Dear Ron,
It was good to talk to you on Monday. I appreciate your understanding of our water situation. I know it has
been a difficult year for you and cattle ranching as well. As predicted, I will need you to shut off one of the
irrigation gates on the canal effective today. I had left you a message stating that it was your choice as to
which gate to close, but after talking to Jim Pendleton, TID, he recommended I consider water rotation and
have you continue with the rotation starting today for the south gate.
I advised Jim Pendleton that I authorize the north gate (one closest to Mountain A venue) closed for the
remainder of the irrigation season. This should affect only two cycles as irrigation is expected to shut off
completely on September 14th (24 days from now). Your south gate had water this past weekend.
In c~nsideration of your help and loss of irrigation, I will provide you with a full month's credit ($1000).
Your latest payment was in May and covered pasture rent for March - May 2001. This next quarter's
payment is due at the end of August, and will be for $2,000 only.
I am curious of your future plans. Do you anticipate using this site over the fall and winter? Please let me
know. Should you choose to relocate your cattle and not remain on the site, please give me a 30 days notice.

Dear Ron,
Thank you for submitting your quarterly check for pasture rent for March - May 2001. Although the City is
no longer pursuing the spray irrigation options, we still own this property. As such, the City will continue
your lease through the remainder of this calendar year. However as in the past, we reserve the right to
provide you with 30 days notice to remove your cattle if the City should decide to sell or otherwise use the
property in a way that precludes your use. As such, we will continue to allow you to use the property for
pasture grazing for your cattle at $1,000 per month, payable every three months. Should you choose to
relocate your cattle and not remain on the site, please give me a 30 days notice.
I anticipate you will flood irrigate the pasture. Over the past few years, the flood irrigation system has
deteriorated and is in need of some repairs. Please make necessary repairs to ensure you irrigate in such a
manner as to not create runoff off the site. I anticipate this to be a water short year, so please irrigate wisely.

Dear Ron,
I have been meaning to write this letter for the past three weeks, as we are now entering irrigation
season and your cattle will be ready for water.
My last letter to you, December 21, 1999, authorized your cattle to remain on the site through April
15,2000. Construction of the wastewater treatment reuse project on the property continues to be
delayed. The City is, therefore, in a position to continue your lease through the majority of irrigation
season (at least through September 2000). As I am sure you are busy, unless we hear otherwise, I
will expect you to remain on the site. Please inform me if this is not the case so that we can negotiate
with another rancher.
I anticipate you will need to irrigate the pasture and further expect that you will use flood irrigation
techniques to do so. Over the past few years, the flood irrigation system has deteriorated and is in
need of some repairs. Please make necessary repairs to ensure you irrigate in such a manner as to not
create excessive runoff off the site. If possible, do not irrigate the south eastern portion closest to the
swale leading to the 1-5 over pass at Eagle Mill Road as we would like to keep that as dry as possible.
Should we be able to begin construction this calendar year, that is the area in which we would begin.
Please ensure your payments are current. The City expects a payment every two months of
$1000/month. The Finance Department will review and invoice as necessary for the time from
December 30, 1999 to now.

It was good to talk to you last week. I appreciate your continued interest in the City's property
and am glad we can work together. As discussed last Friday, the City is prepared to re-activate
your lease at a prorated monthly rate of $1 ,000 for the same relative number of cattle you had
been grazing.
You have been authorized to remain on the site through April 15, 2000. We may be in a position
to continue your lease beyond that time if the construction continues to be delayed. I will contact
you at the beginning of April if there are any changes on the City's part with respect to the start
of construction on that site. I ask that you continue not to flood irrigate as we are trying to keep
the south eastern portion closest to the swale leading to the 1-5 over pass at Eagle Mill Road dry.
Please inform me of the date you re-enter the site. I would appreciate payment every two
months.

Dear Ron,
It was good to talk to you today. I realize it has been a bit confusing with our lease
arrangements. I found your old lease, and as we discussed, the terms were $11,000 a year and
expiring on April 14, 1999. As discussed today, to keep the terms simple for the remaining
month-to-month situation we are facing this spring and summer, the City is prepared to continue
at a prorated monthly rate of $1 ,000 for the same relative number of cattle you are currently
grazIng.
You have been authorized to remain on the site through August 15, 1999. I will endeavor to
contact you at the beginning of August if there are any changes on the City's part with respect to
the start of construction on that site. I ask that you continue not to flood irrigate. Should you
need irrigation, we could meet on site and discuss options for irrigating the north western end of
the property, but we are trying to keep the south eastern portion closest to the swale leading to
the 1-5 over pass at Eagle Mill Road dry. Let me know if we need to meet.
My calculations show this initial time extension throu~h June 15, 1999 would be a $2,000 lease
fee, and the remaining two months through August 15 , another $2,000. Please forward the
initial $2,000 at this time. The subsequent $2,000, should you decide to remain on the site,
would be payable by August 1, 1999.

Your lease of property with the City of Ashland was officially up April 15, 1999,
however, Public Works Director Paula Brown extended this time allowing you to keep
your cattle on the property until May 1, 1999, with the understanding that you were not
to open any irrigation gates. The purpose of this letter is to inform you that the city is
again extending your time on the property to June 15, 1999, with the same stipulation in
place regarding the irrigation gates.

As I told your wife on the telephone on October 13, 1998, the City of Ashland will not
be renewing your grazing lease on the "Imperatrice" property when the current lease
comes due (April 15, 1998, through April 14, 1999) as the city has made the
decision to change the use of this leased land. This letter is to confirm that
telephone call.
I would appreciate it if you could coordinate the return of this property to the city -
when the time is right - with our Director of Public Works, Paula Brown. I know that
she would appreciate your making sure that all of the irrigation gates on the site are
closed in order for us to keep the site dry at the start of next irrigation season. You
can reach Paula at 488-5587.
