In re: Mann Subdivision
FINDINGS OF FACT
This matter came before the Council for public hearing
on October 21, 1975 on the appeal from the Planning Commission's
tentative approval of the Mann Subdivision which included the
creation of a private way.
Neit Mann, the applicant for the subdivision, was
present in person and Council heard oral evidence and also
received written evidence which was presented by persons in favor
of the subdivision and those opposed to the subdivision as
then planned.
Based upon the evidence,
appeal should be denied provided
the Council determined that the
the private way is deleted from
the subdivision. This determination is based upon the finding
that the requirement contained in the Ashland Municipal Code,
Section 17.12.020 relative to the creation of private ways is
not met in that the private way is not the only reasonable method
by which the rear portion of an unusually deep lot, large enough
to warrant partitioning into two parcels, may be provided with
