HomeMy WebLinkAbout1974-0702 REG MININVOCATION ROLL CALL APPROVAL OF MINUTES Ashland Sanitary Serv- ice Rate Increase Public Forum MINUTES FOR THE REGULAR MEETING ASHLAND CITY COUNCIL July 2, 1974 Rev. Leo Wine of Faith Tabernacle gave invocation which was followed by the Pledge of Allegiance. The regular meeting was called to, order by Mayor Fries in the Council Chambers on the above date at 7:SO p.m. Soderberg, Roble, Allen, McCannon and Conklin were pros-. ent. Prickerr was absent. Roble moved that minutes of the regular meeting of June 18, 1974 and the adjourned meeting of June 2S, 1974 be approved and placed on file. Conklin seconded and minutes stood approved on unanimous voice vote. City Administrator Almquist read a letter from Ashland Sanitary Service requesting a rate increase of 50ยข per month based on increased cost of operation. Conklin moved that rate increase of SO~ be approved based on ~ost of gasoline, labor, equipment etc.;~ erb}r seconded the motion, McCannon said he ~r~ L the motion to grant increase and would like to see a committee appointed to sit down with Bob Wenker to seek relief of such an increase to elderly and low income people. Wenker (owner) said that they are already giving a discount to those people who have been qualified to receive a discount on city utilities. Motion passed unanimously on roll call vote. McCannon moved that committeebe ippointed ~o work with Wenker to discuss possible assistance for elderly people; Roble seconded and on voice vote motion passed unanimous Mayor appointed members of Senior Forum Committee t discuss alternatives, to be chaired Cy Siebring of the Boar's Head requested approval of the Council to remain open until 2:30 a.m. to accommodate the theatre crowd. Although they are operating on a combination restaurant-liquor (wine ~ beer) license they are allowed to remain open until just 1:00 a.m. Siebring said if request is approved that food will be served until the new closing time, He said at this time there is no food available after the theatre and that people are going into Madford. City Attorney said he would research the Ordinance controlling hours and report back. Roble said there is no way Council could approve request until such time as Chief Hays would be available to submit recommend- ation. Soderberg moved that Salter be directed to bring back research on the ordinance and recommendation from Chief Hays. Conklin seconded and motion passed unanimously on roll call vote. Rich Nailson of 1209 Valley View Road said that Council is turning its back on young people and pleaded that some provision be made for recreation facilities such as pool halls, dance halls etc. to keep the youth of Ashland bnsy and out of trouble. Roble and Mayor Fries agreed that such activity is not in the realm of Council business but that of private industry and that the Parks ~ Recreation Department does have a wide variety of activities to offer the youth of Ashland, and that parents should accept the responsibility of the needs of the youngsters in question. ~gular Meeting Ashland City Council 7/2/74 Page 2 CUP No. 146 Findings of Fact Liquor License Transfer Omar's Buidlings ~ Construction Codes - Ordinance City Administrator read b~ckground of CUP No. 146 as applied for by James R. Ochs of 27S Avery Street for use as a private first grade and Findings of Fact and Determination for adoption. Mayor Fries asked Conklin if he had said that such approval would open situation for future applications until the school built up to higher grades. Conklin said he suggested such a possib- ility exists and no way to confirm or deny it now. Roble said that the findings should point'up protests by neighbors and stated that the millage rate of taxes pro- vides children with a good school system and this part- icular installation is unwarranted~ City Attorney Salter' said that these things were not brought up at the public hearing and that all the Staff can do is to take the opinion of the majority of the Council. Mayor Fries brought up the fact that proponents had suKges~ed having a one-way street which should have been quoted in the findings. Salter said that it would be difficult to guess how decisions would be made by a court on find- ings and opinions of local bodies. Allen moved that Findings of Fact and Determination be rejected; Soder- berg seconded. Conklin objected, saying that such find- ings were fact and couldn't understand why they should not be adopted as such. Soderberg reasoned that regular attendance of first graders would generate less traffic than some forty-five part-time students. McCannon said the findings are not sufficient. Conklin said that when we have a meeting short of'members any motion could be brought up to overturn previous decisions voted on and questioned the mechanics of such proeedure. Allen said that he rejected the finding of fact to voice his object- ion and that he wanted it clear that he would not change his mind. Salter reminded Council that the original decision would include the findings and that they were faced with a decision they will have to make themselves. Allen said thatif his objection would not effect the outcome, he would withdraw his motion. Soderberg agreed with Allen and moved to table the matter until the City Attorney can study the issue and return with direction. On motion to table, all YES. McCannon asked for a point of privilege and expected to speak to the m~tter as others had but was told that matter tabled precluded further discussion. Recorder Butler presented a request for transfer o{ Class A (DA) Liquor License for Omar's, Inc., 1380 Siski- you Blvd. The new corporate officers are Michael Roy Yondorf, Donald James Mercer and Bavid Austin Wiley. On question from Roble regarding Police recommendation, Butler reported that Lt. d'Entremont had stated that investigation revealed no reason for Police Department to recommend denial. Conklin moved for approval of the request; Allen seconded and on rol] call, all YES. City Administrator Almqu]st said that the i.eague of Oregon. Contract Laborers Union, Local #1400 Fire Fighters Assn. Contract Recorder Roble moved that contract with Internationa'l BrotherhooH of Electrical Workers, Local #659 for the period of July 1, 1974 to July 1, 1976 be approved and that the Mayor and Recorder be authorized to sign it. McCannon seconded and motion passe~ unanimously on roll call vote. Roble moved that contract with Laborers Union, Local #1400 for period of July 1, 1974 to 3uly 1, 1976 be approved and that Mayor and Rocorder be authorized to sign it. Conklin seconded and motion passed unanimously on roll call. Roble asked City Attorney Salter if the contract should not be presented in clear type as amended. Salter said that the contract contained the intent but that language was being modified. Roble moved that contract with Ashland Fire Fighters Association, Local 2279 be aDDroved and that Mayor and Recorder be authorized to sign ~. Soderberg seconded and asked for a clean copy of final agreement if ratified by Fire Fighters. On roll call, passed unanimously. Conklin moved for adjournment.
