ASHLAND CITY COUNCIL
September 16, 1975
ROLL CALL
The Pledge of Allegiance was led by Mayor PriCkerr who called the meet-
ing to order at 7:30 p.m., on the above d~e in the Council Chambers,
with Allen, Hoffarth, McDowell, McCannon and Laws present. Ragland was
absent.

Recorder Butler requested that ninutes of regular meeting of Sept. 2
be corrected in the public he~Irjng of Pentecostal Church record to
delete "reduction of side yard from fifteen to eight feet" ~.~he.L-e it'
appeared beginning in the tenth iine. llIcCannon moved for approval
as amended to which Laws seconded and on voice vote, all YES.
No comment from the audience,
City Attorney Salter reported that the renting of rooms to transients
by the Colony Inn was against the zoning ordinance and theft spec_~al
permission could not be granted ~litbout amending the ordinance. On
question from Hoffarth, Prickett said that City A~miuistrator Al!nquim;z
had written a letter alerting the Colony I~'.n to the illegal practice.
City Administrator Almquist said he anticipates thst the practice
continue until the City takes al~propriate actio~l. Salter said that
had not researched the entire question of the City's power to control
state owned property in the case of Soutbc'_~n.O~Eon St?to Col ]cite Let
said that if the College is renting to people involved in
pursuit that such use would be considered accessory use. Mayor
requested that the volume and current guidelines being fo!le~,,~ed by
College be explored through Don Lewis and/or Dick I,[cDaniels relativc~ rc
domitory rentals.
Reporting c~ theplans of M. C. Lininger, City Ad.mninistra~tor Almquist
said that originally the transfer should have taken place by
June 1, 1975 but that two months before that time he ha~ been notifie=i
by the company of their inability to meet the deadline because of
various problems and had asked for a 45 day extension. A letter
read from J~m Wright (Liningera) asking for a further extension unt~l
October l, 1975 because of difficulties arising out of the firm bei:~g
caught up ~nto the construction period when they are their busiest.
On McDowell's question as to plans for the City's use of the Water
Street property taken in through the trade, Almquist stated that at
present time it would be used for storagc~ of pipe, poles, waTehongc
supplies and eventually might be used for a warehouse and yard to
replace the existing facility on 2nd Street
Mayor Prickett appointed the Water Resources Cormmittee made up of
Seeley, MacGraw, Putdon, !loffbuhr, Savikkc and asked that Co~luci]:z~n
Ragland, City Ac'min~strator Almquist and Director of Puhl~c Ucrl~
Atsing assist in choosing a coez~lting firm for the watershed stu<~y.
Laws moved to approve al~pointmcuts seconded by McCanscl~. Coordinator

Parks financial commentary was given by Director of Finance Nelson. 13~
question from Hoffarth, Nelson explained that $],000 was for playground
equipment and $2,250 had been earmarked for a 'new tractor and suggested
that acquisition of the new tractor be delayed until the B.O.R. monies
are approved because of added costs of seeding and fertilizing may over-
run appropriations of Capital Outlay account. Allen objected to Parks
expending monies after having agreed not to. Nelson said that Parks
must maintain an austere program because of tight budget approval and
went on further to say that the utility bill'owed had created part
of the problem. Mayor Prickett asked that City Administrator Almquist
contact Chairman Bennett to ask that he attend the Budget Committee
study session.
Because the Findings of Fact had been submitted just before the meetin~
Mayor Prickett recommended that consideration be postponed until the
next Council meeting on October 7, 1975. Hoffarth so moved; Allen
seconded and on roll call, passed unanimously.
An ordinance relative to electric regulations was given second reading
by title only by City Administrator Almquist. Laws moved for adoption;
second by McCannon and passed unanimously on roll call vote.
City Administrator Almquist read a memorandum from Chief of Police Hays
outlining need for radar and radio eq6ipment and repairs, and explaininE
that that added radio expense had Dot been budgeted. ~e rental of ~ars
was discussed and Mayor Prickett suggested that acquisition of a police
car be taken up at the scheduled budget hearing and that ~ief Hays
check on new radar and expense involvedso that he can submit informeric
to budget committee for consideration.
A resolution of gratitude to Lords for their donation of lands for open
space was read by City Administrator Almquist. McCannon moved for adop~
ion. McDowell seconded and motion passed unanimously on roll call vote.
Councilman Laws noted that the newspaper carried a letter from a perso~
stating that 40 tickets were issued during a snowsto~ last Winter and
asked Chief Hays background of such charge. Chief Hays sa~d he has no
idea where the number had come from and stated that violations are
usually relaxed during storms. City Attorney Salter said that since
the Wilson case had been publicized he felt obligated to state that he
was defending the City in the case end that there was some iuconsistency
in stories told. McDowell moved to accept department reports; Laws
seconded and on voice vote, all YES.
Chief Hays requested that his departmental report be submitted a month
late until the new computing system becomes effective in catching up
with the month's totals. Council granted request.
The meeting was adjourned at 8:20 p.m.
