Mayor Prickett led the Pledge of Allegiance and called the meeting
to order at 7:30 P.M. on the above date in the Council Chambers.
Present were Phelps, Drescher, Laws and Hamilton. Ragland arrived
moments late. McCannon was noted as absent.
~ouncilwoman Hamilton asked that correction be made on Page 2 of the
July 5th minutes stating that name submitted for Planning Commission
er should be "Sally" instead of Patty as the record showed. Laws

and passed unanimously on voice vote.
City Administrator Almquist read a letter from Davis, Ainsworth and
Pinnock asking that appeal from the decision of the Planning Commiss
ion denying request for subdivision be considered. Also read was a
letter from Karen & John Darling of 490 Strawberry Lane opposing the
project. ~aff report of June 7, 1977 and minutes of the Planning
Commission meeting of June 13, 1977 and the Darling letter were sub-
mitted for the record. Almquist asked Winterowd to review the re-
quest denied By the Planning Commission. Winterowd showed slides of
the area explaining the zoni~ and showing access to the properly by
Strawberry Lane,calling attention to the narrow width and sharp turn
in the unimproved road. Winterowd called attention to another acces
to the north and added that Roberrs on Westwood had denied an ease-
ment. Almquist noted there is only a 4 inch water line to serve the
property at this time. Alsing added that service is not sufficient
~t this time but that eventually a 12 inch line is planned and said
hat service without a pumping system to get it up there would be
ifficu]t, if not impossible. Winterowd reviewed the six suggested
conditions for approval included in the Staff report.
Sid Ainsworth, Attorney representing the applicants said that they
had agreed with all suggested cor~itinns and said that Kneebone had
agreed to dedicate 60 feet to the City as he plans to develop in a
year or so himself. Almquist said that the City does not normally
accept streets which have not been improved. Ainsworth said the
principal access would be to the North and Strawberry could be
straightened out and used as secondary access. Drescher said that i
the subdivision is developed based on Kneebone access, there is no
way of reassuring that plans would be carried out. Ainsworth said
that Kneebone would enter into an agreement to that effect. On
question from Drescher, Kneebone said he is not positive as to exact
time he will be developing his land but hoped to within a year or Pc
Mayor Prickett opened the public hearing. Larry Gastorf, 187 Straw'-
berry Lane shared his concern regarding traffic on the narrow lane
saying his property is on the lower side of Alnut and wonders who
will pay for the improvements when the street is required to be wide
ed. Merle Mills, 34 Scenic said his family will eat the dust and
criticized the plan for "leapfrog" zoning and supported by City
services.

Judy Sundin presented photos of the area and contour of Strayberry
Lane showing vehicle in the road to illustrate the narrowness and
said not one person failed to sign the petition against the proposal
and added that access to the north is not the problem but that dur-
ing bad weather it is impossible to hold a car on the hill and addec
that the intersection of Scenic & Strawberry is 33 ft. wide and said
that more property would be needed to get necessary electric, sewer
and water l~nes plus retaining walls etc.
Mary Jo Broomfield, 220 Strawberry Lane said her main concern is for
the safety of her youngsters and any others who may move into the
area, Mike Broomfield of the same address agreed with Judy Sundin
saying that the secondary access mentioned would be an easement and
that many people have shrubbery growing right down to the road and
that the road is carved through the area. George Sanders, 196 Nut-
ley said this road would become a main thoroughfare which is what
happened to Wimer and described conditions in decomposed granite sa5
ing that if you put your brakes on you will slide ten feet. Henry
Hill, 147 Nutley said he supports decision of Planning Commission
for reasons expressed By audience. Alex Chisholm of 124 Strawberry
spoke in opposition to the proposal and supported decision of the
Planning Commission.
Ainsworth said the plan is to go down on Alnut and that the opinion~
expressed were not valid complaints. Mayor Prickett closed the
public hearing. Drescher moved to deny appeal; Ragland seconded
and on roll call, all YES.
Public Hearing on State Revenue Sharing funds set for July 26, 1977
at 7:30 P.M,
Prickett opened the public hearing and since there was no comment
pro or con from the audience, the public hearing was closed and
reading of Ordinance noted to be later on agenda.
Ragland moved to accept minutes of Boards, Committees and Commissio~
and place on file; seconded by Laws and on voice vote, all YES.
A letter was read requesting a noise permit to play taped music for
folkdancing on Friday, August 5, 1977 between the hours ef 5:00 and
8!:30 P.M was considered. Drescher moved to approve subject to
approval by Parks & Rec. Ragland seconded and on roll call, all YES
Almquist read a letter from Scott Young proposing closure of Winburn
Way to vehicle traffic and citing support of citizens who signed a
petition. Young urged Council to consider placing the issue on the
ballot in the next election. Drescher said he had conferred with
the Parks Commission asking that a test be made to see the effect of
closure of thE! park by closing it for one or two days a week. Young
said that was avoiding the issue and that he wants the matter brougk
to the people through the ballot, and as for tbe argument on Police
patrol, that it could Be patrolled on foot.

Ragland said there would be a good many people irritated by having tc
carry picnics etc. and many people not physically able to walk there
and moved to accept letter and place on file; Laws seconded. Young
suggested that electric vehicles (elephant train type) could be used
to transport people within the park. Michael Eastman of 169 Lincoln
stated that both he and his wife are handicapped and would find it
difficult to enjoy the park as many senior citizens would, and asked
that money not be spent either for closure for trail period or by
placing the matter on a ballotS' On roll call, all YES.
A letter wes read from Earl Montgomery resigning from the Ashland
Historic Commission. Mayor Prickett directed the City Administrator
to wr~te a letter of appreciation.
Public Hearing was set for August 2, 1977 at 7:30 P.M.
Planner Himes submitted a draft of the Comprehensive Plan and req-
uested that a joint meeting of Council and Planning Commission be
set for August 9, 1977 at 7:30 p.m. The meeting was set for that
date .
Councilman Drescher asked the coordinator of the Community Health
Center if the funds discussed at the previous were to be used for
Staff and Doctors or just Doctors. Grove said that it was proposed
that the money would go for hourly wages for the Doctors and added
that it is hoped that by the end of September they will have a full-
time Doctor recruited for the Clinic. Grove said she is working
closely with Finance Director Nelson. No action necessary.
A letter written by Scott Young relative to loud mufflers wss read
by the City Administrator who reported that recent legislation for
control of such noises has been passed in the State legislature and
signed by the Governor and offered to forward a copy to Scott Young.
No action necessary.

Deferred until later in meeting to accommodate citizens wait~ag for
other items to come up.
Mayor Prickett nominated Sally Croskell to serve on the Planning
Commission; Carlotto Sheldon was nominated to serve on the Historic
Commission and D~escher was appointed to act as liaison to Ashland
Parks & Recreation Commission. Laws moved for confirmation; Ragland
seconded and on roll call, all YES.
A request for a liquor license transfer to David B. Zaslow and
Ste[hen J. Sacks, dba Boar's Head, 180 C Street was considered
subject to return of informstion on fingerprint records. Ragland
moved for approval; D~escher seconded and on roll call, all YES.
A memorandom from Director of Public Works Alsing requesting per-
mission to cut Nutley Street to provide service to a flag lot not
known to exist when paving was done. Laws moved to grant permission
Phelps seconded and on roll call, all YES.

A'proposal was submitted by R. W. Beck regarding a study of future
electric power supply and George Dickson, Consulting Engineer for
thE: fi~ was present and reviewed plan for study as outlined in the
letter submitted. Dickson said that alternate sources of power
would be researched and a reasonable forecast arrived at before the
present contract with PP&L terminates in 1982. Tom Kennedy, 1130
Hwy 99, expressed concern that alternate sources of power might not
be presented and suggested that study be postponed until the City
could meet on power needs and plans. Dickson said the citizens
would have an opportunity for input. Drescher said if we go for
study with Phase 1, we will have to implement Phase 2. After much
discussion, Laws moved to authorize signing of contract for Phase 1
stt.dy; Ragland seconded. Laws amended his motion to include provis-
ion that the firm provide us with a forecast to include range of con
sumption based on conservation; Ragland seconded. On roll call on
amendment Phelps, Laws and Hamilton voted NO. On roll call vote on
the original motion to sign contract for study (Phase 1) passed
unanimously.
Commissioner Larry Horton explained the plans of the Housing AuthorD
ity to add lowcost housing in $35,0G0 to $45,000 bracket to be man-
aged and maintained by the Authority and to be buil~ according to
specifications by HUD and interspersed throughout Ashland. }~yor
Prickett asked what tax monies would be forthcoming from low cost
housing and was told each owner would pay 10% of gross revenue.
Mayor Prickett commented on the fact that the City will be subsidiz-
ing the package based on forty year term. Laws moved to authorize
Mayor end Recorder to sign contract; Phelps seconded. On roll call,
Phelps, Drescher, Laws and Hamilton voted YES. Ragland voted NO.
A letter was read from City Attorney Salter making certain c,.rrect-
ions in the Franchise, as follows: The first correction is i line 9
of Section 2 where the word "extension" should have an "s" aoded
and in section 6 at the end of the first paragraph the reference
should be to Section "18" and not "17". On the last page of the
acting clause, the word in the third line "read" should be "passed".
Councilman Ragland said he doesn't like the way the franchise was
handled after months of discussion between the committee and SOCATV
and the City caved in on many of the provisions. Ragland went cn t¢
say that what is going to happen to cable t.v. is mind-boggling and
moved to amend the original motion to strike Section 17 and 19 and
make t~e period of the franchise 3 years; Laws seconded. Cantrail
told Council they have not correlated the ordinance by including
Commission (FCC) requirements and that they are going back to square
1. Drescher agreed with Cantrail and said that we have hammered out
an agreement and although it isn't ideal for the City, we are going
back to square 1. Phelps said hd:is confused because h~ hasn't hear
SOCATV accept the franchise at this time. Cantrail said they carry
fourteen stations other than local ones and have them grandfathered
and the City will not ~e able to get them. Technical cable media
was discussed at length and Cantrail was asked if he knew if the
company planned on accepting the franchise. Cantrail said they h,~d
many discussions and meetings with customers who wanted service to

continue so the company is willing to accept the document you have
before you tonight. Laws explained that he had voted against it
because of the 15 year term being such a long period of time
and CATV is going to Be a different system and we are going to give
up the right to have any protection at the time these changes are
made when it Becomes a real monopoly. Drescher commented that we ar~
going to have to franchise it out anyway. Considerable discussion
followed relative to the complexity of CATV systems. Laws said
he is not satisfied with the proposal but would go a few years with
as it is. Mayor Prickerr mentioned a few industries which would be
using CATV and said tbe probabies are staggering. Ragland said that
if he isisright, down the road this could be more profitable to the
City than electric and that during the three year period we can dec-
ide if we want to get into this or not; we could renegotiate with
SOCATV or if they won't sign then we can ask for bids from other
companies. On roll call on the amendment, Phelps, Ragland, Laws and
Hamilton voted YES; Drescher voted NO. Almquist read the amended
section. Ragland moved tO second'reading; second by Phelps and on
roll call, Phelps, Ragland, Laws and Hamilton voted in favor of the
motion; Drescher voted in opposition.
First reading was given an ordinance electing to receive State Reven
ue Sharing pursuant to Senate Bill 11. Ragland moved to second read
ing; Phelps seconded and on roll call, all YES.
A]mquist gave first reading of an ordinance annexing a contiguous
area known as Ashland Hills. Himes reported that Planning Commissic
had received topo map and approved and public hearing will he held
on August 2, 1977 at 7:30 p.m. Phelps moved to table #4 & 5;Hami!to
seconded. Prickett had requested the ordinance not be read until
after the public hearing. On roll call, passed unanimously.

First reading was given an ordinance amending Section 18.50.060 of
the Ashland Municipal Code relating to sign lighting, and Laws moved
to second reading; Phelps seconded and on roll call, all YES.
Almquist gave first reading of an ordinance amendingSect~ons18.68.
100 and 17.32.050, and adding a new Section 1.08.020 to the Ashland
Municipal Code to provide for infractions and a penalty for violatic
thereof. Drescher moved to second reading; seconded by Hamilton
and passed without opposition on roll call vote.
The Cimy Administrator read a Resolution adopting 208 Report by
Jamee M. Montgomery. Laws moved for adoption; Phelps seconded and
on roll call, all YES.
Almquist read a Resolution accepting Grant offer from E.D.A. under
the Community Emergency Drought Relief Program and a motion for
adoption was made By Drescher and seconded by Ragland and on roll
call, passed unanimously.

A letter was read from Tom Kennedy asking Council to consider a
$2,500 fee for placement of City's insurance coverage (liability).
Almquist reccmmended that fee for the coming fiscal year be rejected
Dresche~r moved to reject and place letter on file; Laws seconded
and on roll call, passed unanimously.
Alsing reported staff is concerned about the three proposed projects
as outlined in the 208 Study to take place next year and which is to
be voted on this coming Thursday (July 21, 1977) and said he had req-
uested item be tabled dealing with runoff section until he gets dir-
ection from Council relative to downstream flow from Ashland Creek
down and said we never said we would clean up Ashland Creek but to
handle the water supply needs of the people. Aiming said he has
reservations on voting to spend money to clean the creek and to moni
tot the creek before any modifications are made in the way of cor-
rective measures, Laws said that we should know the effect our res-
ervoir sluicing has on downstream activity - fish and water quality
and reminded Council of government criteria and said we had committe
ourselves to that goal when we went into the 208 Study. On Laws'
question as to what extent the study should be implemented in genera
Alsing said we should go all the way. Ragland said that we will hay
to file some kind of impact statement for those items mentioned in
the discussion and that this money won't even get the job started.
No action necessary.
Phelps reported a safety hazard at the new Thrifty Drug store where
a pedestrian ramp and barricade has been placed and requested that
such condition be checked by the Planni and Building Departments.
Planner Himes said he would inform W' t .owd and Chamberlain.
Laws moved for adjournment at :2:20 .m. to an adjou meeting
on Tuesday, July 26, 1977 at 7'30 R m. for revenue ng etc.
