AN ORDINANCE AMENDING ORDINANCE NO. 1676 PERTAINING
TO REGULATIONS GOVERNING WATER SERVICE, RELATING TO
THE FURNISHING OF IRRIGATION WATER FROM THE TALENT
IRRIGATION CANAL.
THE PEOPLE OF THE CITY OE ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. Section 1 of Ordinance no. 1676 is hereby
amended by amending Section 1.6 of Exhibit "A" in its entirety,
which shall hereafter read as follows:
"1.6 Irrigation Service (TID Water)
1.6.1 Definition
TID irrigation service shall be
defined as the provision of water service to
a premise through the TID water system for
sprinkling lawns, gardens, pasture, or orchards.
1.6.2 Irrigation Water Rates (TID Water)
TID irrigation rates shall be as established
by the City in the regular published rate schedules
as amended from time to time by the City Council.
Such rates shall provide for both a metered and
an unmetered schedule. As far as is practical,
the TID system shall be self-supporting, so that
domestic water users will not subsidize the rates
of TID water users.
If more than one acre-foot of water is
used per acre, or if the water is served by a 1"
or larger pipe, a meter may be installed at the
discretion of the City, and charges made on the
basis of metered usage. Payment shall be due for
unmetered irrigation water as follows: One-third
when water is made available, one-third thirty (30)
days thereafter, and the remaining one-third sixty
(60) days after the water is made available.
1.6.3 Computation of Acreage; grievances
Ail persons using TID irrigation water
having grievances as to the amount of land billed
by the City on an acreage basis may, upon written
application to the Recorder-Treasurer, have the
same rechecked. If such recheck determines an
overcharge by the City, no charge shall be made
for the recheck and a billing credit shall be
issued to the customer. In the event that the
recheck determines an undercharge by the City,
the customer shall be billed at the actual hourly
rate of personnel required to conduct the recheck,
and a supplemental billing shall be issued by the
City for the additional acreage.

1.6.4 Misuse of Irrigation Water
Any person who shall allow or supply in any
way others with wateL or who shall willfully misstate
the amount of land to be irrigated and the location
of said land, or who shall use Talent Irrigation water
for irrigation purposes without first having filed
application with the Director of Public Works for
the same, or who shall irrigate more land than named
in said application or any land not so named in said
application, shall be deemed guilty of an unlawful
act and be punished according to the provisions of
these regulations or the ordinance so adopting these
regulations.
1.6.5 Priority of Use
The primary use of the City's TID water is
for domestic purposes in water-short years. Also
to be considered as primary use is the need for TID
water for domestic use in future non water-short
years as domestic need increases, or when needed to
supplement water rights in Ashland Creek.
At times other than noted above, the TID
water will be available for irrigation purposes at
rates less than those in effect for domestic water.
1.6.6 Construction and Maintenance
The TID distribution system shall be con-
structed and maintained to serve as many customers
as possible where such construction is determined
by the City to be economically feasible. New
connections to the system shall be permitted only
if the particular supply line has sufficient capacity
to serve the applicant, without jeopardizing service
to other customers. The costs of replacing distri-
bution lines shall be borne by system users.
1.6.7 New Connections Interruptable
Ail new customers will be informed that supply will
be on an interruptable basis only. In water-short
years, the City will have the right to restrict the
use of TID water by irrigation customers.
If a parcel of land presently served by TID
is divided, each newly created parcel will be treated
as a new customer subject to regulations pertaining
to new customers.

1.6.8 Service Equipment
If proper water service cannot be provided
to any customer because of debris in the service
lines, the City may require the customer to provide
an approved screen on the service line.
1.6.9 Sprinkling Equipment
If it is determined that water can be con-
served or waste reduced, the City may require that
flood irrigation be replaced with sprinkling
equipment. Such requirement may be imposed on
individual customers as necessary.
SECTION 2. Section 5 of Ordinance No. 1676 shall be amended
to read as follows:
"Every person who willfully violates any of the provisions
of the ordinance shall, upon conviction thereof, be guilty
of an infraction, and shall be punished as set forth in
Section 1.08.020 of the Ashland Municipal Code."
The foregoing was first read on the ~-f~ day of
