HomeMy WebLinkAbout1977-1122 ADJOURNEDMINUTES OF THE ADJOURNED MEETING ASHLAND CITY COUNCIL November Z2, 1977 ROLL CALL APPROVAL OF MINUTES WATER BOND BIDS AAA SAFETY AWARD PUBLIC HEARING MAJOR LAND PARTITION AT 335 High St. (Sunmerhays) Mayor Prickerr called the meeting to order at 7:30 p.m. on the above date in the Council Chambers; at 9:50 p.m. Mayor Prtckett left and the meeting continuedunder th~ chairmanship of Chairman McCannon. Councilmembers Phelps, Laws, Ragland, Hamilton and Mc- Cannon were present, Drescher was absent. Ragland moved to approve.minutes of the regular meeting of Novem- ber 1, 1977 and the adjourned meeting of November 8, 1977; Ramilto seconded and on voice vote~ passed unanimously. Finance Director Nelson called for General Obligation Water Bond bids and said he wou~d return to award same after studying the bids as submitted. Mr. Hal Friend of AAA Automobile Club of Oregon presented the Mayo and Council a Pedestrian Safety Award for having gone fourteen yea without a pedestrian fatality and added that period was the longes time in the State without a fatality and that Ashland had competed against833 other cities to win the award, Ashland's tenth. Mayor Prickett opened the public hearing and Planner Winterowd showed slides of the area and homes adjacent to the proposed devel opment of two lots behind 335 High to be served by an alley betwee High Street and Scenic Drive which would narrow at both ends with no parking at those points. Winterowd said there had been no objection expressed before the Planning Commission meeting at whic time the vote was 4-3 in favor of the request by Robinson and Chambers, owners of the property. Winterowd added that the applic ants signed an agreement to paving and sidewalks should a petition come up in the future for such improvements. Appellant SLnm~erhays expressed opposition to position of alley right on his fence line and explained that should a car be parked on the alley there would be only 18 feet remaining. Summerhays also cited access to City's services as problem and showed a diagram of block area with flag lots and suggested applicants develop one lot with co~mmn driveway Summerhays explained that he had not complained before the meeting because his notice had not shown plans for a through street (alley and suggested that development be delayed until a more comprehen- sive plan could be designated for the area as a whole. Roy Nason of 338 Scenic Drive said he objects to the plan and said he doesn' plan to subdivide his property. Dick Chambers said the land could be developed into R-3 low density apartments but they would prefer single family residences. Sabra Hoffman supported Sammerhays and urged more planning be done for the area before piecemeal flag lot preclude orderly development of the unimproved land. Robinson sai he drives the fire truck and would have no problem getting into th proposed alley. Laws moved to uphold appeal; Ragland seconded and on roll call, motion passed without opposition. 11/22/77 Pg. 1 ~djourned Meeting Ashland City Council 11/22/77 Pg. 2 PUBLIC HEARING OAK KNOLL CLUBHOUSE CON- DITIONAL USE #205 APPEAL City Administrator Almquist read appeal of decision to allow CUP Planner Winterowd explained the request for expansion of the Golf Course Clubhouse and showed slides where plans for expansion of t dining room/dance area are planned. Eleanor Bradley of 854 Twin Pines Circle cited finding no. 1 sayi there would be no change which would be injurious to property in the area and that the orchestra is situated so that with amplific tion the music blares and that with the Country Rock music the audience participates and that it continues out into the parking lot and often from the cars leaving the restaurant. Bradley said that in recent weeks It has been much more ~uiet and wondered if the cold weather may have contributed. J. D. Selleck of 821 Twin Pines Circle spoke objecting to the noi in the early morning hours generated by amplified music and vehic arriving and leaving the dining room. Selleck recommended three traffic control features in an attempt to reduce that portion of the complaint. Alma Williams-Selleck objected to the use of the clubhouse as bei a night club entertainment center as opposed to an accommodation principally to golfers by offering luncheons, dinners and a cockt lounge. Selleck requested that the building be completely sound- proofed in acoustic insulation and cautioned that thermal insulat as used for weatherproofing would not be effective. Selleck asked that double construction should be used for entrance and ex and that the bandstand be centrally located in the building to av the music hazard. Don Thomas of 733 Twin Pines Circle read part of the agreement st ing that food must be served where alcoholic beverages are sold, and wondered if this is being carried out and also cited the haza of the traffic and suggested radar controls, and signing to direc vehicles directly to Oak Knoll Restaurant so they don't go throug the subdivision. Brita Hazell of 804 Twin Pines Circle asked if the Police Depart- ment is aware of any activity or any action which might have been recorded and agrees with Thomas that rerouting vehicles so they u the entrance to the restaurant on ahead. Hazell also brought up the municipal code which calls for operation to be closed between the hours of 1 a.m. and 6 a.m. and in this instance the entertain ment lasts until 2 a.m. Hazell wondered if Oak Knoll is licensed for those hours. Hazell said she was well aware of the golf tour being there but the fact that the number of vehicles going into idential area and disturbing noise were not anticipated and shou now be considered. Mayor opened public hearing to supportive voj City Administrator Almquist read a letter from Bob VanVleet suppo ing the expansion of Oak Knoll. Akins also said that the golf course and dining room are tourist attractions and enjoyed by a great number of local people. Steve Shapiro of 564 Ashland street said he doesn't think it is up to the citizens or the Council to decide on the music and that there have been rock bands there before. Bob Lima of 1679 Jackson Road (Operator) said the walls are thin but will be well insulated. .Chief Hays said that the liquor license held by OK permits it's use. On Mayor's question as to whether there are problems and the Chief said there have been problems in the parking lot and that he would agree that an off-duty policeman would be able to handle it. Carroll Corliss of 520 Fairview said that the country club road is not a dedicated street and the City might be able to close it. Mayor Prickett suggested a "no thru traffic" sign. Lima said the band announces that vehicles should go through the golf course exit. Ken Krumdieck who is contracting the work said that the acoustics will be improved 100% upon completion of the job. Harold Mobley, secretary of Men's Club spoke in support of the ex- pansion because of the need for meeting rooms. Donna Anstead of 854 Twin Pines Circle said that the noise ad not bothered them at night and supported the expansion of the club. After discussion of off-duty, reserve or merchant police for noise and traffic control, closure of street from subdivision and signin~ for traffic direction, Hamilton move to deny appeal and place con- ditions as discussed on conditional use permit and to adopt the findings as submitted. McCannon seconded and on roll call, passed without opposition. Finance Director Nelson returned with Water Bond Bid results as follows: Crater National Bank with interest at $529,375; First National Bank, $521,735; Foster/Marshall, $521,345; and United States National at $521,187.50. With an interest rate of 5.46% Nelson recommended the bid award be made to U. S. National Bank and that the Resolution be read later in the meeting. ,~ McCannon m'oved to accept minutes of all Boards, Commissions & Co~' ittees; Phelps seconded and on voice vote all YES. Almquist read petion for improvement of Grandview Drive between Wright's Creek Drive and Sunnyview Street and recommended item be deferred until later in agenda. Page 37 11/22/77 LIQUOR LICENSE APPS. SUP~LUS PROPERTY RESOLUTION DEPARTmeNTAL REPORTS FLAG LOT APPROVAL Applications were submitted for liquor license name change on owner~ of Chautelin Restaurant to Michael Donovan, Jay Therein, and David Taub; liquor license for Aki's Place (Neil W. Kelly, Caroll Ann Kelly; and change of name from Log Cabin to T. & G. Tavern, Inc. All requests were recommended for approval by Chief Hays. McCannon so moved; seconded by Hamilton and passed unanimously on roll vote. A memorandum was read from Almquist recommending membership in the Northwest Public Power Association and McCannon so moved. Phelps seconded and on roll call passed without opposition. Mayor Prickett asked Council to consider attending some of the meetings. First reading of an ordinance authorizing and ordering the improve- ment of an alley located between Gresham and Union Streets, west of Siskiyou Boulevard was given. It was noted that the word "curb" should be omitted in the title of the ordinance. Ragland moved te second reading; seconded by Phelps and on roll call, all YES. Second readin~ bv title only was given an ordinance repealing Section 4.32.060(b) of the Ashland Municipal Code and Regland moved to adopt; Phelps seconded and motion passed without opposition On roll call vote. Resolution No. 77-56 entitled "A Resolution providing for the Sale, Issuance and Delivery of City of Ashland General Obligation Water Bonds" was read by City Administrator Brian AL~quist. Ragland move~ for adoption, Laws seconded and on roll call vote, passed with all in favor. An improvement resolution for construction of curbs, gutters and paving on Grandview Drive between Wright's Creek Drive and Sunnyvie~ S~reet was read by City Administrator Almquist. McCannon moved f,r adoption; seconded by Hamilton and passed unanimously on roll c~ll. A resolution was read authorizing participants to acquire federal surplus property from the Oregon State Agency for Surplus Property. Ragland moved for adoption; Laws seconded and passed unanimously on roll call vote. City Administrator Almquist explained that the State of Oregon ~harges local governments 25% of the acquisition value of the material and cited this as an unfair levy. Ragland moved that the matter be taken to RVCOG on inequity of charges; Laws seconded and on voice vote, all YES. Departmental Reports for the month of October were received. Eity._Admin~strato~' Almquist explained that a request for a flag lot on an unopened street with access off Lynn Street had been approved and that he would recommend that the City not take dedication of the street. Laws moved to place item on agenda; Ragland seconded and on voice vote, all YES. Laws moved that City not accept dedica tion for public street. On voice vote, all YES.
