1968-13 Lease - Parks & Rec
LEASE THIS LEASE, made and entered into in duplicate this ~/ ~ day of May, 1968, by and between the CITY OF ASHLAND, a municipal corporation of the State of Oregon, hereinafter known and desig- nated as the Lessor, and the ASHLAND PARK AND RECREATION! COMMISSION, herinafter known and designated as the Lessee, WITNESSETH: I. i The Lessor does hereby rent and lease unto the Lessee, subject to the terms and conditions as hereinafter stated, that certain property consisting of approximately sixty-six (66) acres known as the "Lithia Springs Tract", which property is described on Exhibit "A" attached hereto and by this reference made a part hereof. II. That said lease shall be for the consideration of One Dollar ($i.00) per year payable on or before the 1st day of June of each year and said lease shall be for a period of five (5) years com- mencing with the 1st day of June, 1968. ~ III. It is agreed that the Lessor is hereby reserving the following rights .- (a) Said lease shall not include the Lithia SPrings water or water facilities including existing and ne~w lines which the City shall have the right to install at such places as it deems advisable. (b) Any restoration of facilities, such as Pompadour Springs, must first have the approval of the Common Council. -1- (C) The City shall have the right to approve any sanitary facilities that Lessee contemplates installing. (d) The Lessor reserves the right to remove any rock or gravel from said premises. It is agreed tha~ no rock or gravel shall be removed except upon approval of the Common Council after receiving the recommendation fr~m the Lessee as to the appropriate areas to remove rock in order to attempt to minimize any impairment of the future development of the property. IV. The Lessee shall take steps so that all cattle from adjoining premises shall be excluded from said property. V. The Lessee shall provide sufficient means for controlled access to the premises by locks on any gates to prevent vandalism. VI. The Lessee shall not assign any interest in said lease or sublease any of the premises, but shall have the right to grant licenses to third persons or organizations for the use of any portions of said premises provided that Lessee shall have l the right to revoke any of said licenses upon giving the licensee not more than sixty (60) days written notice of revocation. VII. Said premises shall be used for park and recreation purposes only, such as archery range, picnicking, camping, fishing~ group meetings and similar activities. VIII. Lessor expresses its desire that the Lessee will encourage and permit the continuance of the use of said premises by Southern Oregon College for ecology purposes if such does not conflict with other uses by the Lessee or permitted by the Lessee. -2- IX. In the event any of said premises are assessed for real prop- erty taxes, the Lessee shall be obligated to pay the same in the event such are not paid by any licensee, and shall save the Lessor harmless from any and all taxes, if any, that may be assessed against the property. X. Upon expiration of this lease or on failure to comply with any of the c©nditions of this lease within thirty (34) dalys after written notice thereof time be in of the essence Ithe g , Lessor, at its option, may terminate the same without notjice and may re-enter and take possession of said premises and. expel:. the occupants thereof without in any wise being trespasser= the failure to take possession at the time as stated aforesaid shall not, however, estop Lessor from afterward asserting its night.
