The purpose of this agreement is for the City to act as an agent of the Division in administering the statewide profabricated structures inspection program specifically for electrical inspections, I. STATEMENT OF RESPONSIBILITY City agrees to follow and be bound by all laws, rules and regulations in ORS 455 and OAR Chapter 91 g, Division 674. The City may provide inspections under the statewide authority of the Division as outlined in OAR 918-674-0000. II. PURPOSE - ELECTRICAL INSPECTIONS Division shall: I. Issue insignias as required. 2. Retain responsibility for all plan reviews. This agreement is only for inspections. 3. Periodically monitor the City (or its representative) to verify that it is prudently providing inspections. 4. Retain the right to monitor the manufacturer to verify that all requirements of Oregon's Specialty Codes are met. .~ 5. In the event work is not in compliance with Oregon's Specialty Codes, inform the City (or its representative) of specific violations within 10 days of the Division's review. If the City (or its representative) fail to comply with noted violations, the agreement will be terminated effective upon written notice from the Division. 6. Reserve the right to verify inspector credentials. 7. With adequate notice, provide coverage or re-assume the inspection program (in whole or part) if the City carmot supply certified individuals within 60 working days. 8. Provide applicable forms, and applicable training (in the Salem office) on how to use and process those forms if requested. 9. Retain Building Official jurisdiction. c" ~:~ '" ~i 10. Reserve the right to direct time and location of inspections. ~ BUILDING CODE$'$W$ Fax:503-3?8-4101 Apr 8 '98 9:24 P. 03 B. City shall: 1. Charge the Division an inspection fee of $55.00 per hour. Hourly rate will include inspection and travel time. Invoices will be submitted monthly to: Rick Lloyd Building Codes Division/Statewide Services P.O. Box 14470 Salem, OR 97309 2. Be able to utilize a contractor to carrybout its duties, provided the contractor meets Inspector Certification Requirements outlined in OAR 918-674-0220 and is approved by the Division prior to commencing work. If the City wishes to utilize a contractor, a copy of the agreement must be filed with the Division. 3. Provide copies of inspection reports to the Division within I 0 calendar days of providing the actual inspection. Reports must be on Division provided forms. 4. Maintain records of all inspections provided on Division forms. Inactive files two (2) years or older shall be returned to the Salem office for retention. 5. Meet service standards prescribed in OAR 91g-674-0055. 6. Coordinate and gain approval from the profabricated structures electrical inspector (Salem office) and with the State B.uilding Official before approving deviations from the Division approved plans. 7. Verify that inspectors have proper'credentials as put forth in OAR 918-674-0220. 8. Require manufacturer compliance to BCD approved plans before recommending that BCD issue insignias. 9. Upon notification by BCD that buildings constructed do not conform to approved plans and/or the State Building Code, assure timely manufacO.trer compliance to bring subject building(s) into conformance with the State Building Code. In such situations the City must issue stop work orders ("red tags") or remove insignia(s) of compliance as applicable. IV. AMENDMENT The terms of this agreement shall not be waived or amended except by a written agreement signed by both parties. BUILDING CODES SWS Fax:503-S?8-4101 Apr 8 '98 9:24 P. 04 V. EFFECTIVE DATF. S This agreement is effective upon signature of both obligating parties and expires July I, 1999. VI. TF, RMrNATION 1. Th~,s agreement may be terminated by mutual consent or by either party giving 60 days notice in ~vriting to the other and delivered by certified mail or in person. 2. Notwithstanding "l" of this section, Division may terminate the whole or any part of this agreement effective upon written notice if the City fails to provide some or all services called for in this agreement.
