pischel of 839 Roca criticized City for lack of progress in con- nection with construction of curbs and gutters in preparation for paving of tl~ma & Elkader Streets and said that property damage may result un- less execution of the contract is not enforced by the City Attorney. Pischel said that if the contractor is too busy or not interested etc., new bids might be advertised for with an increase in cost per foot to be allowed participants and contractor(s) would make themselves avail- able. Director of Public Works expressed concern that the contractor had overscheduled himself and said he is hopeful that he will come back to finish the streets mentioned sometime in the following week and should he appear on the job he will be able to complete the job shortly with his equipment. Alsing said he would rather give the present contractor a chance to return rather than starting all over which would take more time in the long run. Dick Joseph spoke for himself, the Reynolds, and the Don Kiernans saying that the property owners are faced with a hazardous and property damaging winter should this work not be completed as contracted immediately and suggested that another contractor be secured since he understands this is a "hobby" with the present con- tractor. City Attorney Salter said that the City must accept the low bidder and had a recent experience in that regard. Salter said he had not been advised of any specific problem as to paving construction and since he is now aware will act accordingly and report back. Medaris moved to place on agenda; Ragland seconded and on roll call, all YES. Medaris moved City Attorney investigate the contract and to see if the penalty clause can be used and to take appropriate action to get the job done; Ragland seconded the motion which passed without opposition, on roll call vote. Mayor Prickett appointed Councilman Ragland, Chairman with Mike Altabet, Dave D'Olivo, Richard MOore, Hank Hampton and Steve Kocsis to serve on Bikeway Committee. Sims moved to approve with Chairman's option to expand the cormnittee. Hamilton seconded and the motion passed without opposition on roll call vote. Alsing showed locations of spraying of herbicides on a map posted and said that spraying has taken place within a half mile of Ashland's water source at Howard Praire but none took place in watershed. Mayor asked cost of testing of Howard Prairie water and was told it runs about $50 for each chemical at a total cost of $150. Mayor recommended that such test be given on first draw and Phelps so moved; Sims seconded and on roll call, all YES. 10/16/v9 p. 2 Regular Meeting Ashland City Council 10/16/79 P.3 SOCATS REPORT GREENWAY MURALS - Sign Ordinance MANAGEMENT PERFORMANCE EVALUATION pROGRAM UPDATE OF AIRPORT M.P. ORDINANCES, RESOLUTIONS AND CONTRACTS GLENN ST. IMPROVEMENTS POSITION CLASSIFICATION MERCHANT POLICE MECHANICAL CODE James Walsh submitted three copies of letters from the Lane County Board of Commissioners relating to herbicide spraying and the federal govern- ment's responsibility and position in the matter. Commissioner Rust of Lane County invited respresentative(s) from the City of Ashland to join in a conference being held on October 22 at the Lincoln County Courthouse and Sims moved to send one delegate to the conference; Phelps seconded. Mayor Prickett recommended that Alsing accompany Councilmember and Sims amended his motion to include Alsing; Phelps concurred and the motion passed unanimously on roll call vote. Ragland moved the City of Ashland take over the Greenway land 1) to acquire land from willing sellers whenever and wherever financially possible to do so or, 2) in event someone comes for a privilege (to develop land) the City pursue acquiring the land along Ashland Green- way by donation or being allowed to purchase it. Phelps seconded. Medaris said that the Charter spells out Parks Commission responsibili- ties and disagrees with concept of motion. On roll call Phelps, Sims, RAgland and Hamilton voted YES; Medaris opposed. Almquist read a memorandum from the Planning Commission relative to the question of murals and Ragland expressed concern that the City finally got rid of billboards and then envisioned murals cropping up and moved that ordinance be drafted that murals not be allowed. City Attorney Salter said it would be necessary to have a public hearing and Ragland withdrew his motion and moved that a public hearing be held on the question; Medaris seconded and on roll call passed unanimously. Almquist presented program draft to Council as a guide and briefly reviewed the general plan for Council asking for input. It was decided that a study session should be held in the near future for input from Council. Medaris commended the Administrator for composition of plan. Sims moved to approve update of Airport Master Plan; Medaris seconded and on roll call, all YES. Sims said he would like to see the changes addressed in the update. Second reading by title only was given an ordinance authorizing and ordering the improvement of Glenn Street from North Main Street to Willow Street and Medaris moved to adopt; Hamilton seconded and on roll call, all YES. Second reading was given by title only to amend Ord. 1415 as amended and adopt position classification plan and Ragland moved to adopt; Phelps seconded and on roll call passed unanimously. First reading was given an ordinance amending Ord. No. 1194 relative to licensing of merchant police. Hamilton moved to adopt; Medaris seconded and on roll call the motion passed unanimously. Almquist read a resolution adopting the 1979 UMC Schedule of Mechanical Specialty Code Fees as authorized by HB 2561 and Medaris moved for adoption and Ragland seconded the motion which passed unanimously on roll call vote. 10/16/79 P. 3 Regular Meeting Ashland City Council 10/16/79 P. 4 STATE AGENCY AGREEMENT A State Agency/City Cooperative Agreement (between City and S.O.S.C.) was reviewed and Ragland moved to authorize signature of Mayor; Sims seconded and on roll call, all YES. DEPARTMENTAL REPORTS Ragland moved to accept; Hamilton seconded and on voice vote, all YES. COUNCIL LIAISON REPORTS None ADJOURNMENT The meeting adjourned at 9:25 P,M.
