MINUTES OF THE REGULAR MEETING
ASHLAND CITY COUNCIL
October 3, 1972
The regular meeting of the Ashland City Council was called to order
a~ 7:30 p.m. in the Council Chambers, Ashland City Hall on the
above date. On roll call: Councilman Roberrs noted absent, all
other council members present.
C~onklin requested change in minutes of regular meeting of Sept. 19.
On page 6, paragraph 2, Conklin requested that the word "this" be
inserted to indicate he was against a certain annexation - not all
annexations.
Willstatter requested change in the minutes of the regular meeting
of September 19. On page 5, paragraph 7, Willstatter stated that
"that due to an oversight the applicant was not required to have
a conditional use permit." On page 6, paragraph 9, Willstate= State~
that he had written a letter to the Attorney General who suggested
he go through Mr. Densmore.
Conklin then moved that the minutes of the regular meeting of
September 19, with its corrections be accepted and placed on file.
Willstatter seconded. On voice vote, passed unanimously.
McCannon stated that Public Service Committee had met Tuesday,
September 26 to discuss complaint of Vaughn Bornet relative to
granite quarry on Granite Street, north of Winburn Way. The com-
mittee decided that no action would be taken by the City Council
at present time. He then moved that City Council take no action
at the present time on Bornet complaint. Conklin seconded. Passed
unanimously by voice vote.
Willstatter moved that the minutes of the Hospital Board of
September 22, 1972 be accepted and placed on file. Soderberg sec-
onded. On voice vote, passed unanimously.
Almquist read a letter from S.O.C. Security & Safety Department
requesting closure of Webster Street from Wightman to Stadium Street
on October 14 from 7:00 p.m. to 12:00 midnight for S.O.C. Homecoming
McCannon moved that approval be given to close Webster Street on
October 14 from 7:00 p.m. to 12:00 midnight for the S.O.C. Home-
coming. Soderberg seconded. On voice vote, passed unanimously.
Almquist read letter from Dom Provost concerning an appeal from the
decision of Building Appeals Board denying the use of Class B wood
shakes for remodeling of Provost Furniture block. Willstatter won-
dered if an appeal was necessary since a memo from Brian Almquist tc
Earle Chamberlain was written on February 3, 1972. Willstatter read
the letter and stated he failed to see the reason for an appeal.
Mr. Provost showed plans for the proposed use of fire retardant
shakes and the specifications calling for backing with aluminum foil
on 1/2" plywood. Mr. Provost cited the need for amending the build-
ing code to include fire retardant shakes and treated timbers for
use for esthetic purposes. Conklin moved that the decision of the
Building Appeals Board be overruled and that Mr. Provost's request k
approved. McCannon seconded. Willstatter suggested an amendment
that this decision not be confined to Provost but generally allowed

since this was the City Council's intent in February 1972.
Roble requested 30 minutes time to discuss the use of wood
before the Public Hearing explaining the subject was relative
to the hearing. Soderberg suggested that the Council proceed with
the hearing without making a decision until after Roble had spoken,
to which the Mayor agreed. See attachment "A"
A public hearing was called to order on the proposed adoption of the
~970 Uniform Building Code for the City of Ashland with certain
amendments.
Almquist read a memo submitted to the City Council by the Building
Appeals Board and the Contractor's Review Committee in which they
recommended against making the code more lenient. Soderberg asked
if the ordinance included all the recommendations from the Building
Appeals Board. Almquist stated that it incorporated all proposed
amendments.
General discussion ensued concerning changes in the ordinance.
Roble then suggested that this matter be reviewed in a study session
and pointed out that the City has no electrical inspector according
tO state law.
Mr. B. D. Greene, Builder, stated that he was a member of the
committee to review the code. The Committee was not unanimous in
their recommendations that were made to the Council according to
Mr. Greene. The Committee sought more leniency toward using wood
construction in the downtown area. He felt the Uniform Building Cod
as written was adequate and objected to any requirements at the
discretion of the Building Inspector, saying that at present we have
a competent inspector but we may not always have him.
Mr. Jim Ragland spoke representing the Planning Commission and the
Downtown Development Committee. The Building Code has been a source
of frustration to many prople in Ashland, he said. He cited that
the town is somewhat different in that we have many older buildings
and said that the Planning Commission was delighted last February
when the City Council requested a study on the use of wood in the
downtown area. Mr. Ragland said that the Commission was under
the impression that what Provost would like to do was perfectly
legal. The Uniform Building Code needs to be clarified, he said.
Mr. Dick Walsh of the Oregon College of Art expressed frustration
because it has been required that he bring his entire building up to
code before he can occupy it. Roble pointed out that laws governing
the remodel work on the school where it will be used for "public
assembly" are more strict than for a retail outlet where people
simply come and go.
Mr. Dick Cottle, Attorney suggested notice be published in the
paper when the Uniform Building Code would be reviewed by the
Council so that experts in the field might work with the City to
make the code more conducive to improving the City.

Mr. Ed Budge stated he would like to see more studying of the Code
as he is attempting to upgrade and remodel the old Litwil~er Funeral
Home and the Code as it is will not permit the construction of a
small wooden bridge over Ashland Creek. He stated that for this
reason he would postpone the project until a later date.
Mr. Richard Norland read a letter he had written to the citizens
of Ashland citing difficulties with the Code and recommended that
the City Council act to make changes he feels necessary.
Mr. Provost suggested that amendments in the Code could make the
downtown area stronger. If not, the buildings in the downtown
area may have to be torn down, he stated.
Conklin moved that the Uniform Building Code be reviewed in a study
session on October 18 at 7:30 p.m. in the Council Chambers. Soder-
berg seconded. On voice vote, passed unanimously.
Almquist read a report of findings and recommendations of the Ash-
land Planning Commission concerning a proposed amendment to the
text of Ordinance No. 1361, the Zoning Ordinance, by adding the
businesses of "printing, publishing and lithography" as conditional
uses in C-1 and C-2 districts, under Section 13 (3) and Section 14
(3) respectively. (See Attachment "B"
After a question by Mrs. Dorothy Sneed, the Mayor replied that the
proposal was that printing would be added as a conditional use in
the c-1 area, but that the Planning Commission still had the right
to ascertain whether it would be allowable or not.
Mr. Dick Cottle, attorney representing the Ashland Publishing Com-
pany stated that he would be willing to present to the City Council
tonight instances of the modernizing action in the last few years
of the printing process. He reassured Mrs. Sneed that the Planning
Commission still has the final say as to whether the use would be
allowable next to her house. Mrs. Sneed stated that she was not
opposed to the publishing company but was concerned with truck traf-
fic and use of the road next to her home. Willstatter noted that
the argument is well taken in favor of new processes, but also hoped
that the Planning Commission would look at other uses such as baker-
ies, and not confine it to just the printing industry.
Roble stated he was the last person to agree to anything at all with
regard to the Code that would create a liability to the present fire
insurance rating. He does not believe in the indiscriminate~'use of
wood in Fire Zone 1, but does believe in supporting applications of
fire retardant wood. In July 1970 it was agreed that the rear of
the buildings in the plaza could have some wood facings. Roble sta-
ted he could not understand the decision of the Building Appeals
Board when the Code provides for an appeals board and building offic-
ial approval of any alternative program. He then explained what a
Class B rating and other ratings meant. Roble stated he did not see
any reason why this fire retardant shingle was not approved and cited
an example of how two coats of fire retardant paint raised a Class C
material to a Class B rating. On roll call the motion to overrule
the Building Appeals Board and approve Mr. Provost's request was
passed unanimously.

Conklin moved that the findings and recommendations of the Ashland
Planning Commission concerning printing, publishing & lithography
in C-1 and C-2 districts by a conditonal use permit be accepted,
and also that staff be instructed to draw up the necessary ordinance
Soderberg seconded. On roll call, passed unanimously.

Almquist read a memo from Mr. Alsing, Dir. of Public Works, concern-
ing a request to Jackson County Board of Commissioners for surrender
of jurisdiction over a portion of Clay Street, south of Siskiyou Blvl
Soderberg moved that a request for transfer of jurisdiction be made
subject to payment by the County of their share of the improvement
project. Conklin seconded. On roll call, passed unanimously.

BOOSTER CLUB:
Variance
request
Almquist read a letter from Adrian Barats, President of the Ashland
Grizzlies Booster Club, concerning a variance request for a
40 square foot reader board at the corner of Morse Street and
Siskiyou Boulevard. Conklin moved that the request be granted.
Roble seconded. On roll call, passed unanimously.

Almquist stated that the variance request from Federal Sign and
Signal Corporation on behalf of Angelo's Pizza Parlor has been
withdrawn for the time being.
POLICY
STATEMENT
Mayor McKeen stated that the Jackson County Comprehensive Water
and Sewerage Plan (Phase II), August 1972, was inconceivably drawn
and worded, and called it a "fairy tale".

Conklin stated that in regards to Ashland the plan is totally in-
conceivable, and he would hope that the Council accept the policy
statement drawn up by the City Administrator in regards to the plan.
Almquist then cited inconsistencies in the plan and read the policy
statement. Soderberg said that at the time the County Planning
Commission presented its Comprehensive Plan she was afraid it would
be used as a basis for plans over all of the area. She would like
to request that the City Council not only make this policy statement,
disapproving the plan but also be specific as to our recommendations
on the corrections of the plan so it meets sewer and water needs of
the City of Ashland. Soderberg moved that the City Council adopt
the policy statement that was presented by Mr. Almquist, saying

~onsidered by the county in future studies. Conklin said'that he
would like the City Administrator and the Mayor to attend the meet-
ing and present this information. Conklin also commented he would
like to remind the Jackson County Planning Commission of their
brief conversation with the Council. Willstatter mentioned that
this could be mentioned in the policy statement. Conklin seconded
the motion. On roll call, passed unanimously. Soderberg asked the
staff to be careful to correct the text as it pertains to our plan
and reflect our plans. She also suggested that Mr. Alsing attend
the meeting with Mr. Almquist and the Mayor.
COUNCIL OF
GOVERNMENTS:
Soderberg stated that she made a proposal at last night's Council
Of Governments meeting that a separate office and staff be set up.
Soderberg expressed the feeling that all municipalities have an equal
say and financial responsibility in running the Council of Govern-
ments.

The Mayor gave a second reading by title only of an ordinance dis-
pensing with an election within the City of Ashland on the question
of a proposed annexation and setting a public hearing (8:00 p.m. on
Nov. 21) in the Council Chambers. Soderberg moved for adoption.
McCannon seconded. On roll call, motion passed with Conklin and
Willstatter dissenting.
The Mayor gave a second reading by title only of an ordinance amend-
ing Ordinance No. 1318, which pertained to subdivision and other
land partitioning standards. Conklin moved for the adoption of
the ordinance. Willstatter seconded. On roll call, passed
unanimously.
Almquist read a resolution prohibiting parking on the south side
of Ashland Street between Mountain Avenue and Beach Street in the
City of Ashland and providing a penalty for violation of this
resolution. Conklin moved for the adoption of the resolution. Sod-
erberg seconded. On roll call, passed unanimously.
Soderberg cited a request for street improvement from Ed Pentkowski
which the Streets and Traffic Committee reviewed. The Committee
recommended a public hearing be called to consider paving Schofield
Street. Almquist read a resolution providing for a public hearing
on the proposed construction of curbs, gutters, and paving on Sch-
ofield Street, from N. Main Street, southerly approximately 476 ft.
Conklin moved for the adoption of the resolution. Roble seconded.
On roll call, passed unanimously.
ROnald Salter, City Attorney, stated that he had two resolutions
which could be approved tonight calling for a special election on
October 24. Almquist read a resolution calling for a special elec-
tion to be held on October 24, 1972, and providing for the submiss-
ion at said election to the legal voters of said city, a proposed
act of municipal legislation to approve and ratify the "Ashland
Charter of 1970". as amended in 1972. Conklin moved for the adoptior
of the resolution. McCannon seconded. On roll call, motion passed
with Willstatter dissenting.
Almquist read a resolution calling for a special election to be held
on October 24, 1972, and providing for the submission at said elec-
tion to the legal voters of said city, a proposed act of municipal
legislation amending the charter of said city to provide for the
issuance of bonds in the amount not to exceed two hundred ninety-
five thousand dollars ($295,000), to finance the design and cons-
truction of additions and improvements to the Ashland Sewage Treat-
ment facilities.
McCannon moved for the adoption of the resolution. Conklin seconded.
Under discussion, Willstatter again stated that we do not have a
firm commitment; there are other alternatives that have not been
explored. On roll call, passed with Willstatter dissenting.
Roble asked Mr. Salter about the progress on Water & Main Streets
and moved that two sheets of plywood be taken off Main & Water Sts.,
and chicken wire be installed instead. Soderberg seconded. Under
discussion, Alsing stated that he had contacted two contractors to
finish the job. Soderberg commented thre will be the same problem
of view if someone bui~ls there again. Almquist stated he had

ADJOURNMENT:
talked to Jim Ragland and Mr. Ragland had contacted property owners
concerning this problem. The property owners have an agreement with
Walt Young to use the site and beautify it, through private efforts.
On voice vote, motion passed unanimously.
Conklin moved to adjourn; McCannon seconded; there being no further
business, the meeting was so adjourned at 10:30 P.M.
