HomeMy WebLinkAbout1993-11-09 Hearings Board MINASHLAND PLANNING COMMISSION HEARINGS BOARD NOVEMBER 9,1993 MINUTES CALL TO ORDER The meeting was called to order at 1:40 p.m. by Chairperson Barbara Jarvis. Other Commissioners present were Larry Medinger and Michael Bingham. TYPE II PUBLIC HEARINGS PLANNING ACTION 93-108 REQUEST FOR A MINOR LAND PARTITION TO DIVIDE A LOT INTO 'rwo PARCELS FOR THE PROPERTY LOCATED AT 943 OAK STREET WITH A FLAG DRIVE FROM OAK STREET ACCESSING THE REAR PARCEL. APPLICANT: LANCE & VIRGINIA HONDA Site Visits and Ex Parte Contacts All Commissioners had a site visit. STAFF REPORT This action is continued from last month and it was the hope of the Hearings Board that the three parties could get together to resolve their differences. To Molnar's knowledge, nothing has changed. Staff would prefer to see the flag access through Phase II of Oak Meadows subdivision, however, this would involve cooperation from Don Greene and would require modification of Oak Meadows subdivision. Additional information provided by the applicant is showing vegetation on the property that would restrict access on the south side of the property. If the boundary line adjustment is finalized by Greene and Honda, the application would appear to meet the Minor Land Partition section of the ordinance. Jarvis noted that she has reviewed everything in the record including the minutes and she has looked at the area and had a discussion with Staff regarding this action. Staff did not feel it was necessary for Jarvis to listen to the tapes from last month's meeting in order to participate in today's hearing. ASHLAND PLANNING COMMISSION HEARINGS BOARD MINUTES NOVEMBER 9, 1993 PUBLIC HEARING JOHN HASSEN, Attorney, 129 Oakdale, Medford, OR 97501, spoke on behalf of the applicant. He reported that the Hondas have negotiated an agreement with Greene. They were not able to negotiate an agreement to access the flag through Greene's subdivision because Greene felt it would be too much trouble to change his preliminary plat. The two parties did agree upon the boundary line. The adjustment will give the Hondas the added footage so they can proceed with their Minor Land Partition. It appears that the criteria have been met with Guerriero's property, the only property affected. Staff would recommend a Condition for a common driveway with the flag coming off a common curb cut. This may require an adjustment of the flag and the existing drive. Molnar was not certain a common driveway is possible due to the angles and because of the carport. Condition 10 can be left as is and if it is not feasible, the applicant can ask for a change in Condition. HASSEN indicated there would be room for a turnaround driveway on the back of parcel 5. COMMISSIONERS DISCUSSION AND MOTION Bingham moved to approve PA93-108 with the attached 10 conditions. Medinger seconded and the motion carried unanimously. PLANNING ACTION 93-119 REQUEST FOR A SITE REVIEW TO REPLACE THE EXISTING BUILDING WITH A TWO-STORY COMMERCIAL/RESIDENTIAL STRUCTURE AT 233 FOURTH STREET. ALSO INCLUDES PARKING VARIANCE TO REDUCE THE NUMBER OF REQUIRED SPACES BY 50 PERCENT. COMPREHENSIVE PLAN DESIGNATION: EMPLOYMENT; ASSESSOR'S MAP #: 9BA; TAX LOT: 3500. APPLICANT: TOM FRANTZ Site Visits and Ex Parte Contacts Medinger has traveled by the site for years. Bingham had a site visit and noted the building that used to be there isn't there anymore. Jarvis had a site visit. ASHLAND PLANNING COMMISSION HEARINGS BOARD MINUTES NOVEMBER 9, 1993 STAFF REPORT This application involves a building located across the alley from Peerless Rooms. The building that had been on the property has been demolished. The upstairs of the new structure will consist of an 800 square foot residence. The area downstairs will be commercial. The parking will be perpendicular off the alley, not diagonal. The applicant is requesting a 50 percent parking variance. The Historic Commission's concerns with design from last month have been resolved with the Commission giving unanimous approval of the design. With regard to parking, the applicant is not certain how the ground floor space will be used, but most likely, general office or retail. Staff is not recommending approval of the Variance. If the applicant decides at a later date that the downstairs will house a more intensive use, he will come back then to request a Variance. There are eight attached Conditions. PUBLIC HEARING TOM FRANTZ, has had several interested renters and he wants to do something that will fit into the overall Fourth Street streetscape. COMMISSIONERS DISCUSSION AND MOTION The Minutes from the Historic Commission have been made part of the record. Medinger moved to approve PA93-119 with the attached Conditions and deny the Variance without prejudice. Bingham seconded the motion and it was approved unanimously. TYPE I PLANNING ACTIONS PLANNING ACTION 93-131 IS A REQUEST FOR A MINOR LAND PARTITION TO DIVIDE A LOT INTO TWO PARCELS FOR THE PROPERTY LOCATED AT 507 TUCKER STREET. APPLICANT: THOMAS S. CLAYTON & JOANNE CLAYTON This action was approved. ASHLAND PLANNING COMMISSION HEARINGS BOARD MINUTES NOVEMBER 9, 1993 PLANNING ACTION 93-130 REQUEST FOR FINAL PLAN APPROVAL FOR A 14-LOT PHASE II OF A 25-LOT SUBDIVISION UNDER THE PERFORMANCE STANDARDS OPTIONS, FOR THE PROPERTY LOCATED ON THE NORTH SIDE OF EAST MAIN ON FORDYCE STREET. APPLICANT: KEITH AVERY/BEAR CREEK CONSTRUCTION This action was approved. PLANNING ACTION 93-132 REQUEST FOR A CONDITIONAL USE PERMIT TO EXPAND A NON- CONFORMING STRUCTURE (PORCH ADDITION) TO THE PROPERTY LOCATED AT 156 SIXTH STREET. APPLICANT: BOB MEISER This action was approved. PLANNING ACTION 93-133 REQUEST FOR A CONDITIONAL USE PERMIT TO CONVERT THE EXISTING NON-CONFORMING GARAGE TO A BEDROOM WITH A BATH (NO KITCHEN) AT 126 BUSH STREET. APPLICANT: BILL EMERSON Jarvis had major concerns for fire safety at this site because the buildings on the property and surrounding properties were very close together. Add a Condition that a one-hour fire wall be included to meet the requirements of the Building Department. The action was approved. PLANNING ACTION 93-134 REQUEST FOR A CONDITIONAL USE PERMIT FOR A FOUR-UNIT TRAVELLER'S ACCOMMODATION AND AN OWNER'S UNIT (TOTAL OF 5 UNITS) FOR THE PROPERTY AT 407 SCENIC DRIVE. APPLICANT: RICHARD WAGNER AND JOYCE WARD Add a condition that a fire wall be added to meet the requirements of the Building Department. The action was approved.
