AN ORDINANCE CREATING A PLANNING COMMISSION, ESTABLISHING
SUB-COMMITTEES, PROVIDING FOR THE APPOINTMENT OF MEMBERS,
FIXING THEIR TERM OF OFFICE, ESTABLISHING POWERS AND DUTIES
OF THE CO~,IISSION AND ITS SUB-COMMITTEES; AND REPEALING
ORDINANCE NOS. 1051, 1237, 1532 AND ALL OTHER ORDINANCES
IN CONFLICT HEREWITH.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. REPEAL OF CONFLICTING ORDINANCES. Ordinance Nos.
1051, 1237, 1532, all amendments thereto, and all other sections of
Ordinances in conflict with the provisions of this Ordinance are
hereby repealed.
SECTION 2. PLANNING COMMISSION CREATED. There is hereby
created a "City Planning Commission" of nine (9) members, to be
appointed to serve without compensation by the Mayor and confirmed
by the City Council, not more than two (2) of which may be non-
residents of the City. The Mayor, City Attorney and City Engineer
shall be ex-officio, non-voting members of the City Planning Commission.
SECTION 3. SUB-COMMITTEES ESTABLISHED. There are hereby
established the following sub-committees, each consisting of three (3)
members of the City Planning Commission, and two (2) voting members-at-
large, all appointed to serve without compensation by the Mayor, with
confirmation by the City Council:
Zoning Adjustment Committee
Ashland Redevelopment Committee
Economic Development Committee
SECTION 4. TERMS OF OFFICE; VACANCIES. At the first meeting
of the City Planning Commission, the nine appointed members shall
choose their terms of office by lot as follows: two for terms to
expire December 31, 1972; two for terms to expire December 31, 1973;
two for terms to expire December 31, 1974; and three for terms to
expire December 31, 1975; and shall immediately thereafter notify
the Mayor and City Council in writing of such allotment. Their
successors shall hold office for four years. Terms of office of
sub-committee members from the City Planning Commission shall be
concurrent with their terms on the commission; and for the members-at-
large, one shall be appointed to a term expiring December 31, 1973
and one to a term expiring December 31, 1974, with their successors

SECTION 4. (continued) to hold office for two (2) years. Any
vacancy shall be filled by the Mayor, with confirmation by the City
Council, for the unexpired portion of the term.
SECTION 5. ELECTION OF OFFICERS; ANNUAL REPORT. The
Commission and each sub-committee, at its first meeting, shall elect
a Chairman and a Vice-Chairman, and shall appoint a secretary who
need not be a member of the Commission or sub-committee, all of
which shall hold office during the pleasure of the Commission or
sub-committee. The secretary shall keep an accurate record of all
proceedings; and the City Planning Commission shall, on the first
day of October of each year, make and file a report of all its
transactions with the City Council.
SECTION 6. QUORUM; RULES AND REGULATIONS. Five members of
the City Planning Commission, or three members of a sub-committee,
shall constitute a quorum. The Commission and each sub-committee
may make and alter rules and regulations for its government and
procedure, consistent with the laws of the State of Oregon and with
the City Charter and ordinances, and each shall meet at least once
every thirty (30) days.
SECTION 7. POWERS AND DUTIES OF THE PLANNING COMMISSION.
The powers and duties of the City Planning Commission may be, but
shall not be limited to, those set forth in O.R.S. 227.090. et. seq.,
as follows:
1. Recommend and make suggestions to the City Council
and to all other public authorities concerning laying out,
widening, extending, and locating of streets, sidewalks and
boulevards; parking; relief of traffic congestion; betterment
of housing and sanitation conditions; and establishment of
zones or districts limiting the use, height, area and bulk
of buildings and structures.
2. Recommend to the City Council and all other public
authorities, plans for regulation of the future growth,
development and beautification of the municipality in
respect to its public and private buildings and works,
streets, parks, grounds and vacant lots; plans consistent
with future growth and development of the City in order to
secure to the City and its inhabitants sanitation, proper
service of all public utilities, and transportation facilities.
3. Recommend to the City Council and all other public
authorities, plans for promotion, development and regulation
of industrial and economic needs of the community in respect
to private and public enterprises engaged in industrial
pursuits.

4. Advertise the industrial advantages and opportunities
of the municipality and availability of real estate within
the municipality for industrial settlement.
5. Encourage industrial settlement within the munici-
pality.
6. Make an economic survey of present and potential
possibilities of the municipality with a view to ascertain-
ing its industrial needs.
7. Study needs of existing local industries with a view
to strengthening and developing local industries and stabilizing
employment conditions.
8. Do and perform all other acts and things necessary or
proper to carry out t]~e provisions of ORS 227.010 to 227.150.
9. Study and propose in general such measures as may be
advisable for promotion of the public interest, health,
morals, safety, comfort, convenience and welfare of the City
and of the area six miles adjacent thereto.
In addition, it shall have the powers and duties to:
1. Act upon appeals from administrative decisions of
sub-committees established under Section 3 of this Ordinance
pursuant to powers and duties granted to such sub-committees
under Section 8 of this Ordinance.
2. Review all proposed ordinances regulating or limit-
ing the use, height, area, bulk and construction of buildings
and appurtenant facilities; to hold the necessary public
hearings thereon; and to make its recommendations thereon
in writing to the City Council.
3. To act as the Urban Renewal Agency in lieu of the
former "Ashland Development Commission", to which reference
is made in Resolution No. 68-2, adopted by the City Council
on January 9, 1968.
SECTION 8. POWERS AND DUTIES OF SUB-COMMITTEES. The powers
and duties of the sub-committees established under Section 3 of this
Ordinance shall be as follows:
A. Zoning Adjustment Committee:
1. Act on behalf of the City Planning Commission
in approving Conditional Use Permits and Variances as
set forth in Sections 39 and 40 of Ordinance No. 1361.
Appeals from administrative decisions of the committee
shall first be made to the Planning Commission in the
manner set forth for appeals to the Council therein, and
eventually to the Council as set forth therein in
Section 44 of said Ordinance.

2. Act on behalf of the City Planning Commission
in approving Minor Land Partitions as set forth in
Sections 20 and 21 of Ordinance No. 1318; on variances
relating to minor land partitions, set forth in Sections
32 and 33; and on appeals relating to minor land parti-
tions, set forth in Section 34 of said Ordinance.
Appeals from administrative decisions of the committee
shall first be made to the Planning Commission in the
manner set forth for appeals to the Council in said
Section 34, and eventually to the Council as set forth
therein.
3. Act on behalf of the City Planning Commission
in determining off-street parking for uses not specifi-
cally listed under Section ~2(2)(h) of Ordinance No.
1361; and in authorizing a ?eduction of parking require-
ments, under Section 22(3) of Ordinance No. 1361.
B. Ashland Redevelopment Committee:
1. To perform all functions envisioned for the
"Ashland Central Area Coordinating Committee'~ and the
"Design Committee" outlined in the Central Area Plan,
as adopted on January 9, 1968.
2. To perform all functions outlined in Ordinance
No. 1532, adopted August 8, 1967.
C. Economic Development Committee:
To assist the Planning Commission by making specific
studies and recommendations concerning the economic
development of the community, charged to the Planning
Commission under O.R.S. 227.090, Sections (3) through
(7) inclusive.
SECTION 9. FUNDING; GIFTS AND BEQUESTS. The City Council
may annually budget such sums, and may authorize the employment of
consulting advice and/or necessary staff to carry out the powers and
duties delegated to the City Planning Commission and its sub-committees
set forth in this Ordinance. The Commission may receive gifts,
bequests or devises of property to carry out any of the purposes of
this Ordinance, which shall be placed in a special fund for the use
of said Commission.

sentence, clause or phrase of this Ordinance is for any reason held
by a court of competent jurisdiction to be invalid, such decision
shall not effect the validity of the remaining portions of this
Ordinance.

SECTION 11. EFFECTIVE DATE. The effective date of the
provisions of this Ordinances shall be July 1, 1972.
The foregoing Ordinance was first read at a regular meeting
of the Common Council held on the 4th day of April ,
1972 and passed on its second reading and duly passed on the
18th day of April , 1972, the vote being as follows:
