¶1. SERVICES TO BE PROVIDED: Conduct a Community Attitude Survey of Ashland cltlzens as
described in the Request for Proposal, and by the scope of work described in the
response to the request for proposal submitted by Scudder and Associates, September
1998.
ADDITIONAL TERMS: F±nal cost Nil1 be determined by survey instrument length.
Section 10 omitted.
CITY AND CONSULTANT AGREE:
1. Ail costs by Consultant: Consultant shall, at its own risk and expense, perform the personal services
described above and, unless otherwise specified, furnish all labor, equipment and materials required for the
proper performance of such service.
2. Qualified Work: Consultant has represented, and by entering into this contract non represents, that ali
personnel assigned to the work required under this contract are fully qualified to perform the service to
which they will be assigned in a skilled and Norkerlike manner and, if required to be registered, licensed or
bonded by the State of Oregon, are so registered, licensed and bonded. Consultant shall also procure and
maintain a current City of Ashland business license.
3. Completion Date: Consultant shall start performing the service under this contract by the date indicated
above and complete the service by the completion date indicated above.
4. Compensation: City shall pay Consultant for service performed, includin9 costs and expenses, the sum of
specified above. Once work commences, invoices shall be prepared and submitted by the tenth of the month for
work completed in the prior month. Payments shall be made within 30 days of the date of the invoice. Should
the contract be prematurely terminated payments will be made for work completed and accepted to date of
termination.
5. Ownership of 0ocuments: Ail documents prepared by Consultant pursuant to this contract shall be the
property of City.
S. Statutory Requirements: ORS 279.312, 279.314, 279.316 and 279.320 are made part of this contract.
7. Indemnification: Consultant agrees to defend, indemnify and save City, its officers, employees and agents
harmless from any and all losses, claims, actions, costs, expenses, judgments, subrogations~ or other damages
resulting from injury to any person (including injury resulting in death,) or damage (including loss or
destruction) to property, of whatsoever nature arising out of or incident to the performance of this contract
by Consultant (including but not limited to~ Consultant's employees, agents, and others designated by
Consultant to perform Nork or services attendant to this contract.) Consultant shali not be held responsible
for any losses, expenses, claims, subrogations, actions, costs, judgments, or other damages, directly, solely,
and approximately caused by the negligence of City.
8. Termination: This contract may be terminated by City by giving ten days written notice to Consultant and
may be terminated by Consultant should City fail substantially to perform its obligations through no fault of
Consultant.
9. Independent Contractor Status: Consultant is an independent contractor and not an employee of the C£ty.
Consultant shall have the complete responsibility for the performance of this contract. Consultant shall
provide workers' compensation coverage as required in ORS Ch 656 for ail persons employed to perform work
pursuant to this contract and prior to commencing any work, Consultant shall provide City uith adequate proof
of workers' compensation coverage. Consultant is a subject employer that Niil comply with ORS 656.017.
10. Assiqnment and Subcontracts: Consultant shall not assign this contract or subcontract any portion of the
work without the written consent of City. Any attempted assignment or subcontract without written consent of
City shall be void. Consultant shall be fully responsibie for the acts or omissions of any assigns or
subcontractors and of all persons employed by them, and the approval by City of any assignment or subcontract
shall not create any contractual relation between the assignee or subcontractor and City.

REQUEST FOR PROPOSAL
The City of Ashland is soliciting proposals from qualified firms to conduct a series
of three Community Attitude Surveys of Ashland citizens. The firm selected will
work with a small working group of elected officials and staff to review and finalize
a draft City developed survey instrument. It will select and poll a random sample of
Ashland citizens and present a report of findings to the City. It is the intent of the
City to select a firm which will complete an annual survey in 1998, with an option
by the City to utilize the firm to also complete surveys in 1999 and 2000.
Minimum Oualifications - The firm selected must have experience in developing and
conducting community attitude surveys for other public entities.

Who to Contact - Dick Wanderscheid, Administrative Services Director, is the sole
point of contact in the City for this RFP. All correspondence pertaining to this RFP

Content of the Proposals - The proposal should contain at least the following
information:
1. The firm's name, address and telephone number.
2. The number of years the firm has provided like consulting services.
The names of the persons who will be responsible for implementing the
proposal with a description of each person's experience in performing the
type of services being requested.
A list of all public bodies for which the firm has provided like services within
the last two years.
An overview of the process that will be used to implement this proposal. It
is important that adequate opportunity is provided for input by the City into
development of the final survey instrument.
The proposal shall include a schedule for performing the services and identify
any contingencies that could affect a timely performance.
The sample should be of sufficient size to ensure a -+ 5% tolerance and a
95% confidence level.
The cost of the services to be provided, including all reports, documents and
other tangible items required to be provided. The report to the City should
include at a minimum an analysis of the data, a full written compilation of
comments, and all raw data in an ASCII format. The budget should include
the cost by year to provide this service in 1998, 1999 and 2000. The cost
estimate should include costs for 13, 15 and 17 minute telephone surveys.
It should also include one trip to Ashland each year to present survey results
to the Ashland City Council.
Responding firms are encouraged to identify problems and solutions and may
recommend additional services that would benefit the City. Additional services
accepted by the City will be included in the contract.
Submission of Proposals - In order to be considered, sealed proposals must be
received by the City by 5:00 p.m. on September 25, 1998.
Three copies of the proposal shall be submitted in sealed envelopes or packages
and clearly marked on the exterior "Community Attitude Survey RFP".
Evaluation of Proposals - Proposals will be evaluated according to the following
criteria: 1) the general experience and qualifications of the firm, including
experience in providing the type of services requested; 2) the ability of the firm to
provide services promptly and efficiently as needed by the City; and 3) the cost of
services to be provided, including all reports, documents and other tangible items
required to be provided.
