September 4, 1973
ROLL CALL:
The regular meeting was called to order by Mayor Fries
at 7:30 p.m. on the above date in the Council Chambers.
Conklin, McCannon, Allen, Soderberg and Roble were
present. Prickett was absent.
MAYOR ' S APPOINTHENT:
APPROVAL OF MINUTES:
Mayor Fries aDnointed McCannon, Chairman with City Adm-
inistrator Al~nquist and Dick Calkins te serve on the
committee for application for the 1973 All-American City
Award. Conk]in moved for approval of appointments; on
roll call, passed unanimously.
There being no corrections. the Mayor anDroved Minutes of

llespital Bd. Minutes Roble moved Minutes 'of r~ Board'of Directors meeting of
August 20, 1973 be accepted. On voice vote, all YES.
, Parks & Recreation McCannon moved to accept and place on file Minutes of the
Parks & Recreation Co~nission's regular meeting of August 9.
On voice vote, passed unanimously.
~[~YOR'S APPOINTMENT: Mayor Fries appointed committee made up of Roble, Chairman,
Allen and Conkiln to check out possible acquisition by
Richards Heating & Sheet Metal of certain Property owned by
the city on Histletoe Road and to report back to Council
with recommendations at the September 18, 1973 meeting.
Conklin moved to approve appointments; on voice vote, passed
unanimously.
PUBLIC FORUM: Mr. A1 Willstatter requested opportunity to speak on
"Unfinished Business" No. 2-b relative to the right of
inspection by city officials. Permission granted by Mayor.
Mayor Fries said that prior to the September 18 meeting he
would make budget available from Council of Governments and
would like to know how the Council would like him to vote.
Eries said that fourteen Jackson County inter-agencies wante~
to come under the umbrella of the Council of Governments and
that although representatives of Josephine County had attend-
ed the last meeting, he was not snre whether the>' plan to
join in or not. Mayor Fries said that he will make copies
of information compiled by John Rowley available to the
Council. Conklin requested information on voting procedures
of the COG and stated his disapproval. Mayor Frics reported
there were plans for modification of the voting system, and
that he hoped the changes could be made to follow the patton

renewal of taxi franchise De given by City Attorney Salter.
City Attorney Salter recommended that ordinance call for
a term of five years which could be terminated for cause
on 10 days notice and owner may transfer business to another
upon approval by Council and that it was also the recommcad-
ation of the committee that franchise fee be limited to not
more than $80.00 per year, plus 1% of any amount over
$40,000 gross each year. Soderberg asked if all other pro-
visions would remain as originally set down and was assured
by City Attorney Saltcr that they were. Roble moved that
the ordinance be drawn to cover recommendations of committee.
On roll call, motion passed unanimously.

In discussing an Ordinance to provide for definit~
and rules for construction of ordinances as recom .ed
by Book Publishing ComPany, Soderberg took exception
to definitions as outlined in Section 1, item 8 ("and"
"or") and moved that it be stricken. On roll call,
passed unanimously.
A1 Willstatter of 1st & ASts., questioned the need
for what he termed an "all-encompassing" ordinance.
On question by Roble to C~ty Attorney Salter relative
to the right of the Fire Marshall to inspect premises
at reasonable hours, he was assured that the ordinance
would ndt effect an emergency situation.
Allen Traister of 756 Sixth Street spoke out against
such an erdinance stating that it had not been dis-
cussed by the public and felt that the concept was
premature and wondered what the qualififations of
Book Publishing Company were to make recommendations.
Conklin moved that the ordinance granting right of
entry to City Officials be stricken. On roll call
vote, Conklin, Allen, Soderberg and Roble voted in
favor of the motion; ~lcCannon opposed.
Roble moved for adoption of the Penalty Clauses Ordin-
ance, having been assured the Judge would not be
placed in a position by having to levy maximum fine,
On roll call, motion passed unanimously.
Item postponed until Finance Director became available.
Conklin moved for adoption of ordinance to update
cemetery operations. On roll call, all YES.
Roble moved for adoption of State Fireworks Law. Unan-
imously passed on roll call vote.
Finance Director Nelson reported on proposed changes
in Section 4, Ordinance 1399 relating to Finance De~ar~
ment. Willstatter questioned exception of Hospital and
Parks Department accounting. Nelson stated that beth
departments are still accountable to the City. Roble
moved for adoption of change as explained by Nelson.
On roll call, passed unanimously.
Plumbing Code
Traffic Control
City Attorney Salter explained that Ordinance No. 157~
was drawn to update adoption of State laws on Plumbing
as they ]viIi come out in October. McCannon moved for
adoption. On roll call, all YES.
City Attorney Salter explained that to amend Ord-
inance No. 1SS? would be to adopt Motor Vehicle Laws
of Oregon. Roble asked Chief of Police Hays for his
recommendation and Chief Hays gave his approval and
added that he felt traffic ordinances need updating
after each legislative session. Roble moved for
adoption. Robert Voris of 633 Iowa Street complained
that people block the Boulevard when picking u~ or let-
ting people out of cars and nothing can be done by
Ashland Police because it is a state highway.
Soderberg asked the Mayor if people from the audience
can speak during Council motions. On roll call vote,
above motion passed unanimously.

Soderberg then asked that the procedure of speakers
from the audience be. clarified. Mayor asked if Cba~
should be denied discretion. SoderBerg said she did
not think it is a matter of discretion. Conklin said
that such matters should be at the Mayor's discretion
as to whom he would like to hear on a certain subject.
Conklin said he thinks the ~Iayor would lose the right
to conduct the meeting. Soderberg said she thought it
only fair that a person should know when he can speak.
Roble asked that the meeting return to the Agenda.
Parking Restrict-
ions
City Attorney Salter said that this particular ordin-
ance was simply to rewrite parking ordinances so that
they would be rephrased and thus easier to read. Roble
moved for adoption. On roll call vote, all YES.
Reneal Ordinance

City Attorney Salter said that codification had brought
out the fact that this ordinance had not been repealed
and this was an effort to do so. Roble moved to pass
to second reading. On roll call, all YES.

Soderbcrg moved to bass to a second reading the ordin-
ance dealin~ ~cith definitions, but with deletion of
"and-or" definition. Passed unanimously on roll call.
Conklin moved that public hearing be held on Tuesday,
September 18, 1973 to consider a revised sign ordin-
ance. 0u roll call, passed unanimously.
NEW & MISCELLANEOUS BUS-
INESS Dispensers Licenses
City Recorder Butler said he had two requests for renew-
als- one from Cook's Reception and the other from The
Boar's Head. On being asked, Chief Hays recommended
approval. Roble moved for granting both requests. On
roll call vote, passed unanimously.
Transportation

Soderberg said Council had expressed need for additional
data to answer sonle of the questions relative to trai~s-I
bortation needs and moved thata request for additional
aata be made to BEAR CREEK AREA TRANSPORTATION C0'~TTEE
for Ashland's transportation system. Conklin said that
in his opinion the idea is premature until Highway 66
is complete which will change statistics. Soderber~
said she didn't think it was too soon to make a request
due to the time it takes to get a study done. Conklin
said even though the stud}' would not cost the city, he
feels that we shouldn't ask BCATS until we need it and
thinks that if we waited until the Comprehensive Plan
is complete, we will have input for BCATS. Allen said
the reverse might apply. On roll call, all YES, with
the exception of Conklin who opposed the motion.
City Administrator Almquist presented study draft of
street cutting ordinance and explained the various
scctions. Roble questioned the five year period and
wondered if it is realistic. Almquist said that they
have five and three year ordinsnces in Hodford. Roble
spoke in favor of the control. City Administrator Aim-
quist said that he would not think it fair to press
this ordinance now as the utility companies have not
been given notice. Conklin urged that ordinance get
passage as soon as possible, tonight for the first read-
ing and the 18th of September for the second reading
because the ordinance would not take effect for 90. days
which should be long enough for the utility companxes
to make plans.

Allen ouestioned Section 3. Soderberg moved that firs'
reading be postponed u~til next Council meeting on Sept
ember 18, 1973 and that provision be made that would re-
quire the property owner be notified. Conklin coald see
no reason we were worried about corporations such as util-
ity companies when it is our job to protect the street. On
roll call vote, passed unanimously.
Conklin moved for adoption of'ordinance amending Ord. 1787
pertaining to bicycle licenses. On roll call, motion
passed without opposition.
Conklin mmvcd for adoption of an ordinance amending
Ord. No. 177S pertaining to annexation fees. On roll call,
passed unanimous ly.
Soderberg moved for adoption of ordinance authorizing
~la>'or Fries and Recordcr Butler to cxecute agreement with
Oregon State Highway Division relative to replacement of
traffic si!~nals. Conklin objected saying that the money
is coming out of the budget somewhere even though labeled
"force account" work. On roll call, Allen, Soderberg,
and McCannon YES; Roble and Conklin NO.
Meeting was adjourned at 9:00 P.m.
