September 12, 1967
The Ashland City Council met in an adjourned session at 12 noon
this date, Mayor Richard Neill presiding. Present: Councilman
Baker, Cottle, Jones and Ward. Absent: Councilmen Roberts and
Whitham.
The purpose of this meeting was to act on settlement documents
with regard to the Pipe Antitrust Case, State of Oregon et al
versus American Pipe Company.
The following Resolutions and Covenant Not to Sue were presented
by City Attorney Skerry.
Following the reading by Skerry of the Resolution authorizing
partial settlement, it was moved by Cottle, seconded by Baker
that the rules be suspended and the Resolution passed to second
reading by title only. On roll call, carried unanimously. Fol-
lowing the second reading, it was moved by Cottle, seconded by
Ward that the Resolution be adopted. On roll call, carried
unanimously.
City Attorney Skerry then read the Resolution authorizing distri-
bution of settlement funds among plaintiffs. It was moved by
Ward, seconded by Cottle that the rules be suspended and the
Resolution passed to second reading by title only. On roll call,
carried unanimously. Following the second reading, it was moved
by Ward, seconded by Cottle that the Resolution be adopted. On
roll call, carried unanimously.
Following the reading of the Covenant Not to Sue, it was moved by
Cottle, seconded by Baker, that this document be adopted. On
roll call, carried unanimously.
There being no further business at this time, the meeting was
adjourned subject to the call of the Mayor.
