A RESOLUTION ADOPTING THE DISADVANTAGED
BUSINESS ENTERPRISE PROGRAM FOR OREGON
DEPARTMENT OF TRANSPORTATION PROJECTS.
THE CITY OF ASHLAND RESOLVES AS FOLLOWS:
SECTION 1. The attached policy entitled "City of Ashland Disadvantaged Business
Enterprise Program for Oregon Department of Transportation Projects" is adopted.

DISADVANTAGED BUSINESS ENTERPRISE PROGRAM
FOR OREGON DEPARTMENT OF TRANSPORTATION PROJECTS
The City of Ashland establishes the following Disadvantaged Business Enterprise
(DBE) program in accordance with the requirements of the Oregon Department of
Transportation (ODOT).
It Is the policy of the Oregon Department of Transportation (ODOT), Its recipients and contractors to
provide Disadvantaged Business Enterprises (DBEs), as defined In 49 CFR 23 and the Intermodal
Transportation Efficiency Act of 1991, with the maximum opportunity to pafficlpate In the performance of
contracts financed In whole or In part wIth federal funds.
Good Faith Efforts: To determine whether a consultant has famed to meet the assigned goal but still may
be awarded the contract, ODOT must decide If the consultant put forth good faIth efforts to meet the
goal. Consultants falling to meet the assigned goal must include documentation of good faIth efforts In
performing the following:
The consultant attended any presdlcitation or prebld meetings scheduled to inform
disadvantaged, minority or women buslnass enterprises of contracting and subcontracting
opportunIties on the project;
The consultant identIfied and salected specific economically feasible project units disadvantaged,
minority or women buslneas enterprises could perform;
The consultant advertised In general circulation, trade association, minority and trade oriented
women-focus publications, If any, concerning the subcontracting;
The consultant provided written notice to a reasonable number of specific disadvantaged,
minority or women business enterprises drawn from a Department list of certified disadvantaged,
minority or women business enterpdsss for sdected disciplines In sufficient time to allow the
enterprises to participate;
The consultant followed up inItial solicitations to determine whether the enterprises were
interested;
The consultant provided Interested disadvantaged, minority or women business enterprises with
adequate information about the plans, specifications and reqtilrements forthe sale:ted
subcontracting;
The consultant negotiated In good faIth with the enterprises, and did not reject any
disadvantaged, minority or women business enterprises without justifiable reason;
Where applicable, the consultant advised and made efforts to help interested disadvantaged,
minority or women business enterprises obtain bonding, lines of credit or insurance the
Department or contractor requires;
The consultant's efforts to obtain disadvantaged, minority or women business enterprise
participation were reasonably expected to produce a level of participation sufficient to meat the
Department's goals or requirements and;
j. The consultant used the services of minority community organizations, minority contractor
groups, local, state and federal minority business assistance offices and other organizations the
Advocate for Minority and Women Business identified that help recruit and place disadvantaged,
minority or women business enterprises,

BACKGROUND
As part of our preparation to meetthe Oregon Department of Transportation
(ODOT) 'S requirements for an engineering request for proposals (RFP) for the
Central AshlandBicycle Path alongthe railroad, ODOThas recommendedwe use
their Disadvantaged Business Enterprise (DBE) policy.
The Citypreviouslyadoptedenextensive DBEpolicyaspartofthe FAAgrent at
the airport. ODOTfeltthatthe FAADBEpoliCy was exemplary, but suggested
that usingtheir recommended DBE policy would facilitate review of our RFP
within their system.
The policy proposed follows ODOT's recommended policy. It will help to
complete our ISTEAgrantthis federal fiscal year, and does not weakenthe
extensive DBE policy previously adopted.
