HomeMy WebLinkAbout1967-0822 REG MINMINUTES FOR REGULAR MEETING ASHLAND CITY COUNCIL August 22, 1967 The regular meeting of the City Council was held in the Council Chambers of the City Hall on the above date. The meeting was called to order by Mayor Pro-tem Roberte. Councilmen Baker, ~ones, Wazd and Whitham were present. Mayor Neill and Councilman Cottle were absent. APPROVAL OF MINUTES: It was moved by Whitham, seconded by Baker that the minutes of the last regular meeting be approved and placed on file. On roll call, carried unanimously. DEPARTMENT REPORTS: It was moved by Whitham, seconded by Bakes that the Departmental Reports for the month of July be accepted and placed on file, On roll call, carried unanimously. COMMITTEE REPORTS: 1. Finance & Realty Committee - no report 2~ Cemetery Committee - no report 3. Public Works & Protection Committee - no report 4~ Utilities Committee - no report At this time, Mayor Pro --tem Roberts stated that the Council had met with regard to the vacancy created by City Administrator Ayre's resignation. He indicated that it was the Council's decision to make an interim appoint- ment for the position. Roberts stated that the Mayor instructed that Gary L. Boshears be selected to serve in this capacity until a permanent appointment is made. He will also continue to administer the Electric Department. It was moved by Baker, seconded by Whitham that the Mayor's appointment be confirmed. On roll call, carried unanimously. SPECIAL AGENDA ITEMS: 1. Development Coordinator Position - recommendation of Downtown Coordinating Commission - City Administrator Ay~e indicated that since Mayor Neill and Councilman Cottle were both absent, this appointment could not be properly made and suggested that this meeting be adjourned until Friday noon, August 25 in the City Council Chambers. 2. City Attorney's Opinion regarding Lithia Mill property. Skerry indicated that the County and District Attorney felt there is a problem with regard to the County's foreclosure of the land on which the mill is located, It was the City Attorney's feeling that Odr Uniform Building Code will cover this matter more thoroughly than our old Dangerous Buildings Ordinance, Skerry indicated that a meeting between the Fire Council Minutes -2- August 22, 1967 Marshal, Building Inspector and City Atnorney had been scheduled for August 23 to further study this matter.l- He~lso stated that he has received com- plaints regarding the Planer Mill and the Kiln on the same property, making it four buildings, rather than two that the City is now concerned with. 3. Ashland Comprehensive Plan - revised recommendation. C~ty Administrator Ayre ~ndicated that this Plan had been referred back to the County to study possible alternate routes to replace Mountain Avenue as a main arterial. A1 Frazier of the County Planning Commission stated that there were two possible alternativest creating a new street in both instances. One would be to follow Mountain Avenue from nhe freeway south to the railroad crossing, then create a new street from the railroad crossing to connect with Morse Avenue at the intersection o~ Morse and East Main. The second alternative would be to follow Mountain from the ireeway south to the inter- section of Hersey Street, then create a new street from Mountain through vacant fields to connect with Morse Avenue at the ~ntersection of East Main and Morse Avenue. Thus, neither alternative will show Mountain Avenue as a collector from East Main up through nhe High School area. Following some discussion, it was moved by Baker, seconded by Whitham that a Public Hearing be scheduled for the suggested changes in the Comprehensive Plan for 8:00 P.M., September 5. On roll call, carried unanimously. 8:00 P.M. Public Hearing - Curb, gutter and pav~ng of Hope Street between Park and Beswick. City Attorney Skerry read the Ordinance ordering in said improvements. It was moved by Baker, seconded by Whirham that the rules be suspended and the Ordinance passed to second reading by title only. On roll call, carried unanimously. Following the second reading, it was moved by Whitham, seconded by Jones that Ordinance No, 1533 be adopted. On roll call, carried unanimously° 8:05 P.M~ Public Hearing - Curb, gutter and paving of Orange Street between Laurel and Willow Street. City Attorney Ske£ry read said Ordinance. It was moved by Ward, seconded by Whitham that the £ules be suspended and the Ordinance passed to second reading by title only. On roll call, carried unanimously. Following the second reading, it was moved by Baker, seconded by Ward that Ordinance No. 1534 be adopted. On roll call, carried unani- mously, SPECIAL AGENDA (con't.) 4. Staff Report - transmission of carillon music to downtown area. Director of Electric Utilities Boshears submitted a report to the Council, indicating that carillon can be piped to the downtown area by leasing a telephone line for a monthly rental of $5 and the major components of the system could be provided and ~nstalled by the Schulmerich Co., making the total cost of a system with foul speakers $2,878. As an alternate, a three-year or five-year lease basis could be arranged making the rental $87.55 (3-yr. lease) or $55.64 ~5-yr. lease). At the completion Of the specified lease period, the Lessee would assume own- ership of all equipment. The Codncil was in unanimous agreement that this undertaking was probably not a function o~ the City, but rather of the Chamber of Commerce. It was moved by Baker, seconded by Ward that this re- port be accepted and transmitted to the Chamber of Commerce. On roll call, carried unanimously. Council Minutes -'3- August 22, 1967 Confirmation of lease for Fixed Base Operation - Ashland Municipal Airport. City Administrator Ayre indicated that the Council Minutes of the last regular meeting did not show authorization by the Council for the lease to be signed. It was moved by Ward, seconded by Whirham that the lease be confirmed, and the Mayor and City Recorder be authorized to sign the lease. On roll call~ carried unanimously. 6. Adopt specifications and call for bids - resurfacing portion of three streets° It was moved by Whltham, seconded by Ward that the specifications be adopted and bids called for at 2 P.M., September 5. On roll call, carried unanimously. 7. Award of bid - reconstruction olMountain Avenue Bridge. City Administrator Ayre indicated that the low b~dder was Peterson-Griffin with a base bid of $56,409.60. The deductive alternates, which city forces can do, were bid at $12,888.10, leaving a balance to the Contractor. of $43,521.50. Ayre indicated that the total bid amount was $5.50 over the budgeted estimate. Following some discussion, it was moved by Ward, seconded by Jones that the bid be awarded to Peterson-Griffin° On roll call, carried unanimously. At this time, City Administrator Ayre lndicated that he had received several communications that had not made the agenda. 1. A letter from Nell Mann, Chairman, Ashland-Talent United Fund re- questing permission to hold a street dance on the Plaza Friday, September 2. Following some discussion, it was the Council's ~eeling that more in- formation should be obtained on this matter before a decision could be made. Also the Council requested a recommendation from the Police De- partment. 2. A letter was received from the American Association of University Women (Medford Branch) requesting use of the downtown area streets for advertising of the "Children's Festival" by sound t~uck. It was moved by Ward, seconded by Baker that this request be approved. On roll call carried unanimously. At this time, Mrs. Lola Hendricks, proprietor of the Plaza Gift Shop, requested a variance of some type from the existing Sign Ordinance for her electric sign over the marquee. She indicated that as it presently hangs, the sign is hardly visable. She requested that her sign be lowered from 9'5" to 7'6". Also, at this time, Mr. David Nale, proprietor o£ "The Heather House", stated that he had received a citation indicating his sign was in violation of the Sign Ordinance because of no sign permit and it is constructed of improper materials and was hanging at an improper height. It was his feeling that this Ordinance should apply not only to new businesses, but all businesses old or new. Following much dis- cussion, City Attorney Skerry requested that both parties submit their requests in writing. In regard to Mrs. Hendricks request to lower her slgn~ it was moved by Baker, seconded by Whltham that this appeal be denied. On roll call, carried unanimously. It was then moved by Baker and seconded by Ward that the matter of the Sign Ordinance be referred to the Cemetery and Ordinance Committee for study, to be reported on at the next regular. meeting. On roll call, carried unanimously. Council Minutes -4- August 22, 1967 Mr. Herb Barth, representing the Light Opera Company, requested use of the downtown streets for advertising, by music, (Fire House Five and Kiltles) for their program to be held in the Lithia Park Band Shell on August 29, 30 and 31. He indicated the bands would travel from the Library to the band shell ~in direction with traffic) to attract people to the program. It was moved by Ward, seconded by Roberts that this request be granted. On roll call, carried unanimously. Also at this time, Mr. Joseph Gallati, who is requesting a zone change on Greenbrier Place, indicated that he had heard that the decision of the Planning Commission, at their regular meeting the night before, to recommend this zone change was not legal. City Attorney Skerry stated that there had been an error in publication of the Legal Notice in the paper so a Public Hearing would have to be rescheduled for the Planning Commission at 8:30 September 11. The City Council's Public Hearing was rescheduled for 8:00 P.M., September 19. It was moved by Baker, seconded by Whirham that the Public Hearings be scheduled for above said dates. On roll call, carried unanimously. At this time, Mr. L. C. Ireland, representing the Bellview Grange, ex- plained that the Grange will be forced to move to another location soon, and have been looking for suitable property to re-build. He indicated that such a location has been found, but that the area would have to be re- zoned from R-i:B-8 to M. It was the opinion of the City Attorney that this area should not be re-zoned M. After further d~scussion, it was moved by Bakers, seconded by Ward that a Public Hearing be set regarding the proposed zone change for 9:00 P.M., September 5. On roll call, carried unanimously. ORDINANCES, RESOLUTIONS & CONTRACTS: 1. Ordinance setting a Public Hearing for curb, gutter and paving of Catalina Street at 8:05 P.M., September 5. It was moved by Baker, seconded by Whitham ~hat the rules be suspended and the Ordinance passed to second reading by title only. On roll call, carried unanimously. Following the second reading, it was moved by Baker, seconded by Ward that Ordinance No. 1535 be adopted. On roll call, carried unanimously. 2. Ordinance establishing fines for over-time parking in unmetered zones. City Attorney Skerry read the Ordinance establishing parking limits on Municipal Parking Lots, This lot is located at the intersection of East Main and First Street. Parking will be allowed on the east side of Frist Street between East Main and the alley; there will be no parking on the west side of First Street. It was moved by Baker, seconded by Wh~tham that the rules be suspended and the Ordinance passed to second reading by title only. On roll call, carried unanimously. Following the second reading, it was moved by Whitham, seconded by Ward that Ordinance Noo 1536 be passed to second reading by title only. On roll call, carried unanimously. 3o Ordinance calling for Public Hearing for curb and gutter only on Orange Street between Laurel and a point 52' east of Laurel.
