BOUNDARY LINE AGREEMENT
Boundary line agreement made July 3, 2001, by the City of Ashland ("City") and
Norman K. Purdy and Jeanne C. Collins, Trustees or their successors in trust under the
Purdy Collins Living Trust, dated November 2, 2000 ("Trust").
RECITALS:
A. City owns property in the City of Ashland, Oregon, described on the attached
Exhibit A and commonly known as the Hillah Temple property.
B. Trust owns property described on that certain bargain and sale deed between
Eleanor S. Purdy, Trustee, as Grantor, and Norman Kenneth Purdy as Grantee,
recorded in Jackson County Deed Records, Recorder Number 81-17891 ("Trust
property") which is adjacent to the Hillah Temple property.
C. City and Trust are uncertain of the location of the common boundary line
between the two properties.
D. The parties desire to settle all questions relating to the location relat"ing to this
common boundary.
City and Trust agree as follows:
1. Boundary Line Agreement: The parties agree on and fix the common boundary line
between the Hillah Temple property and the Trust property as described in the attached
Exhibit B.
2. Bindinq Effect: The benefits and obligations of these covenants shall run with the
land described and shall bind the respective parties, their heirs, legal representatives,
and assigns.
3. Quitclaim: City releases and quitclaims to Trust all right, title and interest in and to
the real property southerly of the boundary line described in Exhibit B. Trust releases
