All Councilmembers were present. Mayor Prickett noted that the date of the Executive Session should ha~ read April 27, 1976 and asked that the record be corrected. McCannon who was listed as absent at the Executive Session said he was in attendence. McDowell moved that minutes of the regular meeting of April 2D, t976 and the executive session of April 27th be approved as corrected. Ragland seconded and on voice vote, all YES. Hoffarth moved to accept minutes of all Boards, Commissions & Committ- ees. McDoweil seconded and on voice vote, passed unanimously. A letter from Attorney Gerald Scannell, representing Nell Mann, was read appealing a decision of the Planning Commission recommending denail of a proposed amendment to the Comprehensive Plan, on property situated between Faith snd Clay Streets, south of Hwy. 66, and City Administrator Almquist recommended that a public hearing be set for May 18, ]976 at 7:30 p.m. Mayor so ordered. City Administrator Almquist read a letter from Attorney Gerald Scannel representing Applicant Herzman appealing a decision of the Planning Commission requiring the paving of an alley adjacent to a proposed multiple-family development. Since neither the applicant nor the attorney were present, Mayor Prickerr deferred the item until la.ter in the meeting. A letter from the JacPson County Committee for Citizen involvement was read by the City Administrator urging representation and input in-o committee. On Hoffarth's question as to what the committee does, A] quist said it sets up a body to review plans and would on complet- io. review the Jackson County Comprehensive Plan. Laws said it was his feeling that thecommittee simply sets up the body to review. Mayor Prickett directed the City Administrator to communicate with the Coordination Manager for further information, and in the interim that Planner Mawson would serve as Ashland's representative. A request was made for permission to hold a benefit carnival near the Hungry Bear Restaurant in the Bi Mart Shopping Center for the Royal Soccer Team and it was explained that permission for use of the park- ing lot was secured and insurance provided for the ocassion. McCannon moved for approval of request; second by ~llen and passed unanimously on roll call vote. On behalf of the Forest Service, City Administrator requested that a Joint study session be held on June 8, 1976 at 7:30 p.m. Mayor so ordered. McDowell said that Dan Curtisof the Fire Department hsd suggested at the PSO public hearing that eating and sleeping time be disallowed and asked that Council be given legal opinion. Lmcs suggested a study session on the issue. Mayor Prickett set May 25, 1976 at 7:30 for the session. Doug Graef, Parks Director, asked c3nsideration be given Nancy Pinnoc as Co~issior of Parks & Recreation. On Hoffarth's question aS to whether Herzman was m~are of the appeal being on the agenda, the City Administrator thought he was. Planner Himes said he had discussed the subject with Herzman. Laws suggested that there is an implication that "privileged" people are involved in the issue and that problem shouldn't be aggravated. Kent Cutting spoke on the Mann Appeal (item 2) involving Neighborhood No. 6 (Comprehensive Plan) and stated that he has over 150 people ~ne have signed petitions sh~ing their concern over the issue and asked if they could be heard. Mayor Prickett explained that the public hearing was set for May 18, 1976 at 7:30 p.m., at which time anyone can voice an opinion. McDowell moved to carry item 3 to next meeting on May 18, 1976 and that Herzman be so notified. McCannon seconded. On roll call Hoffarth, McDowell, McCannon and Laws voted in favor; Allen and Ragland abstained. Motion carried. Mayor appointed Marcia Gilbert to CATV Committee; Sally White to Historic Commission and Nancy Pinneck as Parks Comnissioner. McCanno! moved for confirmation; Laws seconded and on roll call, all YES. Finance Director's request to transfer funds from Flood Restoration Fund to Parks & Recreation Fund for State Unemplo]nnent Insurance Benefits was considered. Laws moved for approval; second by Hoffarth and passed unanimously on roll call vote. A request from Director of Fin~_~ce for budgetary transfers was dis- cussed relative to accounting p~ocedures. Finance Director Nelson explained procedures and outlined each item requested, and said the Resolution would appear later in the ageride. City Administrator Almquist read a letter from R. Scott Weaver of 590 Grandview who owns 210 feet of frontage speaking in favor of the proposed improvements. Dr. Virgil Hulse of 869 Grandview said he didn't think it was entirely fair that he should have to pay to have his 600 foot frontage paved when it makes for a pleasant entrance for the use of Herzman's subdivision above his home and stated that he will pay the $6,000 if necessary but would like the City to help. Henry Kneebone wondered if the City might be able to secure funding from the govermnent to put Grandview through to Scenic and widen Grandvlew in so doing. Director of Public Works Alsing showed maps and the Mayor explained that the FAUS monies being used for funding a part of the project is designated for arterial streets and that it would not qualify as such. ~. Terry Schneider of 344 Wimer said she had checked the stakes on Wimer Street and that they are not set for a 36 foot wide street and S/4/76 Pg. Z Meeting Ashland City Council 5/4~76 .... Rogue River Basin Quality Management if the City is going to improve the street, it may as well make it a safe one. She added that it was being improved to make it more convenient to get up to the subdivision above. Director of Public Works Alsing said that the stakes have not been placed permanently as yet and that they are there for an outline at this time taking into consideration existing retaining walls, countour and other features which the City will keep in mind before proceeding and fur- ther advised that the State Highway Department will make the final decision as to the width and exact location of the pavement and that the street will probably be 36' wide and if it is found to be necess ary to make it 28', then there will be no parking on either side. Virgil Hulse asked if water drains could be located so as to preclud erosion of his land and Alsing assured him of such installation. Duane Smith said he owns lots on Thornton and would like to see Wimer paved to Thornton. Alsing said if Thornton petitions for paving, it will probably include all the way to Grandview !~prove- ments. Hulse said if Thornton is paved, he will have another 200' to pay for. Mayor Prickett suggested Bancrafting the cost. On question from Mrs. Schneider, Prickett explained FAUS and designatic~ of arterial streets. Public hearing was closed. City Administrator Almquist said that 62.2% of property frontage is in favor. McDcwelI said that she can sympathize with persons in assessment district are not interested in improvements but that at present this is the way it works. Hoffarth moved to draw up necessary documents; second by McCannon and on roll call vote, passed unanimously. Almquist read a memo (attached Ex."A~') from the Traffic Commission outI{n~g recommendations as a result of studies over a period of time. On the recommendation to set a policy whereby the property c mer would be responsible to paint his own curbs at driveways or ~ pay the City for labor and material, M~yor Prickerr disagreed say i~g that colors of yellow would vary as would places property owners decided to paint to deter parking. Prickett agreed that should the owner wish to paint, th~n they would be billed for the material. Laws moved to authorize Items 1 through 4. Allen seconded and on roll call, all YES. Mayor Prickett read a memorandum on the April 15 meeting of the Band Board reporting the 12¢ tax levy to be optimum level of s~pport and recommended copy of report be sent to Budget Committee. A letter recommending amendments to the Zoning Ordinance from the Planning Commission was read by City Administrator Almquist ~,~ho recommended that a public hearing. be set for June 1, 1976 at 7:30 Mayor Prickett so ordered. A memorandum from Director of Public Works Alsing was presented relative to criteria for Water Quality Management as set forth by the Department of Environmental Quality. Alsing suggested that the City of Ashland go on record before the public hearing closes on May 10, 1976 with a statement opposing certain things in the plan. Ragland so moved asking that Public Works Director Alsing write the comments. Allen seconded and on roll call, all YES. Laws said that in order to meet EPA standards the City will have to decrease it's effluent into the Rogue River and that certain standards must be set so each City and district doesn't set its own individual levels of quality. The Mayor criticized the State for its demands and although he doesn't like to make each demand a con- frontation, it seems the only way the matter can be dealt with. Allen asked for a copy of the letter. Memo from Laws & McDowell was read by Mayor Prickett along with pro- posal for funding and recommendation for City to provide for a Coordinator to act as a referral center for those in need of Human Resource agency assis tance. Laws explained that there are so many programs and agencies involved that it is difficult for people to know which way to turn for assistance and that a referral center would act to eliminate the confusion. Hoffarth said it is not the City's position to make agency services available, and that such agencies should dispense their own information. Laws said that many of the services are similar though not duplicated functions. According to Laws the City will be on the County Budget Committee agenda tomorrow at 9:30 a.m. (May 5). Allen said that th'e Multi- Service Center turned out to be unsuccessful and that we should have learned from that fiasco. On McCannon's question as to how the budget amounts were worked out, Laws said one was for senior progr~ and the other was for human resources coordinator. Ms. Esther Sohle said from the audience that one day soon the funding of programs wli have to stop regardless of the sources of monies which all comes fr~ the taxpayer. Hoffarth moved to deny request. Allen seconded. Mayor Prickett sai, that the County puts one quarter of a million in programs with no coordinator or information center and that information on such agencies should be available bZ- simply calling the County. On roll call, Allen, Hoffarth and Ragland voted YES to deny. ~IcCannon, Law~ and McDowell voted NO. Mayor Prickett voted YES to break the tie. Monthly Financial Commentary for period ending March 31, 1976 was submitted by Finance Director Nelson who read an addendu'm to his report and explained background and projections. Financial Commentary was submitted by Finance Director Nelson. Par~ Director Graef was present. On Mayor's question as to whether he ha secured cost estimates on Park Extension wall, Graef said he is stil waiting for engineering specifications. Parks Commission Chairm2n Mills spoke in relation to City's liability of earth movement where wall is proposed for reconstruction. City Administrator Almquist gave second reading by title only of sn Ordinance vacating an alley in the City of Ashland, Oregon, declarin an emergency. McCannon moved for adoption; Ragland seconded. McDowell moved for adoption; Pegland seconded and on roll call, all YES. City Administrator Almquist gave second reading of an ordinance amending Ordinance ~Io. 1766 as -amended, relating to utility discounts for senior citizens. McCannon moved for adoption. Ragland seconded and on roll call, passed unanimously. Second reading by title only was given by City Administrator Almquist of an ordinance adding a new Chapter 4.32 to the Ashland Municipal Code relating to alarm systems and special police service fees. Hoffarth moved for adoption; Ragland seconded and on roll call, passe unanimously. First reading was given by the City Administrator of an ordinance amending Ordinance No. 1825 and Section 15.16.240 of the Ashland Municipal Code relative to plumbing permit fees. Hoffarth moved to second reading; second by Ragland and on roll call, all YES. City Administrator Almquist read a resolution transferring appropria- tions within funds. Laws moved for adoption; second by McCannon and on roll call vote, passed unanimously. City Attorney Salter stated that the agreement for the use of the Twin Plunges swimming pool owned by the Willstatters is essentially the same as last yearts agreement with the exception of the Willstat- t,.rs having the discretion as to the number of persons in the pool at a~y given time and also gives the Willstatters right to caucei the p-ogram in the event of a sale of the property. Swim tickets would be refunded on pro rata basis if this situation occurred. Laws movec to authorize Mayor and Recorder to sign the agreement; Hoffarth sec- onded and on roll call, all YES. McCannon moved to authorize the Mayor and Recorder to sign Addendum No. 6 to the contract between the Police Officers union and the City of Ashland. Allen seconded and on roll call, all YES. City Administrator Almquist submitted a priority llst made up by Public Works Director A!sing for FAUS projects and requested that it be put on the agenda. McCannon moved to place on agenda; second by McDowell and on roll call, all YES. McDowell moved to authorize si~- ing by Mayor and Recorder; secon'ded by McCannon. AIlen, La~s, Ra~- land, McCannon and McDowell ~otedin favor. Hoffarth opposed. Councilman Laws reported that after the last meeting with the Council of Governments relative to the resolution on the standards of quali~ of domestic water including odor and color that he has been research- ing on possible health hazards that odor and color may indicate. He stated that he has talked to EPA, a SOSC biologist and others in an effort to gather data and will bring back any information for Council 5/4/76 Pg. 5 Regular Meeting Ashland City Council Liaison Report Laws reported that the next meeting of COG will be at Oak Knoll on May 26th at 6:30 for a dinner meeting and urged that staff and offici als attend. Director of Public Works Alsing said that the American Water Works Association has gone on record as not being in complete agreement with the standards as set down by the State of Oregon. AlsiHg, Director of Public Works Items from the Traffic Commission Listed below are items from the Traffic Commission meeting of April 21, 1976, which require either action by the Council or authorization by you. The attached map denotes locations of proposed loading zones and other traffic control in the downtown area. The Commission recommends adoption. The Commission recommends that one "no parking" space be designated on the easterly' side of Church Street at the intersection of N. Main Street to facilitate entrance to Church. The Commission recommends that the "no parking" space presently in front of 318 Hargadine Street be removed. This zone was created a number of years ago at the request of the person who owned the building at that time. There ,ave been a number of subsequent owners and it has not been repainted for quite a few years. The present owner does not feel it is needed and it affects only this one property. It was recommended by the Commission of yellow curb be authorized on each at 437 Beach Street that three feet side of the driveway The Commission also requested that the Council consider the adoption of a policy which, after authorization, property owners requesting yellow curbs at their driveways be required to either paint the curb themselves or pay the City for the labor and materials.
