Mayor Gary Prickett called the meeting to order after leading the
Pledge of Allegiance on the above date at 7:30 P.M. in the
Council Chambers. All councilmembers were present.
McCannon moved to approve minutes of November 21, 1978 and Hamil-
ton seconded the motion. On a voice vote, passed unanimously.
City Administrator Almquist read a letter from W. H. Hampton and
reviewed the location of the alley saying that part of it was in-
side the Pitchford building and recommended approval of the vaca-
tion. Hampton was in the audience and said the alley serves no
purpose and with vacation would go back on the tax rolls. The
Mayor opened the public hearing and there were no comments from
the audience for or against. (Ordinance later on agenda).
A petition was submitted from property owners for improvement of
Diane Street from Tolman Creek Road to Jacquelin Street with
curbs, gutters and paving. Mayor Prickett opened the public
hearing and asked for comments against. There were none. Laws
commented in favor on behalf of Mrs. Springer and the public hear-
ing was closed. (Ordinance later on agenda)
A petition signed by one property owner petitioning improvement
of an alley between Hersey Street and Van Ness was presented and
the Mayor opened the public hearing
and asked for those in opposition to speak. Mel Johnson
and Joe Delsman spoke in opposition saying they are not only
against the cost but the resultant traffic it would generate.
Director of Public Works said the request is unusual in that the
proposed work has been imposed by the Planning Commission as a
condition on use of alley and should the members of Council dis-
agree with the concept the applicant will have to pay the full
cost of improvements. There were no other comments (in favor)
from the audience and Ragland moved not to have the ordinance reac
Drescher seconded the motion and on roll call vote, all YES.
Almquist reviewed Winburn Way sidewalk improvement petition. The
Mayor opened the public hearing. There were no connnents from the
audience either in favor or opposition so the Mayor closed the
public hearing. (Ordinance later on agenda).
The City Administrator read a letter from the Planning Commission
requesting approval of CP Change #9 to conform with the original
intent of the plan that the 1.6 acres in question be zoned as
Urban Low Density Residential. Almquist requested that the~Staff
Report dated October 11, 1973; Notice of public hear~pg; Finding~
of Fact submitted by applicant be made part of the record. Mayor
Pric'k~t opened the public hearing and there was no comment from
the audience. McCannon moved to bring the ordinance back; Rag-
land seconded and on roll call, all YES.

Ragland moved to accept minutes of boards, commissions and com-
mittees and Hamilton seconded. Motion passed unanimously on
voice vote.
Atmquist read a memorandum from the Director of Public Works
requesting permission to cut pavement on Mary Jane Avenue by
California Pacific for a gas service. Drescher moved for approval
Hamilton seconded and on roll call the motion passed unanimously.
Request to cut pavement on East Main near Sherman was considered
and Drescher moved to approve request; seconded by Laws and passed
without opposition on roll call vote.
A letter was read from Darrel & Lana Boldt requesting modification
of ordinance relating to heights of structures. The request was
referred to the Planning Commission for consideration in study
session with report back requested by Council.
No response from audience. Ragland reported that as a member of
the planning study group he is concerned with the careless devel-
opment of South Ashland with little or no planning as pertains to
tranffic patterns etc. Ragland said that there may be a proposal
for a 20 acre business center and recommended that animmediate
moratorium be placed on commercial building until such time as
guidelines can be established to preclude further problems by
indiscriminate growth. Mayor Prickett suggested that a moratorium
might be viewed as a radical measure. Ragland asked that a public
hearing be held in two weeks at the next meeting of the City
Council. McCannon moved to place item on agenda; Drescher
seconded and on roll call, all YES. Box said that no one will be
able to come in and be processed within a couple of weeks because
of the time it takes for site reviews, plan checks etc. The Mayor
asked that Box bring a moratorium proposal in writing for next
meeting and requested that Almquist take care of public hearing
notices etc.
Ragland moved that Bear Creek Greenway acquisition be placed on
agenda; Hamilton seconded and on voice vote, all YES. Ragland
requested letter be sent stating Ashland's acceptance to title
of lands acquired by the Greenway Committee in Ashland and
Phelps so moved; Drescher seconded and on voice vote the motion
passed without opposition.
Almquist read a memorandum from Acting Chief Lively regarding
egg throwing as requested at previous meeting. Lively submitted
several remedies which would effectively remedy the situation but
felt that education was the best way to address the problem.
Mayor Prickett submitted a list of names for appointment to the
newly formed energy conservation committee. McCannon moved to
approve appointments; Drescher seconded and the motion passed
unanimously on roll call vote.

City Attorney Salter recommended that since the P,U.D. was
returned to the Planning Commission for a general study of
access to that part of town that Council might want to consider
returning Susitna Heights to the Planning Connnission for study
because of its close relationship in area ~nd problem. Laws
said it was his understanding that that was the intention when
the P.U.D. was sent back. Laws moved to ask Planning Conmission
to include Susitna in its access study; Phelps seconded. Dres-
cher asked if this move means we are backing off the original
decision on Susitna and Salter said that as the case stands we
did not meet findings of fact and I had recommended the petition
be be quashed because the decision making process hadn't been com-
pleted and judge has ruled he can't determine whether findings
were made or not and if he decides they were not made then he
will send it back to City. Salter added that Alsing was on
vacation when the matter came before Council and his testimony
is important relating to access and remedies if we have to come
back before Circuit Cout. Salter said Alsing's testimony can
be added to the record which will help in the deciison making
process and in litigation.
Sid Ainsworth, representing H & S Construction said what Council
is considering is highly improper and prejudicial since the sub-
division approval was not appealed either by himself or the City
but that the appeal was based on the three conditions placed on
such approval. Laws said we are simply asking the Planning Com-
mission to better the conditions which were attached as minimum
and are not backing away from any authorization previously given.
Ainsworth said you can't ask for something you adopt after the
fact. Salter said he thinks it will come back to Council for
findings of fact and the study will be of further assistance on
those findings. Motion passed unanimously on roll call vote.
Almquist gave second reading of ordinance creating Youth Council
by title only and Laws moved for adoption seconded by Ragland and
passed unanimously on roll call vote.
City Administrator Almquist gave first reading of the Suhdivision
ordinance and Drescher moved to second reading; Phelps seconded
and the motion passed unanimously on roll call vote.
Almquist gave first reading of an ordinance vacating an alley off
Sherman Street and McCannon moved to second reading; Hamilton
seconded the motion which passed unanimously on roll call vote.
An ordinance authorizing improvement of Diane Street was given
first reading and Drescher moved to second reading; seconded by
Ragland and passed unanimously on roll call vote.
Almquist gave first reading of an ordinance on proposed instal-
lation of Winburn Way sidewalks and Drescher moved to second
reading; Phelps seconded and on roll call, all YES.

Mayor Prickett read a Proclamation marking the thirty-seventh
anniversary of the Civil Air Patrol.
Laws submitted suggestions for guidelines on role of the newly
appointed Conservation Committee. Mayor asked Laws to submit
them in written form for placing on next agenda. Prickett said
Laws would be convener for the first meeting at which time a
chairman will be elected by the committee.
