INTERGOVERNMENTAL AGREEMENT
BETWEEN
THE CITY OF ASI-ILAND AND JACKSON COUNTY FOR BUILDING CODE
ENFORCEMENT RESPONSIBILITIES
This agreement is between the City Of A~hlnr~d (City) md Jackson Cotmty (County). The
intent of the agreement is to enable the City of Ashland'a Building Division to assist 1ackson
County with County's building code administration responsibilities while the County arranges
for qualified personnel to continue the work.
1. AUTHORIZATION. ORS 190.110(1) authorizes County and City to
enter imo this agreement. Both County and City exercise powers relating to building code
adn'dnistratio~ (ORS 455.110; 455.] 50).
2. TERM. TMs agree~t shall become effective on the date signed by both
paxfies. Unless term;noted or extcuded, the agreement shall expire on Mm-ch 30, 2001.
3. STATEMiC. NT OF WORIC Ashland Building D/vision employee. Mike
Broorafield, will act as interim building official for ~'ackson County. Mr. Broomfield is
appropriately qualified and certified to act as the building official for the County. In the capacity
as interim building official, and in accordance with the te~-as or,his agreement:
On a limited bad, a, Mr, Broom.field will oversee application of the storewide
building code in County's jucisdiction. Mr. Broomfleld will make necessary
interpretations of tho building codes and will approve altexrmtive methods of
construction, where appropriate. He w/ll advise cotmty employees on technical
issues relating to statowlde building codes.
Mr. Broomfield may authorize lhe use of plans exam/nation and/or inspection
services provided by the City. Mr, Broomfield will direct and schedule any platls
examination or insp~tion services required and coordinate those serdce~ with the
existing County plans examiners and haspeetors and/or other available plan~
examination and i~tion serv~e providexa.
4. PAYMENT FOR SERVICES.
a. County agrees to re/mburse City the hourly rate of $65.00 for each hoxtr wocked by
Mr. Broomfield and thc hourly rate of $$0.00 for each hour worked by a certified plans examiner
and inspector. The City shaJl keep records of the dates and hours worked by Mr. Broomfield
and/or o:her City employees. Mr. Broomtleld services shall be prey/dod free of charge for the
month of Sanuary. County shall wimburse City for mileage payment~ claimed by Mx. Broomfield
and/or other City employees daring the term of the agreement at the County rate of $0,325 a

shall detail all items o£consideration. County shall pay City ~he amount irMicated by City's
statement within thirty (30) days of receipt.
$. COUNTYtS REPRESENTATIONS AND WARRANTIES.
County represents and warrants thax it has the power and authority to enter into this
a~reement, that it has taken all necessary m~d legal actions to effectuate this agreement and
further r~presents and warrants that it has sufficient funds currently available for expenditure to
finance the costs of this agreeaaaent.
6. LIMITATIONS OF LIABILITY
All parties agree that each party shall not be subject to claim, action, or liability arising in
any manner whatsoever out of any act or omission, interruption, or cessation of services by the
other party under this agreement. Each party shall not be liable or responsible for any direct,
indirect special or consequent/al damages sustained by the other party to this agreement,
including, but not limited re, delay, or interruption of business activities that may result in any
manner whatsoever from any act or omission, interruption, or cessation of services.
7. INDEMNIFICATION
Subject to thc limitations and conditions of thc Oregon Tort Claims Act, ORS 30.260 er
soq., and Article II, Section 7 of the Oregon Constitution, each Party to this agrccmen; shall be
solely responsible for its own actions and/or failure to act and shall indemnify and hold the other
party harmless from any liabihty, cost or damage arising there,'om The provisions of this
paragraph shall survive the expira~on or sooner termination of this agrecmcm.
8. TERMlrNATION.
Th/s agreement may be terminated at any t/me by mutual written consent of tho parties.
City or County may tcrminate this agreement, in whole or in part, upon five (5) days written
notice to thc other patty.
9. NOTICE.
Except as otherwise expressly provided in this agreement, any notices relating to this
agrecn,ent shall be given in writing by personal deliva'y, facsimile, or mailing the same to City
or County at the add~ess or number set forth on thc signature page of this agreemem, or to such
other addresses or numb~'s as either party may horeafte-r indicate pursuant to Rig paragr~pI~ Any
comm-,%ation or notice so ad&cssed and mailed shalt be deemed to be given five day~ a~er
mailing. Any com~nunic.~t|on or notice deliwrod by fines/mile shall bo deemed to be giv~m when
receipt of the transmission is geuer~ted. Any communication or notice by p~,aonal delivery shall
b~ de~med to bc given when actually delivered.
MERGER CLAUSE; WAIVER.
This agreement constitutes the emir¢ a~ement between the parties on the subject matter
hereof. There are no understandings, agreements, or repr ¢ntation , oral or written, not specified
herein regarding this agreemenT. No waiver, ~nsent, modification or change of terms of this
agreement shall bind either party unless in writing and signed by both Pm, xies and for whSeh all
necessary approvals have been obtained. Such waiver, consent, modification or change, if made
shall be effective only in the specific instance and for fl~e ~pec/fic purpose given. The failure to
enforce any provision of this agreement shall not constitute a waiver of that or any other
provision.
