Marilyn Votaw asked if Staff made recommendations relative routes in
subdivisions for pclice and fire use and was told by Winterowd that
all subdivision requests go through those departments.
Peggy Hornak of 754 Oak Street said that Oak Street traffic has becom
like that on a freeway and if this street comes through the way it is
placed, someone could be hurtab a result. Hornak said she rents but
is now glad she didn't buy because of the traffic conditionst Glenn
Ve~illion, 202 Oak Lawn, spoke of concern for children should traffj
increase. Elizabeth Peterson of 198 Alicia agreed with Vermillion an
added that there are no sidewalks for the protection of children.
Robert Popejoy with Solar-Cal said that his original intent had the
development coming off Oak, but Planning preferred Sylvia to be exten
ed. Popejoy told of his interest in keepin~ costs down to make hous-
ing available in the $40,000 bracket. On Mayor's question as to
whether the original plan had gone to the Planning Commission, Popejo
said it had gone to the Planning Department and that when the subject
first came up there had been talk of keeping Sylvia open for emergent
vehicles only. Popejoy showed where a sewer line was located in the
section where Sylvia would be blocked off. Arvid Mesdgahl said h~
purchased his home three years ago and wishes he had known then bow
the traffic volume would increase. Ruth Newman spoke again saying
that the street will never go through as long as he is around here.

and that they were trying to greenbelt their property to keep the
open space for suburban living. Bob Ridinger asked who would pick u1!

ion; Drescher seconded and on roll call, all YES.

A letter w~s read from Ashland Community Health Clinic requesting
extension cF curfew to 2:00 A.M. and waiver of required license fee
and bond for proposed benefit dance at Mark Antony Hotel. Chief ~syt
said he has no objection. Ragland moved to approve request; Hami]to~
seconded and on roll call, passed unanimously.
A request from Southern Oregon State College for temporary closure of
Winburn Way for ccmmenc~'ment exercises on June 4, 1977 was read by t~
City Administrator. Ragland moved for approval and Drescher second~
On roll call, motion passed withcut opposition.
Mayor Prickett set a meeting with Southern Oregon Cable TV for Tues-
day, Msy 10, 1977 at 7:30 P.M.

Drescher asked that matter of application from Sims appealing the
negative decision of Plan~ing Commission on fence at recent meeting
be reconsidered because be had abstained having not heard the entire
proceedings. Mayor Prickett advised that if Drescher had not voted
on the motion, he cannot request reconsfderation.
McCannon suggest that consideration of appointing rather than electio
of City Recorder be placed on next agenda. F~ayor said tbat in 1970
a Charter Revision Committee reviewed the Charter and requested that
the committee ~ invited ~.o the next meeting. ...

Councilman Phelps recommended that a committee be appointed inclwdin_2

two others from the community. Mayor Prickett said he would contact
people end and mi,ke appointments at the next m~eting.
A memorandum was reIqd from Almquist recommending that cor. fi~,atior, be

expressed concern that s~ctfon calling for tertiary treatment after
1982 remains in the plan and that criteria had specifically been
requested deleted based on the recent modifications of the Waste Tree'
ment Plant and tbe fact that a bond bad been passed to update the
plant in 1974. A]sing recommended that should Council agree on such
deletion of tertiary treatment that the section be stricken before
adoption rather than to adopt the master plan with that exclusion.
Alsing also asked deletion of proposed boundary line at Crowson Road.
On Ragland's quotation as to whether the Mayor had written to COG on
the tertiary issue, Prickett said he had not understood he was to
write, but that be would do so covering both items and that he would
adjourn meeting until an adjourned meeting on May 10, 1977 at 7:30

First reading of an ordinance was given to rezone property from
R-F:B-200 to R-i:B-10 on property sithated west of Granite Street an~

son County for parks and recreation purposes. McCannon moved for

PETITION TO THE ASHLAND CITY COUNCIL, April
FROM: Oak Lawn Subdivision Residents
RE: Subdivision No. 77-14
Applicant: Solar-Cal, Incorporated
1977
The undersigned question the wisdom of the approval given the
above-mentioned subdivision application by the Ashland City
Planning Commission on April 13, 1977 for the following
reasons:
t) It appears that the actual primary access to the pro-
posed subdivision will be over Oak Lawn Avenue and Sylvia
Street, wbich~along with Alicia Avenue, form an unimproved
cul-de-saco This is a very awkward approach for the potential
residents of the proposed subdivision. However, the primary
objection of the undersigned to the use of Oaklawn and Sylvia
in this manner is that such use will double the traffic on
those streets, increasing the traffic hazard to the undersigned,
especially their children because there are no sidewalks avail-
able for pedestrian use. Furthermore, there will be a drastic
increase in wear and tear on the gravel roadbeds of Oaklawn
and Sylvia, along with an increase in dust produced. In addi-
tion, noise and general disturbance from the increased speed
and frequency of through traffic will be greater than presently
exists. A secondary objection is that the present residents
purchased their property with the expected continuance of the
cul-de-sac in mind.
It appears that a much more logical access to the pro-
posed subdivision would be directly off Oak Street where Oak
Street abuts on the Phelps property, site of the proposed snb-~.~"

division. In the presently proposed arrangement, the applicant
wishes to make use of Oak Court subdivision as an access to
the proposed subdivision so that a maximum of area within the
proposed site can be devoted to profit-making lots, rather than
necessary access routes.
2) Not all the persons
were given proper notice of
living near the proposed subdivision

was scheduled before the Planning Commission meeting on April
11, 1977 at 7:30 p.m. For this reason, the Commission did not
have an opportunity to hear the concerns of all members of
the affected area who wished to make their opinions known be-
fore the Cormnission acted on the proposal, The undersigned
are divided into categories of those who were notified and
those who ware not.
3) Several members of the Commission appear to be serving
under conflict(s) of interest, Only one such person disquali-
fied himself from voting (but not from d]~cussion) on the pro-
posal: Mr. Billings. Beyond him, Ms. Weaker certainly suffers
from a conflict of interest because of her husband's proprietary
interest in Ashland Sanitary Service, Inc. Therefore, any real
estate developments approved by the Commission result in direct
financial benefit to the Wenkers because of the virtual necessity
of garbage pickups. Interestingly enough, it was Ms. Wenker
who placed the motion for approval of this project before the
Commission. For the above reasons, Ms. Wenker should have dis-
qualified herself from discussing or voting upon this applica-
tion. Because she did participate and vote, the validity of
the Co~ission's approval is questionable. [~ W~

The undersigned respectfully request the Ashland City Council
to reconsider approval given Solar-Cal, Inc.'s application.
We feel that the above-mentioned procedural and substantive
errors require this reconsideration. We recommend that the
following be considered as possible remedies to our grievances:
A) Require the applicant to provide primary access directly
from Oak Street to the proposed subdivision as described in
(1) above.
B) Require some secondary access other than through the
existing Oak Court road system.
