Dear Mr. Alsing:
I am writing on behalf of Tibby OIBrien, who is on leave
for three months. Dr. Le Gilsen has reviewed the materials
submitted as a final product for the Ashland grant, and
does not feel that the City's contractual obligations have
been met.
Apparently, the consultant did not supply site forms as
required under Section 1f of the contract. In addition, he
had questions about items relating to the project report.
Finally, the contract calls for the submission of three
copies of the report. I can locate only one.
Perhaps you might want to have the Infotech people call
Dr. Gilsen at 378-5001. If you have questions of me, I can
be reached at the same number.

AGREEMENT
This agreement is made this
by and between the City of Ashland,
to as "City," and INFOTEC Research,
as "Contractor."

RECITALS
WHEREAS, the U.S. Department of Interior, National Park
Service under the National Historic Preservation Act, has made
funds available for Survey and Planning projects; and
WHEREAS, the State Historic Preservation Office (SHPO) has
agreed to act as a grant administration agency for these funds; and
WHEREAS, City entered into an archaeological Survey
agreement with SHPO under the above program and has agreed to
spend and utilize those grant funds in accordance with said
agreement, and in accordance with federal regulations and
requirements; and
WHEREAS, Contractor has been selected by City under an RFP
process as being the lowest responsible or most qualified bidder,
and has been awarded this contract; and
WHEREAS, Contractor, in consideration of the sum indicated
on the Contractor's Proposal, which by this reference is made a
part hereof, and in consideration of the other covenants and
agreements herein contained, agrees to perform and complete the
work herein described.
NOW, THEREFORE, the terms and conditions as being put forth
herein, it is agreed by and between the parties hereto as follows:
1. a. Contractor shall accomplish the scope of the work
for this project as indicated in Exhibit A, attached
hereto and by this reference made a part hereof, and
comply with all standards and specifications which are
also incorporated as part of this agreement.
b. Contractor shall meet the following schedule for
completion of project:

End July 31, 1988
2. City shall make payment to contractor of a sum, not to exceed
the bid amount of $2,750.00 for accomplishment of the project.
Contractor shall submit a monthly billing for work completed and
shall receive payment from City within 15 days.

3. Amendments to this agreement including the scope of work found
in Exhibit A, and compensation, shall only be made upon written
amendments agreed to and executed by the parties and approved by
SHPO.
4. Contractor shall obtain and maintain all licenses or permits,
and meet all requirements of local, state or federal law necessary
for the successful completion of this project.
5. Contractor shall not enter into any subcontracts for any of
the work scheduled under this contract, or assign any right,
interest or obligation under this contract, without obtaining
written approval of City and SHPO.
6. Termination Conditions
In event of Contract termination by any of the following
provisions, the parties agree to make notification in writing of
the reasons for termination and the effective date.
a. Termination for Cause
City, by written notice of default (including breach of
contract) to the Contractor may immediately terminate the
whole or any part of this agreement if Contractor fails to
perform in the manner called for by this agreement; or
fails to provide the services within the time specified
herein, or any extension hereof; or fails to perform any
of the other provisions of this contract; or fails to
pursue the work as to endanger performance of this
contract in accordance with its terms, and fails to
correct such failures.
b. Termination of Grant
City may terminate Contract if the State of Oregon or the
National Parks Service terminates project funding due to
noncompliance with grant condition.
c. Termination for Convenience
This Contract may be terminated in whole or part if the
State of Oregon, National Parks Service, City and
Contractor agree that continuation of the project would
not produce beneficial results commensurate with the
further expenditure of funds. The parties will agree upon
termination conditions, including effective date, and in
the case of partial terminations, the portion to be
terminated.

7. The rights and remedies of City provided in Section 6 related
to defaults by the Contractor shall not be exclusive, and are in
addition to any other rights or remedies provided by law or under
this agreement.
8. Compensation in Event of Termination
If Contract is terminated for reasons identified in Section 6
above, Contractor will be compensated by City proportionately for
the work that has been satisfactorily completed. Determination of
satisfactory work will be made by City in accordance with
generally accepted standards of the trade.
9. Attorney's Fees
In the event any proceeding is brought for failure to observe
any of the provisions or covenants of this Agreement, the losing
party shall pay to the prevailing party reasonable attorney's fees
as ordered by the Court.
10. Contractor shall comply with any applicable state laws
concerning wage and hour, and safety requirements, including but
limited to paying all employees a minimum hourly wage pursuant to
ORS ch. 653; paying to the Department of Revenue all sums withheld
from employees' wages pursuant to ORS 316.167; and paying all
contributions or amounts due its worker's compensation carrier for
any and all personnel used in performance of this contract.
11. Contractor recognizes the mandatory standards and policies
relating to energy efficiency which are contained in the State
Energy Conservation Plan issued in compliance with the Energy
Policy and Conservation Act (P.L. 94-165).
12. Contractor shall allow City, SHPO, Department of Interior,
National Park Service, the Comptroller General of the United
States and any duly authorized representatives of these agencies,
access to all books, documents, papers and records which are
directly pertinent to the specific contract for the purposes of
making audit, examinations, excerpts and transcriptions.
Contractor shall maintain such records for three years after final
payment on this project.
13. Contractor agrees to comply with all applicable requirements
of federal and state civil rights and rehabilitation statute,
rules and regulations, including the Civil Rights Act of 1964
(particularly Title VI) and the Vocational Rehabilitation Act of
1973 (particularly Section 504), as these Acts are amended or
otherwise supplemented.

14. The parties acknowledge that the U.S. Department of the
Interior, National Park Service, shall be credited as the source
of federal match funds on this project, and has the right to any
materials which might be copyrighted or patented arising out of
the project.
15. It is expressly understood that this Contract shall be
governed by the laws of the State of Oregon.
16. Contractor shall promptly, as due, make payment of all just
debts, dues, demands and obligations incurred in the performance
of said Contract and shall not permit any lien or claim to be
filed or prosecuted against the City or SHPO.
17. Non Waiver
Any waiver or any breach of covenants herein contained to be
performed by Contractor shall not be considered as a continuing
waiver and shall not operate to prevent the City from declaring a
forfeiture of any succeeding breach, either of the same condition
or covenant or otherwise.
IN WITNESS WHEREOF, the parties hereto have set their hands and
affixed their seals as of the day and year first above written.

CITY OF ASHLAND
ARCHAEOLOGICAL SURVEY
REQUEST FOR PROPOSAL
The City of Ashland, Oregon requests proposals to provide
professional, archaeological services for a project related to two
pieces of property owned by the City of Ashland which have
historical and pre-historical significance to the local area.
The purposes of the project are:
1. To provide the State Historic Preservation Office with a
completed form on each site for inclusion in the
Statewide Inventory of Historic Properties.
2. To comply with LCDC Statewide Planning Goal 5 pertaining
to the identification of cultural resources.
3. To prepare a document which will help in understanding
the history of the area, and the impact of the persons
who inhabited the sites on the history of Ashland.
4. To survey areas which have not been systematically
surveyed.
It is anticipated that a professional consultant will be
retained and that the archaeological survey will be conducted

Historic Preservation Fund Agreement No. 8714.
Work shall commence immediately upon selection of the
consultant and shall be completed by July 31, 1988.
The total cost of professional services shall not exceed
$2,750.00.
The proposal shall contain the following information:
1. A statement of the problem in the respondent's own words
- The statement should include an outline of the
objectives and scope of the proposed project.
2. Project background - The respondent's understanding of
the history of the project or problem, organizational
relationships, and limiting factors.
3. Project product to be delivered - A clear statement of
the services to be performed, the form they will take,
and what the final product and/or end result will be.

4. Statement of Work - A concise outline delineating the
specific tasks to be performed indicating what will be
done, in what sequence, by whom. The statement of work
should include a schedule which clearly indicates how
long each task will require, when meetings, seminars, or
workshops will be held, and when products or reports are
due.
5. Management plan - A description of the respondent's
organizational framework, production capabilities,
special resources or equipment, and any other
information to demonstrate that the respondent can
effectively and efficiently deliver the project product.
6. Qualifications and prior experience of the project
consultant, team or firm - including resumes on each
person involved in the project and verifiable
references.
7. Cost proposal - An offer to undertake the project as
proposed at a quoted price. The cost proposal must be
sealed separately from the rest of the proposal.
8. Schedule of activities - A chart designed to illustrate
who will perform what duties when and how much each
portion of the project will cost.
Criteria by which the contractor will be selected is as
follows:
1. Understanding the problem (20 points) - The respondent's
understanding of the proposal and scope of the project,
as well as the organizational framework, geographic
area, and/or other context in which it is to be
conducted will be assessed. Respondent's proposals must
contain a clear description of the project product.
2. Technical approach (30 points) - Proposals will be
evaluated to assess the approach that will be applied to
accomplish the objectives set forth in the statement of
work. This statement of approach must clearly outline
the specific procedures, methods of evaluation, and
other technical processes that will be applied to the
project.

3. Staff capability (30 points) - The technical training,
experience, and skills of all proposed project staff
will be evaluated. In the case of a consulting firm, it
will be necessary to determine who is actually doing the
work. If you wish to ensure that the principal partners
are going to perform the work you must state this in
your selection criteria and in your Request for
Proposal.
4. Management capability (20 points) - The organizational
framework, proposed time-lines, and means of producing
the project product will be evaluated.
Proposals must be received no later than 5:00 P.M., June 26,
1987, at the Office of the Director of Public Works. Additional

This agreement is made this 11- day of !vl ~ ' 19i1, by and between
the State of Oregon, by and through its Historic Preservation Officer, Parks
and Recreation Division, Department of Transportation, hereinafter referred to
as State, and the City of Ashland, herein referred to as Proponent.
WHEREAS, the State Historic Preservation Office (SHPO) is charged with the
responsibility of survey and planning with regard to cultural resources in
Oregon under the program authorized by the National Historic Preservation Act
of 1966, 16 USC s. 470; and
WHEREAS, the State Parks Administrator has been designated by the Governor
as the State Historic Preservation Officer with authority to direct the
program of maintaining the Statewide Inventory of Historic Properties,
nominating properties to the National Register of Historic Places, and
applying to the Department of the Interior for federal grants for historic
preservation acquisitions and development; and
WHEREAS, the SHPO has insufficient staff to adequately carry out the
survey and inventory responsibilities under the National Historic Preservation
Act of 1966, but has been allocated federal matching funds to fulfill the
surveying, planning and nomination responsibilities authorized by the National
Historic Preservation Act of 1966; and
WHEREAS, the Oregon Department of Land Conservation and Development
requires identification and protection of cultural resources under Goal 5 for
the development of local comprehensive plans;
NOW, THEREFORE, it is agreed between the parties as follows:
PROPONENT AGREES:
1. Proponent shall conduct an archeological survey. Except as otherwise
specifically provided, all documents, reports, and material required by
this agreement to be submitted, must be submitted to SHPO on or before
August 31, 1988.
a. The basic survey area shall consist of an archeological survey of the
Winburn site and the Lithia Springs site, as described in at page 2
paragraph 3 and page 3, paragraph 2, respectively, in Exhibit A, which is
attached and incorporated in its entirety by this reference.
b. The survey and inventory effort carried out under terms of this
agreement shall include prehistoric archeological sites.
c. Proponent shall supply professional credentials of the principal
project supervisor and the project coordinator/consultant(s) chiefly
responsible for evaluating survey data to produce the inventory. Written
approval shall be obtained from the State Historic Preservation Office
prior to hiring of project coordinator/consultant(s}. The project
coordinator/consultant(s) shall meet professional qualification standards
contained in the Secretary of the Interior's Guidelines for Historic
Preservation Projects. (Federal Register, Vol. 48, No. 190, September 29,
1983, pp. 44738 and 44739.)
d. Proponent shall supply written quarterly progress reports on or
before Mqy 31, August 31, 'November 31, and February 28. If the effective
date of the agreement is 30 days or less prior to the due date of a
quarterly progress report, the proponent may submit the report by the next
quarterly deadline. State shall provide the progress report format and
shall review the progress report to determine whether Proponent is
adequately performing the provisions of this agreement. Any changes to
the scope of work which Proponent wishes to propose based on Proponent's
experience during the prior quarter of the project shall be requested at
this time.
e. Proponent shall submit a quarterly billing concurrent with each
quarterly progress report. Proponent shall have a grace period not to
exceed five working days after the quarterly due date for submittal of the
progress report and billing. If the billing is not received within said
grace period, ten percent of the billing amount shall be withheld until
such time as the final billing is processed.
f. Proponent shall supply copies of completed site forms and maps
showing site location at U.S.G.S. quad quality or better.
g. Proponent shall supply summary report of project including synthesis
of any data on settlement patterns, cultural ecology, culture history and
chronology that results from this survey.
h. Proponent shall supply three copies of all reports and manuscripts,
and at least one copy of theses and dissertations that result from this
work.
i. Proponent shall submit to State as part of the final work product
under terms of this agreement, detailed documentation of Proponent's total
material and labor expenditures in carrying out the work of the project.

2. Proponent agrees that Exhibit A, which is attached and incorporated by
reference, describes Proponent's duties under this agreement with respect
to the scope of the project, project procedures and budget under this
agreement. Any changes or modifications to the scope, procedures or
budget of the project as outlined in Exhibit A and attachments thereto,
shall require written approval of the State Historic Preservation Office.
3. Proponent agrees to revise any final product, described at page 6 in
Exhibit A, at no cost to the State, should the State find the product does
not fulfill the terms of the Agreement.
4. Proponent shall not be compensated for work performed under this contract
from any other department of the State of Oregon.
5. Proponent agrees to comply with the requirements of the Civil Rights Act
of 1964 and the Vocational Rehabilitation Act of 1973.
6. Proponent agrees that the National Park Service, U.S. Department of the
Interior, shall be credited as the source of federal match-fund assistance
in any published version of the cultural resource inventory produced under
terms of this agreement.
7. Proponent shall provide access, at reasonable times, to its books, records
and documents which pertain to this agreement, for and it purposes as may
be required by State and Federal government regulations.
8. Proponent shall not subcontract any of the work required under this
agreement without the written approval of State.
9. Proponent will be responsible for any federal or state taxes applicable to
payments under this agreement.
10. Proponent certifies that it is not currently employed by the Federal
Government or the State of Oregon.
11. Proponent is not an officer, employe, or agent of the State as those terms
are used in ORS 30.265.
12. Proponent shall defend, save, and hold harmless the State of Oregon and
the Department of Transportation, Parks and Recreation Division, its
officers, agents, employes and members, from all claims, suits or actions
of whatsoever nature resulting from or arising out of the activities of
the Proponent or its Contractors, agents or employes under this agreement.
13. Proponent agrees that no part of the money appropriated by any enactment
of Congress shall, in the absence of express authorization by Congress, be
used directly or indirectly to pay for any personal service,
advertisement, telegram, telephone, letter, printed or written matter, or
other device, intended or designed to influence in any manner a Member of

Congress~ to favor or oppose~ by vote or otherwise~ any legislation or
appropriation by Congress, whether before or after the introduction of any
bill or resolution proposing such legislation or appropriation; but this
shall not prevent officers or employees of the United States or its
Departments or agencies from communicating to Members of Congress at the
request of any Member, or to Congress through the proper official
channels, requests for legislation or appropriations which they deem
necessary for the efficient conduct of the pUblic business.
STATE AGREES:
1. State shall reimburse the Proponent for up to 50 percent of the costs
incurred by Proponent in conducting the work as outlined in this agreement
and producing the reports, but State's total monetary obligation to
Proponent shall not exceed $2,750. State shall only reimburse Proponent
for agreement costs incurred between the time period of March 27, 1987, or
the date the agreement is executed by both parties, whichever is later,
through August 31, 1988. Reimbursement costs shall include all materials,
labor and travel reasonably incurred in the conduct of the project.
Travel costs will be reimbursed at State rates.
2. State shall bill National Park Service, Department of the Interior, within
ninety days of receipt of a satisfactory report and cost statement. State
at its opti on may parti ally reimburse the Proponent for Proponent's
general cost prior to completion of the project. State shall in any case
retain 10 percent or $270.00 of the State's total monetary obligation to
Proponent until receipt of all approved final work products.
State certifies at the time the contract is written that sufficient funds
are available and authorized for expenditure to finance costs of this
contract within State's current appropriation of limitation.
TERMINATION:
This contract may be terminated by mutual consent of both parties, or
by either party upon a 30-day notice in writing, and delivered by
certified mail, or in person.
State may terminate this contract effective upon delivery of written
notice to the Proponent, or at such later date as may be established by
the State~ under any of the following conditions:

a. If State funding from federal, state or other sources is not obtained
and continued at levels sufficient to allow for purchase of the indicated
quantity of services. When possible, and when agreed upon, the contract
may be modified to accommodate a reduction in funds.
b. If federal or state regulations or guidelines are modified or changed
in such a way that the services are no longer allowable or appropriate for
purchase under this contract.
c. If any license or certificate required by law or regulation to be
held by the Proponent to provide the services required by this contract is
for any reason denied, revoked or not renewed.
Any such termination of this contract shall be without prejudice to
any obligations or liabilities of either party already accrued prior to
such termination.
State, by written notice of default (including breach of contract) to
the Proponent, may terminate the whole or any part of this agreement, if:
a. The Proponent fails to provide services called for by this contract
within the time specified herein or any extension thereof; or
b. The Proponent fails to perform any of the other provisions of this
contract, or so fails to pursue the work as to endanger performance of
this contract in accordance with its terms, and after receipt of written
notice from State, fails to correct such failures within ten days or such
a longer period as the State may authorize.
SI GNATURES:
The Oregon Transportation Commission, by a duly adopted delegation
order (OTC Delegation Order No. 26, paragraph 2), authorized the
Administrator of the State Parks and Recreation Division to act in its
behalf in approving and executing this agreement.
Pursuant to ORS 358.565 and 358.605 and Oregon Transportation
Commission Delegation Order No. 26, paragraph 2, this agreement has been
approved by the State Parks Administrator/State Historic Preservation
Officer, and pursuant to a subdelegation order, dated March 23, 1984, the
Manager, Parks History Unit/Deputy State Historic Preservation Officer has
been authorized to execute this agreement on behalf of the State of
Oregon, Department of Transportation, Parks and Recreation Division and
the State Historic Preservation Officer.

THIS AGREEt-ENT CONSTITUTES THE ENTIRE AGREEt-ENT BETWEEN THE PARTIES.
NO WAIVER, CONSENT, MODIFICATION OR CHANG: OF TERMS OF THIS AGREEMENT SHALL

1. ACCOUNTING PROCEDURES
In any program where reimbursement is requested for a portion of project
costs, adequate records are essential. There should be definite
supporting evidence for EACH item of cost claimed--estimates are not
sufficient.
In order to promote a better understanding of the records required and to
avoid the possibility of having costs disallowed at the time of audit,
the following accounting procedures are suggested for all SHPO grants:
General
A separate account should be established for each approved project. The
ledger sheet, IBM cards or tape should include the project number and
name. It should be maintained in such a manner (e.g.. separate columns
on a ledger sheet) that payment for salaries, contracts, equipment
rental, supplies and other items listed on the attached Agency Billing
Form can be accumulated separately.
Each entry in the account must be cross-referenced to a voucher, payroll
invoiCe or other supporting document. Each payment must be supported by
a cancelled check or warrant.
A. Salariesand'Wages
1) Payrolls should be signed by an authorized official and wages
paid should be supported by time and attendance records for
each employee.
a) Time and Attendance Records (daily, weekly, or monthly)
should show total daily hours for all projects and
description of work performed. A system which reports
only hours applicable to the SHPO grant is not acceptable..
2) Time distribution records are not required for employees whose
entire time is chargeable to the grant project.
3) Fringe benefit rates should be developed using actual
historical costs, and individual components should be
identified. Documentation should show how rate or cost was
derived. This amount must be traceable through the
subgrantee I s records.
4) Provide SHPO with a copy of the consultant contract with the
subgrantee. Work performed by consultant must be consistent
with the provision of the state1s contract with the subgrantee.
5) Payments made by the subgrantee shaul d be supported by a
statement or invoice from the contractor (or the project
architect or engineer). The document must identify the project
and the service performed. It must also indicate the time
period in which the service was performed. (Remember that NPS
contracts that exceed $10.000 must be advertised for bid.)

B. Consultant Services
Proper consultant selection procedures must be followed and proper
documentation maintained for audit. For consultant selection
guidelines, refer to Grant Application Manual, Section 8.
1) Payments made by the subgrantee should be supported by a
statement or invoice from the consultant. The consultant hours
do not need to be broken down, since the consultant agreement
should state a total contracted amount.
2) Payments made by the project sponsor m~ be for per diem,
salary, fee or service and m~ include payment for the travel
or other services.
3) Payments made to the consultant may be for per diem, salary,
fee or service and may include payment for the travel or other
services.
4) A cost-plus-a-percentage of costs payment is not allowable
under federal regul ati ons.
c. Travel
1) Federal guidelines require that all mileage rates do not exceed
the current standard federal rate of .205 cents per mile.
2) A copy of reimbursement request must show name of individual,
mileage (odometer readings or locations) and purpose.
3) A copy of motel receipts must be maintained.
4) Reimbursement requests must show name of individual; time of
departure and return; dates; and meals claimed. Current State
of Oregon rates are: Breakfast = $4; Lunch = $4.50; Dinner =
$10.
D. Equi pment- Rental' (Owned)
Equipment rental cost (for owned equipment) should be supported by
time records and by a schedule of hourly rates developed from actual
historical,costs, or in the event no previous cost data exists, from
reasonable estimates of such factors as useful life, annual hours or
use, insurance premiums, etc. These estimated rates must be
adjusted each year based on the previous year's actual costs. The
State has developed a tabul ati on type form that may be used for thi s
purpose; copies are available from State Parks.
E. Equipment Rental (Outside)
Payments made by the project sponsor for equipment rented for
specific project area generally allowable under federal
regulations. Payments made by the project sponsor must be supported
by a statement or invoice from the vendor that indicates the time
period the equipment was rented.

F. Materials and Supplies
Supplies and materials charged to the project must be supported by
purchase orders and supplier1s invoices if purchased for a specific
project, or by approved requisi ti ons or simil ar documents if issued
from stock; unit prices for stock issues should be traceable to
actual invoices and/or other historic cost data. A photocopy of the
cancelled checks must be provide in final billing.
G. Motor Pool (Equipment)
1) The billing form must relay the following:
(a) Equipment number
(b) Mileage or hour
(c) Rate charged
H. I ndi rect Costs
Indirect costs are those incurred for a common or joint purpose
benefitting more than one cost objective and not attributable to one
particular project. These types of costs are allowable if the
subgrantee is recognized by a cognizant federal agency (primary
source of federa1 funds). Recognition is obtained by submitting a
Cost Allocation Plan. Many larger governmental agencies already
maintain a Cost Allocation Plan and may use the existing plan.
Smaller governmental agencies and non-profits may find that the
process is not cost effective for the total dollar amount attributed
to indirect costs. If interested, procedures are found in OASC-10,
which is made available upon request from SHPO.

J. Valuation ofIn~Kind'Contributions fromNon~FederalThird'Parties
The value of labor, materials. equipment usage, etc., donated by
sources outside the agency may be included only if fully documented
in the project application and approved in advance by the State
Historic Preservation Office. The subgrantee should use the forms
provided for this purpose by the SHPO. The unit value of all
donations must be approved by State Parks as part of the proposed
budget pri or to the acceptance of the donati on by the proj ect
sponsor.
1) Valuation of volunteer services -- Volunteer services may be
furnished by professional and technical personnel, consul tants,
and other Skilled and unSkilled labor. Volunteered services
may be counted as matching share if they are an integral and
necessary part of an approved program. However, because this
benefit has been abused occasionally in the past, donated
values are reviewed with particular care by state and federal
auditors. and complete and meticulous records are absolutely
essenti a 1 .

Required Documentationfor'Volunteer'Services -- All volunteer
services claimed as non federal share must be substantiated by
time cards or records that are signed by both the volunteer and
his supervisor, as required for all other employees. Such
records. must show 'the' actual' hours. worked and. the. speCfffc
dutlesperformed. Ihe records should also indicate the basis
for determining the rate of the volunteer's contributions, and
such documentation must be available for audit.
A packet of forms is available for use by proponents who
anticipate donated values to projects. The forms are, for the
most part, self-explanatory. The Donated Labor forms are
weekly time sheets which must be signed by both the person
donating the time and a supervisor. Proponents should keep
copies of the completed forms, and additional blank forms may
be reproduced locally as necessary. The cost of reproduction
may be included in the reimbursable project cost. The State
Historic Preservation Office will not process requests for
reimbursement containing donated values unless donated value
documentation is complete.
2) Rates for volunteer services
(a) Rates for volunteer services must be consistent with those
regular rates paid for similar work in other activities of
the state government, not to exceed the GS-18 federal
employee salary range. In those instances in which the
skills required for the Historic Preservation
Fund-assisted work are not found in the state government,
rates used must be consistent with those paid for similar
work in the labor market in which the grantee competes for
the kind of services involved. For example, if a
carpenter or bookkeeper donates carpentry or bookkeeping
services to the project, these services may be valued at
the hourly rate the carpenter or bookkeeper would normally
charge. In such cases the donor must sign a brief
statement which notes the donor's usual occupation, social
security number, intent to donate usual occupational
services, and the date. These statements are then sent to
the State Historic Preservation Office for approval before
they are included in requests for reimbursement.
(b) If a volunteer performs services outside his profession or
trade, this volunteer time must be valued at the federal
minimum wage rate unless a higher rate can be documented
as applicable and is approved by the SHPO. All such rates
are subj ect to Nati ona 1 Park Servi ce and SHPO fi el d and
audit review.
3. Volunteers employed by other organizations -- When an employer
other than the grantee or a unlversity furnishes the services
of an employee, these services will be valued at the employee's
regular rate of pay (exclusive of fringe benefits and overhead
cost) provided these services are in the same skill for which
the employee is normally paid.

Donated Professional Services -- When professional services, such as
architectural services, are donated to a project, the professional
simply marks an invoice for professional services "donated" and
signs it.

2. QUARTERLY BILLINGS AND REPORTS
A. CompulsoryProgress'Report'andBillingDates
Compulsory progress reports and billing due dates are scheduled for
November 31, Febrary 28, May 31, and August 31. These dates must be
adhered to, unl ess the grant is awarded_,30 days or 1 ess pri or to the
due date of a quarterly progress report. The grantee then may
disregard the pending report and submit the next report and billing,.
when due.
1} The August 31st due date will either consist of a final report
and billing or a progress report and partial billing, if your
project proceeds into the next funding year by means of a
second phase.
2} The due dates incorporate a grace period of five working days.
If the billing and report are not received on or before the end
of this grace period, ten percent of the billing will be
withheld until the final billing at the completion of the
project.
B. Completing the Progress Report
The form should be self-explanatory. Keep in mind that we do not
intend this to be a time-consuming procedure. Keep it brief, to the
point. The main intent is to make everyone stop, assess the
progress of their project and identify any problems before they
become insurmountable.

3. IN-FIELD MONITORING
Expect to receive approximately two or more site inspections involving
both the project coordinator and/or persons conducting the work.
Typically, the meeting might consist of a visit to the project area; a
review of the boundaries, concentrations or types of resources,
discussion of the progress of the project, or attendance at a public
hearing or meeting.

Project Proponent
The project proponent is the City of Ashland, 20 East Main
Street, Ashland, Oregon.
Project Personnel
Project Supervisor:
The Project Supervisor is Allen A. Alsing, P.E., Director of
Public Works and City Engineer, City of Ashland, Oregon.
Project Coordinator:
Since there is no one on staff with previous cultural resource
survey experience or equivalent educational background, this
position will be combined with that of the consultant.
Consultant:
A consultant will be retained by the City of Ashland through a
selection process utilizing proposals and a selection
committee.
Other Personnel:
City engineering and secretarial personnel will participate in
the project in the following tasks:
1. Surveying, plotting and documenting.
2. Preparation of access to Winburn property.
3. Graphics.
4. Preparation of proposals and selection of consultant.
5. Archival research.

Project Timeline:
Selection of a consultant will be initiated within 30 days of
notification of grant award, and will be completed within an
additional six weeks. The project will commence within the
following eight weeks and will be completed within 12 months
but no later than Sept. 30, 1987.
Project Scope
The project is an archeological survey and consists of work at
two locations: (1) The Winburn Site, and (2) The Lithia
Springs Site (both of which are outside of the Urban Growth
Boundary) .
(1) The Winburn Site:
The Winburn Site is located on a 160-acre parcel of land
owned by the City of Ashland within, and surrounded by, the
Ashland Watershed, a 12,000-acre area owned by the U.s.
Forest Service. The site is named for Jesse Winburn, a
philanthropist who gave much to the City of Ashland during
the 1920's.
Mr. Winburn lived at the site for a few years and
constructed a complex of log buildings consisting of a
house, barn, and outbuildings. The improvements also
included a swimming pool. The buildings are now gone but
there are many photographs available. The land was
eventually purchased by the City of Ashland, not only to
clear the watershed of its only inhabitant, but to provide
a City-owned site for a future water supply reservoir. The

site is of historical significance because it was Mr.
Winburn's principal residence while living in the Ashland
area, and he figured prominently in Ashland's early
history. Winburn purchased the local hospital, spent
$30,000 to remodel it and gave it to the City. He
completed the construction of the Women's Civic Club
building, added a $5,000 organ and donated it to the City.
He also spent money to improve Lithia Park and to promote
his dream of making Ashland a resort city built upon the
idea of a mineral water health spa. A city street was
ultimately named in his honor.
Since the site is at the confluence of Weasel Creek and
Ashland Creek, and includes one of the few meadows in the
watershed, there is a strong suspicion that native
Americans previously occupied the site on a seasonal basis.
(2) The Lithia Springs Site
The Lithia Springs Site is a 66-acre parcel located on
Emigrant Creek (Bear Creek). It is owned by the City of
Ashland and is the location of the Lithia Springs well
field which produces a naturally-carbonated mineral water.
The site and the water it produces figures prominently in
Ashland's history in that the City's inhabitants passed a
rather large bond issue in the early 1900's to develop the
Springs and pipe the water into the City in an effort to
establish Ashland as a spa area similar to those found in
great favor in Europe at that time.

The Springs site was a favorite picnic area in the early
1900's. In the 1940's, the area was developed with facili-
ties for producing dry ice from the COzin the Lithia water.
This enterprise faded in the 1950's when refrigeration
became commonplace.
It is known that native Americans have occupied this site
because arrowheads, spearheads, and other artifacts have
been previously found at this location.
It has also been mentioned by early residents of the valley
that the Lithia Springs site was utilized by various tribes
of native Americans for the therapeutic value of the
mineral waters and that the area was considered a "Kings-X"
area of no weapons.
Project Cost
It is estimated that the total cost of the project will be
$5500.00. This grant request is for 70% of the project cost or
$3850.00.
The City of Ashland's 30% match is outlined in the attached
budget. It is anticipated that the City's contribution will be
in the form of in-kind services in the areas of surveying,
drafting, documenting, access preparation, graphics,
preparation of proposals, and consultant selection.
In the event that these duties do not satisfy the necessary
dollar amount, the City of Ashland is prepared to make up the
difference with cash.

It is anticipated that the City will disperse all funds as work
progresses and will request reimbursement from the State
Historic Preservation Office on a monthly basis or upon
completion of the project, or final audit, whichever meets the
present policy. All funds will be accounted for and records
kept by the City Finance Department. Payment to the consultant
will be made according to the developed contract and the City's
share will be calculated according to actual time spent, actual
wage rate, plus overhead.
The City Finance Department has administered many grants over
the years and is available for discussion of procedures at your
convenience.
Potential Project Objectives
1. To provide the State Historic Preservation Office with a
completed form on each site for inclusion in the Statewide
Inventory of Historic Properties.
2. To comply with LCDC Statewide Planning GoalS pertaining to
the identification of cultural resources.
3. To address issues of significance to an EIS for the Federal
Energy Regulatory Commission should the Winburn Site be
developed for a reservoir in the future.
4. To prepare a document which will help in understanding the
history of the area, and the impact of the persons who
inhabited the sites, on the history of Ashland.

At both sites the properties are associated with past events
and activities which have contributed significantly to the
City's history.
The only persons to occupy the Winburn site were native
Americans and Jesse Winburn. The occupancy of each did not
overlap. The site is the place most importantly associated
with Mr. Winburn who played a very significant part in local
history. The occupancy of the Lithia Springs property is of a
different nature and not as clean of that of the Winburn site.
Although the occupancy is well known, it is more accessible to
the public and the archeological remnants are not as clearly
defined timewise.
Project Methodology and Procedure
The project will proceed as follows:
1. Preparation of Grant Request.
2. Availability of Project Supervisor for questions by the
State Historic Preservation Office.
3. Award of the Grant.
4. Preparation of the Request for Proposal.
5. Formation of a Selection Committee.
6. Consultant interviews.
7. Selection of Consultant.
8. Consultation with Consultant regarding project scope, time-
line, and expected final product.
9. Work projects including field and office work to the extent
that the archeological survey will be conducted according
to recognized professional standards and will meet the
Project Objectives noted above.

10. Compilation of work product into a suitable report and
preparation of Statewide Inventory Sheets.
11. Submittal of project products to the State Historic
Preservation Office.
12. Final payment to Consultant.
13. Final audit.
14. Final billing to State Historic Preservation Office if
appropriate.
Final Product
The final product will consist of:
1. Inventory sheets for each site suitable for inclusion in
the Statewide Inventory of Historic Properties.
2. A document suitable to address issues of significance to an
EIS for the Federal Energy Regulatory Commission should the
Winburn Site be developed for a reservoir in the future.
3. A document which will comply with LCDC Statewide Planning
Goal 5 pertaining to the identification of cultural
resources.
4. A document which will help in understanding the history of

Dear Mr. Alsing:
I assume the urban growth boundaries woul d be the area of concern.
Man-made features such as roads, parking lots, housing, heavy urban
areas and similar construction tend to make prehistoric survey
difficult to impossible. You should have a firm concept of what you
want in terms of areas to be surveyed. Archeology can be both
prehistoric and historic: so define your limits. Archeological
survey work is relatively labor intensive, as the only way to find
sites is to walk over the ground where the ground is visible. As I
have ITEntioned, paving or heavy vegetation can make surveying next
to impossible. At times, surveying can be done under these
conditions, but digging holes every so often or clearing vegetation
at regular intervals, can be very costly.
Some areas are rrore likely to contain sites then others. Local
prehistoric land use patterns may be reconstructed from ethnographic
research. Finding site patterns in existing data helps to define
these patterns also. Important resources such as oak forest
(acorns), camas flats, or stone quarries attracted prehistoric
people. Quite often the winter village sites were along river
terraces just above the average flood plain.
Our office has some unrecorded site data near Ashland. Sites should
be expected all along the terraces of Bear Creek and its tributaries
and near springs and seeps.
Another major element is permission to enter private lands to
perform the survey. It has been our experience in the past that
about 40 percent of the owners will respond to entry requests. We
have discovered that preh istoric survey requires that pre-survey
permission should be done before the grant request. It helps to
define the size of the survey involved. We have also discovered
that this kind of activity (permission requests) is suited to the
city government as they can qui ckly discover the 1 an downers and send

out cards requesting permission. Archeological surveys are not like
windshield historic building surveys. It is obvious when teams of
people are walk ing over agricul tural fiel ds.
The best window for archeological site visibility is the freshly
tilled field after a rain storm. The majority of archeological
sites in the lower elevations are found just this way. Enclosed is

RESEARCH DESIGNS
INTRODUCTION
A research design should cover the whole planning and investigation
sequence from the initial statement of problem, through general assump-
tions, to operational statements. Specific procedures to be used should
be described and the steps of data recovery and analysis should be ex-
plained and justified in terms of the stated aims and theoretical orien-
tation of the study. It must be recognized that predictability of re-
search results is limited, and any investigator should always have the
flexibility to modify and revise the research design. The research de-
sign for a data recovery project conducted under the authority of the
Archeological and Historic Preservation Act should insure the recovery of
those data whose existence or predicted existence makes the property eli-
gible for inclusion in the National Register. Also, research designs of
different level of detail and complexity will be appropriate to different
types of projects.
PURPOSES OF A RESEARCH DESIGN.
(1) To provide the research with a vehicle to express and to develop
explicitly the rationale behind the proposed research, giving the theo-
retical orientation, justification for problem selection, logic, specific
criteria or archeological significance, and procedures for the research
strategy.
(2) To define the universe of study and realistic minimal expecta-
tions of research.
(3) To permit the sponsor and professional reviewers to identify and
assess the reasoning and validity of the design in the perspective of
current professional capabilities and standards.
(4) To provide a realistic, logically developed, and adequate
schedule of research.
(5) To provide for the productive. efficient and justifiable recovery
of archeological data.
(6) To permit comparison of the proposed research with actual accom-
plishments and reduce the discrepancies between research expectations and
results by coordinating research goals with procedures.

ELEMENTS OF A RESEARCH DESIGN
(1) The basic archeological and anthropological perspective governing
research formulations. This should include, minimally, the purpose and
reasons for the research, underlying assumptions, and the theoretical
organizational, and methodological base of the approach. Explain why
these. perspectives and emphases are applied, and in particular, why they
apply to the research project proposed.
(2) The environmental, archeological, and relevant ethnographic or
ethnohistoric content of the project area. Include, where obtainable,
period of occupation, cultural affiliation, and the relationship and sig-
nificance of the project area to environmental and cultural regions of
which it is a part. If there are serious deficiencies in the knowledge
of the area relative to these concerns, these should also be identified.
(3) Research goals and their rationale. Based on information devel-
oped in 2, this section should develop in detail the questions to be an-
swered or hypotheses to be tested and their test implications, the appli-
cabi 1 ity of these hypotheses in the project area, and the reasons for
selection of the research goals.
(4) Research strategy, schedule, and priority. This should include
discussion of the following, and a statement of their relationship to re-
search goals:
(a) For survey, identification of environmental situations and cate-
gories of cultural data to be sampled.
(b) For excavation, identification of sites, or groups of sites or
other resources to be studied.
(c) Reasons for selection of locations, sites, or other variables to
be sampled.
(d) Sample size and sampling procedure for (1) selection of sites,
and (2) data recovery within site.
(e) Project implementation techniques and their relevance to the aims
and purposes of the study.
(f) Data recovery techniques to be used and their relevance to aims
and purposes of the project.
(g) Analysis procedures to be used and their relevance to aims and
purposes of the project.
(h) Plans for dissemination of research results.

RESEARCH PROPOSALS
A research proposal is written in response to a request by a sponsor as to
whether a prospective contractor can perform a particular service, i.e., do
the research necessary to provide needed information on cultural resources or
with respect to a particular project. The proposal will vary in content
depending upon the project, the contracting agency, and the contractor.
However, the following items of information normally should be included or
considered for inclusion.
Elements of a Typical Research Proposal
1. Name and address of individual or institutional proposer; and of
principal investigator.
2. Brief summary of status of information on cultural resources in
project area.
3. Research proposed to provide information requested by scope of work,
e.g., reconnaissance survey, intensive field study with testing;
provides enough detail to give peers an ability to judge whether a
sponsor's needs will be met, and to provide sponsors with
justification for budgeted items; include a statement on the
mechanism whereby the research design will be drafted and approved
prior to initiation of the field research.
4. Qualification of principal investigator, and other major professional
personnel contributing to the project. Vitae are appropriate.
5. Specifically indicate where materials and records are to be housed,
and who is responible for curation.
6. Time frame including in the field, and date of submission of draft
and of final report.
7. Budget estimate. The particular entries noted below are one
frequently occurring in and appropriate to such budgets. However,
institutions and agencies will vary as to how various costs are
categorized and which are to be included. The following is intended
simply as a general guide:

each will devote to the project).

purchase of permanent equipment such as cameras, vehicles, or transits but
small items of nonexpendible equipment are appropriate, such as wheel
barrows, or soil augers, or machetes.)
Specialized studies (C14 dates, pollen or soil analysis, faunal, floral
analyses, dendro, etc. If specific individuals are to be employed by the
contractor for this, the salaries should be under that category.)
Rental of equipment (normally is listed separately and can include rented
vehicles, generators, backhoes, etc.)
Preparation of Report (this can include preparation of special
illustrations and drafting, and should include cost of reproduction and
distribution of an adequate number of copies to the scientific community
and other directly concerned audiences. Typing time, if extensive, could
be included under salaries/wages.)
8. Other specific information may be requested, e.g., whether other
contracts have been awarded within the past few years, and the
reporting record of the institution and principal investigator(s).
