Subj: Impact of Municipal Code 10.46/Transient Statistics
The following report is in response to the City Council's request to rqceive a
report regarding the impact of recently adopted ordinances as to con~cerns
associated with the transient population: ~
Municipal Code 10.46 became effective July 6, 1995. The most notable impact
of the ordinance, other than statistical numbers, has been reported te us by
numerous downtown merchants, visitors and community members a~ their
noticing a "cleaned up" appearance in the downtown area. Also, fewer
transient vehicles are observed parking for lengthy periods on the streets.
There appears to be a slight rate of increase in transient related offe~tses, even
with the adoption of Municipal Code 10.46. We are comparing the same three
month period of time from 1994 to 1995.
Since the adoption of the ordinance, only one person has been citedi for
actually camping on public property, under the ordinance. He was Cited for
sleeping in a cemetery after being warned a week early that he coul~ not sleep
there. He admitted to the arresting officer he was aware of the prohibition but
was too tired when he got to town to find another place to sleep. He failed to
appear at his arraignment.
The area of greatest impact is that of the ordinance relating to "open container
of alcoholic beverage on public property". We issued 8 citations for! this
offense. Most of those citations were served on persons who had been cited or
warned previously.
We removed a total of six camp sites this summer. All were out of the city
watershed property. One of these campsite was an actual shed which we
believe to have been occupied for a couple of years.

PROCLAMATION
WHEREAS, the United Nations was founded at the end ~f World
War II in an effort to vanquish aggression and eliminate the sqourge of
war and to reaffirm faith in fundamental human rights and the dignity and
worth of each human being; and
WHEREAS, on October 25, 1995, the United Nations wUl celebrate
the Golden Anniversary of its existence, fifty years in which i~ has
labored to promote peace and justice in the world, including f~ing and
clothing children in developing countries; battling such deadly idiseases as
AIDS and small pox; protecting the environment; eliminating ~lliteracy
and improving education; sending troops to troubled areas of the world;
dispatching nuclear inspectors to Iraq, North Korea and other nations;
. and keeping and promoting peace in other ways.
NOW, THEREFORE, BE IT RESOLVED, that the Ashland City
Council congratulates the United Nations on its fiftieth birthday and
expresses continuing support for this organization; and .
BE IT FURTHER RESOLVED, that the Ashland City Counci~ recognize

The City of Ashland will have one volunteer position vacant on
the HISTORIC COMMISSION effective September 15, 1995.
The nine-member Commission meets monthly to review all
actions proposed within the Ashland Historic District and a
review board meets every Thursday for one-half hour to review
new building permits, exterior remodeling, new signs and
demolitions. The Commission seeks applicants who have
demonstrated interest, competence or knowledge of historic
preservation. The vacant position is for a term that will expire
on April 30, 1997. Contact Chairperson Jim Lewis at 482-1173
for further information on the Commission.
If you are interested in applying for this upcoming vacancy,
please send a letter of interest and include your resume to
Mayor Golden at City Hall, 20 East Main Street. The deadline

I am writing in response to the vacancy on the Historic Commission. I have lited in
Ashland for four years and have always admired the historic nature of the towit, in fact it is
one of the reasons my wife and I chose to live here. I am very interested in th~
preservation of historic buildings and neighborhoods, and would like to work bn the
commission. I purchased a turn of the century home myself, and spent a cou~e of years
bringing it back to its fonner glory. I have worked as an appraiser and have ~ many
properties, some vintage and some reproductions, I am familiar with construction and
have studied architectural drafting in college. I have traveled throughout the p.S. and
Europe visiting many historic cities and towns, in fact a walking tour of the tpwn is one of
my first activities. I have read "Rehab Right", "Ashland, the First Hundred )fears", along
with other books regarding historic buildings and construction. My wife and [ have both
done research work on the history of our house and some of its occupants.
I have talked to Jim Lewis, and have known Terry Skibby and Keith Chambets for some

THE COUNCIL
I believe this to be a high priority goal for coundil in '95.
This proceedure should include the following compo~ents:
a) PUBLICITY. A place in local newspapers announcing what
topiC will be up-comming for discussion in a Town Hall
Meeting, with two weeks in advance of council consideration
of this agenda item. The time, place of meeting, and the
topiC should be published in a consisent location in the
local newspapers.
b) TOWN HAll MEETINGS. The holding of town hall meetings,
open to the publiC at large, will follow the announcement and
publication in papers. These public meetings! will. be
conducted by a citizen appointed panel, and will have at
least one council member present. .
c) POllING. At the conclusion of discussion in Town Hall
Meeting of an issue of high priority to the citizen group,
the citizens present will cast a vote as to their ,preference
on the issue which will be recorded by the secretary of the
meeting, and the results of the polling forwarded to the'
Mayor and council members.
d) NEWSPAPER, AND MEDIA POllING. For those unable to attend a
town hall meeting on specifIc Issues The DailY TI~IngS' Mail
TrIbune, and K.S.O.R., and other RadIo or TelevIsI n Stations
will conduct a ehone poll, IdentIfied by calli g number,
registering the for", versus the "against" oginion of the
voters passed. In any case, after the details of Who and whom
will conduct the polls, the results will be published or
aired, as the case may be. Thus the council and ithe public
will have an indicator of what the public's preference Is
regarding the issue.
II. WASTE WATER TREATMENT PLANNING. A detailed" Icomparative
cost analysis, between the most viable options ipen to the
city in this water treatment plan must be p epared for

offIcers to set agendas, appoint sub-groups for different
issues to be consloered, and will be responsible for calling
meetIngs and forwarding recomendations to Mayor and Council.
PHILOSOPHIC PREMISE: To offer citizen- cons~dered and
researched opinions on selected city actions pending, such
as: (a) Letting of any contracts or consultant fees over
$50001 (b) To consider all pending zone changesz varlences,
and s te reviews, with names of applicants and the companies
that they are affiliated with in these requests. (c) To
integrate and exchange information with The 16 Me~ber Citizen
PlannIng and Adv 1 sorv Commi t tee ( .C1 ty Compreherisl ve Plan,

It is desired that this Public Responsibility Group will aid

My experience relative to bicycling is long and varied. For Deidy . year before my move to
Ashland I was involved with the Colorado Bike Coalition (CBC). The cac's mission was
to bring together cycling clubs. bike planners, people in the cycling indU$try, and the
general public, to bring greater exposure to, and development of, bicycJi.g as a primary
, means of ~tion throUghoUt the state of ColoradO. Among the,bQard members were
the Head Bicycle Planners from Denver and Boulder, owners/managers Qf several large
bike shops. representatives from cycling clubs, and interested individuals such as myself.

Please consider me for appointment to the commission on communication between
Ashland government and its citizens.
Some of my qualifications may be known. I have been active as chairperson for Voter
Service for our League of Women Voters. Currently, I serve on the League's S~dy Committee
on enhancing citizen involvement in local government.

We have lived in Ashland for five years and have no intention of leaving. My
interactions with the community' include participation in local neighborhood affairs in the "Quiet
Village" area, such as our concern over air quality from the Sewage Treatment Facility. In
college affairs I am active in the SOUR Program (So. Or. Learning In Retirement) at SOSC.
I am an active member of Ashland Rotary, and I am an AARP Tax Aide volunteer. In addition
I have done tutoring of adults in English and math at Rogue Community College, under the
Jackson County Literacy Coalition, for people with employment transition problems.
My interest in communication between citizens and government continues to be part of
the motivation for my League of Women Voters activity. Poor voter turnout fpr elections is a
concern to all of us who cherish viable freedom and democracy. Increasing control of media
by mega-business complexes raises questions as to possible trends affecting the availability of
objective "both-sided" news.
I have observed communication efforts both here and in other communities where I have
lived. I have been involved in these processes up and down the channels within ffiM during a
quarter century of employment there. Reflections on such observations mayor may not be
directly productive for the aims of this Ashland commission. But I believe they may at least help
stimulate thought and discussion in its deliberations.
If I can help fmd ways to enhance the sense of community among our people and our
government in the ongoing life here, it will be most satisfying.

I received a notice of approval by the Planning Commission, dated July 14,
1995. and providing for a 15 day appeal period.
I hereby appeal this decision to the City Council and request that it be
reviewed.
In my original testimony I stated the general and specific (technical/statutory)
bases for my opposition. My five minute testimony was cut off, hut I
subaitted my written text, which was copied and which should be i.in the file.
My testimony on appeal before the City Council will cover previously submitted
material, augmented by visuals.

and exhibits were presented. The Planning Commission approved the
application subject to conditions pertaining to ithe appropriate
development of the site.

SECTION 2. CONCLUSORY FINDINGS
2.1 The Planning Commission finds that it has received all
information necessary to make a decision based o~ the Staff
Report, pUblic hearinq testimony and the exhibits: received.
2.2 The Planning Commission finds that all applicable criteria for
approval found in the Performance Standards chapter 18.88 and site
Design and Use Standards chapter 18.72 have been met.
2.3 The Commission finds that pUblic facilities are available to
serve the project. city sewer, water and electric services are
located within adjacent rights-of-way and available totbeproject
site. Access to the project can be from either "A" Street at 8th
Street or from the entrance along "B" street. Both streets are
paved with curb, gutter and storm drainage facilities, with
adequate capacity to accommodate the additional vehicle trips
generated by the project.

2.4 The Commission finds that the project desi~n complies with
City design standards. While the site is not loqated within the
Historic District, the Commission finds that 'the project is
consistent wi th the character of the adjlacent Historic
neighborhood. The project concept of detached, in.ividually owned
residences is much more consistent with surroun~inq patterns of
housing in the area.
The unit adjacent to the public street are orient~d to the street
with the garage situated at the rear. Pedestrian ,access has been
provided from the front entrance to the public sid~walk. The style
and design of the units incorporates traditional design features
seen on neighboring buildings, includinq different roof styles,
lap, cottage and colonial siding, double hung win~ows, wood trim
and front porches.
SECTION 3. DECISION
3.1 Based on the record of the Public Hearing on this matter, the
Planning Commission concludes that the proposal for a 16-lot, 16-unit
multi-family subdivision is supported by evidence in t~e record.
Therefore, based on our overall conclusions, and upon the proposal being
subject to each of the following conditions, we approve Planning Action
#95-044. Further, if anyone or more of the conditions below are found
to be invalid, for any reason whatsoever, then Plannin, Action #95-044
is denied. The following are the. conditions and they are attached to the
approval:
1) That all proposals of the applicant be conditions of approval
unless otherwise modified here.
2) That the building wall of each unit, excluding porch areas, be
a minimum of 5 feet from the driveway or sidewalk, whichever is closer.
3) That a small, covered porch be incorporated on tpe front of each
residence. Porches to have a minimum dimension of 6 ~eet and minimum
area of 48 square feet.
4) That all requirements of the Ashland Fire D~artment be met
including hydrant placement and minimum flow requirements..
5) That all easements for sewer, water, electric, and streets be
indicated on the final survey plat as required by the city of Ashland.
6) That a copy of the CC&R's indicating responsibility for
maintenance of all driveways, sidewalks, parking space$ and landscaped
areas be submitted at the time of Final Plan for review and approval by
the city of Ashland.
7) That a site, size and species specific landscaping and irrigation
plan for all landscaped areas be submitted for review and approval at

8) That one street tree be installed per 30 feet of driveway length.
Trees to be installed prior to the issuance of a i certificate of
occupancy for the residence.
9) That the existing conifers identified at the r.ar of unit 5 be

shall be installed to provide a visual buffer from the adjacent
property.
10) That a neighborhood sign be installed at the "A" street entrance
to the project in accordance with the requirements of the Ashland Sign
Code 18.96.

STAfF REPORT
This proposal Is oontInued from last month. . There were several concel11S from last
month that can be found in the Staff Report. Garages will access from the private
drive. There will be a yard area for each unit. The applicant has pursued a larger rear
yard and with the exception of the bay window intruding into the space, I there will be a
10 foot rear yard. There was a letter last month from the property owner to the north
who was concerned about solar access. Both units in that area are proposed to be

single story and both comply with solar. Staff has recommended approval of the
application with 9 Conditions.
PUBUC HEARING
FRED COX, 1280 Kirk Lane, thought the requirement of porches for eaqh unit will
work. He spoke to Ann Bass (neighbor) and he will preserve as many tees (three to
four) as possible. He might need to remove a couple of spruce trees. He would be
willing to put another tree on the other side of the fence to make up for It, if
necessary. A one-story home will take up the lot nearest Bass.
TERRY SKIBBY, 611 Beach Street, Vice-President of the Historic Commission, stated
that the Historic Commission had concerns about the private drive from the railroad
area. The railroad addition is on a grid pattern typical of the area and the proposed
development is a departure from it. The bottom of MAlA Street is a critical I place with the
location of the Golden Spike and in addition closes the door to the extension of IAA IA
Street to Mountain Avenue. The Historic Commission objects to the visual impact of
the private drive and the drive is not compatible with the rest of the area.
PHILIP LANG, 758 B Street, is opposed to this development because it adversely
affects development use, livability, safety and economic value of the adjacent
neighborhood and the development is poorly designed and in conflict with the
adjacent developed neighborhood. (Exhibit 0-1.)
Staff Response
Molnar said Condition 9 states that the trees be retained to the greatest extent feasible
and that similar size trees be installed for a buffer if they have to be remC)ved. With
regard to the Historic Commission's concerns about the alignment of the private drive
and "AM Street, Staff suggested a neighborhood sign be placed at the entrance to the
development to set it apart from the Historic District (Condition 10). The [applicant has
been willing to use porches, build detached units and use materials to make the
homes more compatible with the Historic District. A narrower street has been allowed
in this development to encourage traffic calming.
Rebuttal
COX thought it was important to have the private drive from MAM Street so it would not
look like an extension of MAM, along with the narrower street. He pointed out that 16
units he has proposed will create less traffic that the 23 units that the property could
accommodate.

Molnar also recommended adding another Condition. The parking space in the
garage on unit 1 (from the-AlA Street entrance) is on the west side of the IJnit. The
applicant will mirror this design to put In on the. right side so the garage IS not what is
seen first. (ThIs will be Condition 11.) .

Giordano would like the private drive to look like an extension of IAAIA Str~ however,
he does not feel strongly enough about It to vote against It.
Carr likes the concept of a drive (and the Jog), not a public street

The application is requesting annexation of approximately 8 acres and for. a 43 lot
subdivision (41 new homes and 2 existing). The Staff Report outlines the Idetalls of the
project. The section of Mountain Avenue Involved in this application Is urllder a five
year no cut paving moratorium (about one year ago). A waiver could be granted by
the. City Council. The applicant complies with ordinances for annexation 8I'ld outline
plan approval with the ten attached Conditions.
Armitage noted that if the land is annexed, this will create a piece to the south that will
become an island. Mclaughlin said the Commission has the discretion to enlarge the

A revised outline plan has been submitted, showing a reduction in the to~
number of units from 18 to 16. This results in a project'density of 14.3 units per
acre,' very similar to the density permitted in the adjacent R-2 zo~ district. The
following changes have been.made to the project design in order to' address the
concerns raised in the initial staff report:
Site design
The two new buildings along "B" Street have been redesigned such ~hat the
garages are oriented toward the private driveway, rather than "B" stteet Both
residences will have front porches setback 10 feet from the front property line.
Staft' is pleased with this design change and believes the units comply with
applicable Site Design Standards
Private yard areas/Outdoor . recreational space .
The plan has been amended to include a 10 foot rear yard for theDllajority o~
residences. The provision of recreational space is met through a co~bination of
the private rear yard areas and the common area situated at the prdject's
northwest comer.
Minimum distance between driveway and buDding
The building wall of each unit, with the exception of porch areas, y.fill be set a
minimum of 5' feet from the edge of the driveway or sidewalk, whiChever is
closer. This change has been reflected on the revised plan. This will allow for
.some separation between the residence and the driveway and provide a suitable
area for planting trees.

Solar access
A neighboring property owner had raised concern over the project's ability to
comply with the solar access ordinance. To insure compliance with ~ese
pro9isions, single story units will be located adjacent to .the north ptoperty
boundary.

A few minor changes have been discussed with the applicant which will be
included as conditions of approval and incorporated into the Final 'Ian. One
change involves moving the garage and parking space for unit 1 (lo4ated at the

as you enter the project or proceed south on 8th Street The other
recommendation is the inclusion of a small porch on each unit The porches will

The design of the consumer house has been dramatically altered '
by the growth of car ownership, which has increased from an
average of one, to two or three per family; the problem is where
to put th~. The conventional solution is simply to enlarge the
garage. A Slngle-car gar.age is only twelve feet wide, but a th~-
car garage is thirty-six feet wide; on a narrow lot this barely leaves
space fo~ the front door. Even with the best intentions, it is difficult
for a bUilder to avoid giving the impression that the house is really
a converted .service station or car wash. The effect of a row of such
houses can be deadly. The front lawns a~ replaced by almost
continuous driveway paving, and the line of garage doors flanking
the sidewalk hardly creates congenial streets.
There are ways to solve these problems, but they require re-
thinking some basic assumptions about how single-family neigh-
borhoods are planned. One alternative, ,which has been tried
successfully in new developments like Kentlands, in Maryland, is
to provide rear service lanes- and parking behind the houses.

DEAN CROPPER, 1820 Greenmeadows Way, Cropper Medical, expand~ their plan
because their business is growing. He asked for a correction on Page 3 of his
findings to state "'ype II procedureM. He and Mr. Martin are working on soMng the
property line discrepancy. The proposed modifications to Cropper's fadlity will not be
impacted if the property line is in the wrong place. Also in Cropper's findings, he is
interested in pursuing a Physical and Environmental Constraints permit for installation
of a picnic area in the creek area. He will obtain the necessary permits.

DAVE RICHARDSON, 1105 Siskiyou Boulevard, stated the property drains naturally
toward the creek. They may put in some vegetation to aid in draining. He agreed to
put a trap in the drive.
CROPPER said the well is on the north side of the house and there is a significant
drainage moving away from that area He said most pick-ups and deliveries are done
by UPS and the largest truck is a short trailer. The deliveries are done during the day
and Cropper agreed to cooperate in insuring his deliveries would occur at times that
would not conflict with children going to or from school.

FRED COx, 1280 Kirk Lane, tried to incorporate porches in his design. tie has tried
to answer some concerns of Staff and the neighbors. Ann Bass will be behind a one-
story building. Cox agreed with the solar and foliage on Barchet's plan. A
construction fence Is agreeable to Cox.
ED MCCURRY, 375 Otis, is with Century 21 and is the listing agent for th$ property.
He asked the Planning Commission to approve this application. This development will
create considerably less traffic than 23 units (highest density) would caUS$.
Staff Response
Staff would recommend continuation of this application in order to polish lhe design
issues .-ad return with a finished product. There is not a site plan to adopt that meets
the requirements. The Commissioners wanted to see the driveways loa$d per Staff
recommendation. Cox agreed to waive the 120 days for completion of his application.

I. Relevant Facts
1) Background - History of App6cation:
There are no other plannine actions of record for this site.
2) Detailed Description of the Site and Proposal:
The project site is approximately 1.12 acres in size and abuts "B" Street at
the south end and -A" Street right-of-way at the northwest cotner. The
existing house is proposed to be removed. There are several large, mature
trees located within the planting strip adjacent to "B" Street. While the
applicant's findings discuss additional trees on the property, these have not
been noted on the outline plan.
The applicant proposes to construct 18 residences in phases, consisting of
4 to 6 units at a time. All the units will have access from a private driveway
which extends from "B" Street through to "A" Street. One 15 moo in
diameter tree will need to be removed to construct the entrance along "B"
Street. The driveway will be paved to a width of 20 feet and have a 4' wide
sidewalk along one side.
Four different types of units are proposed, three of which are two-stoxy.

While the site is just outside the Historic Interest Area, the architecture
incorporates design elements of the surrounding neighborhood. Horizontal
, siding, single hung windows, hip and gable roofs, and porchesi with turned
columns and chamfered balusters have used in the design of ~dividual
units.
II. Project Impact
Staff commends the applicant's efforts in designing a project which takes into
consideration the character of the adjacent Historic n.eighborhood. While the
property is zoned for high density multi-family development, the pr~ject concept
of detached, individually owned residences is much more consistent With
surrounding patterns of housing in the area.
The style and design of the units incorporates traditional design feat)1res seen on
neighboring buildings, including different roof styles, lap, cottage ancl colonial
siding, double hung windows, wood trim and front porches.
The project incorporates various hardscapes (i.e., concrete, pavemeDjt, pavers, etc.)
that create character and maintain compatibility with the neighborhQod, while
serving to distinguish between the private driveway, parking areas and the
pedestrian walkway. The sidewalk extending through the project will be
constructed of stamped concrete (cobblestone pattern - grey), with individual
driveways being improved in a similar pattern, but in red. Pavers will be used for
additional parking spaces throughout the project.
There are several issues, however, which in Staff's opinion need to be addressed
before the Commission should approve the project. These include tb~ following:
Compliance with Site Design Standards
Staffs concerns relate specifically to the two units facing liB" Street, ,.t the
entrance to the project. Each of the units have a single car garageotiented toward
"B" Street. Given tbe alley network found in the railroad district, mdst of the
garages in the area are located at the rear of the residence, out of view from the
street. It is possible to maintain this historic pattern witb each of tbdse units as
well. The access driveway allows each of the garages to be located aJ: the back of
the lot and oriented at a right angle to the street, rather than towards "B" Street
as proposed.

Standard II-B-l(c) for Multi-Family Development which specifically states:
"Parking areas shall not be located between the buildings and the street. "
This standard is a cornerstone within the Oty's design review process and should
not be compromised. Staff believes ample opportunity exists for the applicant to
redesign the two units to comply with Oty's design standards.
Private Yard Areas
The front yard for this property is the 20' wide area parallel to "B" Street.
Consequently, the two lot lines at right angles to lIB" Street are considered side lot
lines. The project proposes that all but one of the units be set back from the side
lot line by 6', the minimum required by the ordinance. Given that the majority of
the units are two story, it is staffs opinion that the private yard spaee the rear of
each unit should not be less than of 10 feet in any dimension.
Outdoor recreational space
Eight percent of the project area is required to be in "outdoor recreational
space." This can be common or private space dedicated for use by the
residents of the project. Shrubs, bark mulch and other grouncJ covers may
not be counted toward this requirement It is uncl~ in the application if
and how this requirement has been met. The lawn space shown in the
common area is not large enough to meet this standard. In addition, the
landscaping plan does not indicate any landscaping at the rear of the units.
The initial installation of the landscaping for the entire development is the
responsibility of the developer. AftelWards, provisions for continued
maintenance can be the responsibility of individual owners or 'provided
through CC&R's or a homeowner's association.
Minimum Distance Between Driveway and Building
Many of the units are less than 5 feet back from the private driveway, with some
units shown as having no setback from the driveway. While Staff understands that
the narrow driveway with street trees and the location of buildings close to the
street are proven methods for reducing travel speed, we recommend that the
building or porch not be closer than 5 feet from the driveway. Any closer may
compromise the livability of the unit.

developed for the uses shown in the Comprehensive Plan.

entire project.

IV. Conclusions ud Rer.ommendations
The suggestions recommended above should help to provide greater separation
between project residents and neighboring property owners. While tlhe applicant
has stated that the project is below the base density permitted for the parcel, the
average unit size is 1526 square feet (includes single or double garage). Similar
multi-family developments (i.e. Glenn Vista Estates) that incorporatt fairly large
units, like those proposed, have developed at or below the base density due to lot
area constraints.
Staff believes that the COmmilt~ion should delay a decision on this project'in order
to give the applicant time to address the concerns raised in this report.

Request for Outline Plan approval for an 18 unit perfonnance standard
development, presently zoned R-3 (20 units per acre). Present zoning would
allow 23 units.
Location of Property:
955 "B" Street, Ashlan<L OR 97520. The property at the south end extends
from "B" Street to the "A" Street city right-of-way at the north end.
Initial Consideration and Character of Development:
This project was specifically designed to enhance the surrounding
neighborhood, the railroad district and the historical society. The property is
not located within the boundaries of the railroad or historic districts. The
initial plans showed two different designs with 21 units, having little or no
separation between units. These same units would have a similar
architectural look as the surrounding area However, after discussion with
City Planning a concern was expressed that the units would be more
compatible if there were more separation between units. After further study
and discussion with others it was detennined to separate the units and
decrease the overall unit number to 18, better reflecting the overall existing
neighborhood. This included the garages being set toward the rear of each
unit and varying roof styles, some two story and one story units, steep hip
and gable roof designs, a variety of porch styles(i.e. having turned columns
and chamfered balusters), homes having a minimum of four different sidings,
fmish trims and overall color schemes to fit in with the surrounding area.
Infonnal meetings have already taken place with various neighbors, historical
society and railroad district members. An open dialogue with all concerns to
this development will continue. The response thus far to this development
has been favorable. Some of these comments included the fact that
"individual" privately owned units are preferable to an aparbnent setting, and
the feeling of the "quiet lane" with porches reflects the "B" Street theme; also,
the architectural design is compatible with this area of Ashland.

This development will include a gazebo and decorative fountain to iprovide
some private common space and a transition from the railroad park. A
decorative wood picket fence will SUl1'OUlld this common space. The fence
height will be in accordance with Ashland's fence ordinance.

detailed drainage plan will be submitted to and approved by the Asbland
Street Division prior to obtaining any building pennit.
Landscaping: A fmallandscapeand irrigation plan identifying specific
species to be approved by the staff advisor prior to the final plan. All
maintenance of the landscaping in all areas except the immediate backyards
of the units will be responsible by the Homeowners Association and will be
included in the CCRS.

CCRS (Homeowner's Association): To be drawn up by a 1icense4 attorney
and approved by the city of Ashland prior to recording of the final plat. This
docwnent will outline the Homeowner's Association responsibility for the
maintenance, up-keep, landscaping, driveways, parking, private lane,
walkway, common areas, utilities, and maintenance of all exterior structures.
Parking: 18 total units will require 36 parking spaces
- 24 covered parking
- 10 on-site parking

Bicycle Parking: One covered bicycle stall will be installed on the side yard
of each unit and four additional stalls at the common area for a total of 20
stalls; to be in compliance with 18.92.040.

Financing: Financing will be funded privately and in part by bank
construction lending.
Driveways: All driveways to be a stamped red concrete.
Walkways: A walkway will pass through the project from "A" Street to "B"

Energy: All homes will have a split heating and cooling system using
natural gas heat at 92% high efficiency and electric air-conditioning. Hot
water heating will be natural gas.

Time Schedule: The private lane and all utilities will be construct~d and
installed at the beginning of the project. Applicant proposes to complete four
to six units at a time, completing landscaping and walkways as each unit is
completed. The majority of the landscaping of the common area wjll be
completed prior to occupancy. The construction of the homes to the north of
the site will begin frrst and advance towards the south of the site. 11'he units
bordering "B" Street can be built at any time during the project. Projected
overall time frame of the project to be approximately three years.
Street Signs: "No Parking II signs to be in accordance with city approval.
Requested "No Through Traffic" signs; one at II A II Street entrance and one at
"B" Street entrance.

I am sending you this brief note in lieu of an appearance, so that I can
meet the official requirements for stating an objection toa project
at the inception of the process to protect future appeal rights. Unfortunately
I need to be out of town this evening, otherwise I would appear personally.
I understood from my brief conversation with Planning this A.M. that the
proposed development is (just) outside the limits of the Railroad District,
and thus not subject to Historic Commission review.
I object to the approval of this project based on the fact that regardless
of where the line is drawn, this project is within our neighborhood, and
appears in reality to be part of that district. The density of the
project, the fact that it will not truly conform to the size, scale, design
of the residential or small-scale multi-family units in the neighborhood,
and its significant impact on traffic are all reasons to oppose'and reject
this development.
Some years ago there was serious discussion of the need to cut traffic on
B street. The street narrows markedly in the middle of the district.
Cars parked on both sides of the streets make it very difficult and
dangerous for two moving vehicles to pass each other safely. I have
witnessed a number of accidents and potentially many more. Now a developer
proposes to add a substantial load on the street. t~ether or not alternate
routes are available is not relevant. People have a strange way of doing
what appears direct and best for them, regardless of what developers say
or planners agree to. The project is on B street and on B street the
traffic will find its way.
We need to avoid malting the Railroad District "virtual reality" town.
The more these kinds of developments, and inappropriate commercial ones,
are allowed to infiltrate and surround the district, the further we
advance towards a "theme park" mentality and reality, which is diametrically
opposed to real preservation of structures and the social life of the
neighborhood.

Dear Ma'am or Sir,
I am writing in response to the proposed buildinglof 18 units
by Fred Cox at 955 B Street because I have several co~cerns about
this project. I live next to this lot at 248 8th Stre~t.
I chose to buy a home in the Historic Railro~d District
because I consider it to be the most beautiful and by ~ar the most
community-oriented of all the neighborhoods in Ashl4nd. At the
recent Vision Planning Conference in Ashland the gu~st speaker
remarked on the nearly ideal neighborhoods we have he~e. I do not
want to see this destroyed because a developer is anxious to make
as much money as possible. I am well aware that Mr. co~ could have
proposed building 21 units and that the lot is just outside the
Railroad District boundary. I do not, however, think this is reason
enough for being allowed to construct such a high-density complex
as is being proposed.
It is a joy to walk through the Railroad District and see
friendly faces, nicely kept yards, families, pets, etc. The new
park on A street has also significantly improved "our" end of the
District. I fear that Mr. Cox's development greatly +educes the
livability of the neighborhood. After all, who ever chooses to take
walks down Garfield street for instance, or by any other large
development for that matter?
Building 9 units in the same length of distance where 5 houses
stand on 8th street seems absurd to me. There just isn't room for
quality living space with that kind of density. Moreover using a
mere 6 feet set back severely limits the privacy of existing houses
such as mine. I have a small home (characteristic of many of the
RR District houses, unlike an 18 unit complex) with the entire back
side of my house consisting of an all-glass sunroom which we use
as an office and bedroom. A two story building looming 6 feet away
from the property line makes it impossible for me to have any more
privacy in the future. At the same time I would hardly consider
what is proposed as a backyard for these units to be adequate for
the people who intend to live there. I don't believe in $acrificing
quality of living to profits. I strongly concur with the Ashland
Planning Department's Staff Report of. May 9 that the;re must be
greater separation between the project units and existing property
owners.
I also have concerns about traffic and noise. With 18 units
literally crammed onto 1.12 acres how can we still expect to
maintain our RR District neighborhood atmosphere? Again, the
project is in my opinion far too dense to do anything but seriously
detract from the current neighborhood.

I recently received the city's planning action 95-044 · Fred Cox's
proposed 18-uni t townhouse development on B street. As a local
contractor, I'm not opposed to development for obvious reasons, but
this project is completely out of place on B street.
The aain reason I moved to the railroad district 10 years ago was
because it wasn't overdeveloped with "High-Density, .Multi-Family
Dwellings. II An extension of the existing neighborhood's density
would have been an acceptable proposal, but as usual, where the
dollar is concerned, quality of life suffers. I oppose this
proposal for reasons of traffic, neighborhood quality and common
sense.

Dear Mr. Molnar:
As owner of the property adjacent and directly east of the subject
p rope rt y ( 963 '8' St reet ) , I request t hat you commut'l i cat e my
following concerns regarding the proposed townhouse development to
the Planning Commission:'
1) Due to a recent boundary line adjustment, my property now
extends to the north of the subject property. I request that my
solar access rights (Chapter 18.70) be fully protected, as the
current plan for my property calls for solar water heattng panels
in that area (see enclosed site plan).
2) I request that the foliage along our common border remain
undisturbed. This includes a mature hedge running from 'B' Street
up to my existing house, and the numerous plum trees next to my
house.
In addition to the above concerns, I would like to know whether the
setbacks for PUD's are different from the standard setbacks listed
in Chapter 18.28 for properties zoned R3. In Mr. Cox' application,
he states that no variances are requested, yet his front setback
from '8' Street(15'), seems to be less than standard(20').

Dear Mr. McLaughlin:
This letter concerns Fred Cox' project on 'B' Street which is now
before the Council on appeal by Phillip Lange.
As you know, I own the property adjacent to Mr. Cox' on the east
side. I am currently seeking site design approval for 16 townhomes.
During September's Planning Commission meeting, my proj ect was
discussed and several Commissioners suggested that I try to co-
ordinate my project with Fred's. Therefore, I propose a design plan
(see enclosed site design sketch) which integrates the two projects
and which also provides needed parking for the city park on 'AI
Street.
The plan would require the city to purchase the north portion of
Mr. Cox' property for public parking. The parking area would
provide an exit for my project as well as Mr. Cox'. I would donate
the portion of my property which lies between Mr . Cox ' and the
railroad tracks so that the bike path, city park and parking area
would be seamlessly integrated. The parking area would help make up
for lost parking along' A' Street if Demuth Glick's recommendations
are implemented (parking on one side of 'AI St. only).
Please review this proposal within the context of the City's mid to
long term planning goals. If your department believes it has some
merit, please forward it on to the full council for consideration
at their meeting next Tuesday, October 17.

_ sale includes 9.6 million board teet of timber (in 3 "units") to be removed by helicopter
_ 669 acres of high elevation (5,000 ft) forest (Douglas fir, white fir, ponderosa pine, cedar)
- "sold" trees are individually marked with blue paint
( I ,000 trees over 46" in diameter, plus 11,000 trees less than 46" in diameter)

Our consultants, Brown and Caldwell, forwarded to you the final draft of the Ashland
Wastewater Facilities Plan on September 29, 1995. This meets the October 1, 1995 deadline
required Mutual Agreement and Order (dated February 6, 1995, with letter of extension dated
August 1, 1995). This final plan delineates much of what we had previously discussed and
defines our recommended course of action.
We remain concerned with three primary issues relating to the anticipated new permit:
1. Outfall location.
2. Temperature and the ability to obtain a variance as described in the triennial
review.
3. How ammonia and BOD limits are to be calculated.
As Paula Brown has discussed with you, and was presented in our letter dated September 13,
1995, the City has every intent of relocating the outfall to Bear Creek. You indicated a need
for a formal NPDES permit revision, which we will process upon receipt of the forms from your
office. The outfall will be in Bear Creek most likely ahead of the confluence of Bear Creek and
Ashland Creek. We are currently looking at determining a specific location based on the creek
elevations and required access needs. It does not seem prudent to develop a completed NPDES
permit for the Ashland Creek outfall when we are responding to your desires by relocating to
Bear Creek.

The City is eager to begin work on the design and, construction of Phase I of th~ Treatment Plant
improvements. Our schedule shows the design starting in January 1996. It is crucial that you
evaluate the Facilities Plan and provide us with appropriate direction to begin the design of
Phase I. We would like to proceed quickly, yet are concerned with directing work and financial
resources that would not be approved for a facilities permit in the future.
For your information, we will be sending out a Request for Proposals for the pilot wetlands by
the end of this month and will send a copy to you for review. We anticipate that you, or
another member of your office, will be involved with the wetlands permitting and evaluation.
We look forward to working with you as we count down the final phases of the Facilities PIan
approval, and with the corrections to the plant and surrounding watershed improvements.

HAZARDS IN THE CITY OF ASHLAND AND DECLARING AN
EMERGENCY.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. Section 10.30.010.C of the Ashland Municipal Code is amended to read:
C. Except for religious fires, any outdoor fire authorized in this chapter
shall only be used to burn woody debris such as limbs or branches. No person
shall start or maintain any outdoor fire authorized in this chapter in a barrel.
SECTION 2. Section 10.30.020.A of the Ashland Municipal Code is amended to read
in its entirety:
10.30.020 Period When Outdoor Burning is Authorized. After a permit is
obtained from the Fire Chief, outdoor fires are authorized as follows:
A. From March 1 through October 31, excluding fire season, when the
ventilation index is over 400 and fire fuel conditions are conducive to burning.
The amendments to this code section as contained in this ordinance and the
amendments to this code section adopted in Ordinance No. 2751 on March 7,
1995, shall terminate on February 21, 19971.
SECTION 3. Inasmuch as it is necessary to provide authorization for burning in the
month of October 1995 to reduce as soon as possible forest fuels in the forest
interface, it is deemed necessary for the public peace, health, and safety of the
citizens of the City of Ashland that an emergency be declared to exist, and this

A RESOLUTION AUTHORIZING SIGNATURES, INCLUDING
FACSIMILE SIGNA TURBS, FOR BANKING SERVICES ON BEHALP OF
THE CITY OF ASHLAND
THE CITY OF ASHLAND RESOLVES AS FOLLOWS:
SECTION 1. For the City of Ashland, the following persons are authorized to. sign on
behalf of the City, orders for payment or withdrawal of money: Catherine M. Golden,
Mayor; and Barbara Christensen, Recordertrreasurer; or in their absence, Jill Turner,
Director of Finance, or Karen Huckins, Supervising Accountant.
Such authority shall remain in force until revoked by written notice to the affected bank of
the action taken by the Council of the City of Ashland.
All prior authorizations are supeneded.
SECTION 2. Any designated depository (-Bank-) of the City of Ashland is authorized and
directed to honor and pay any checb, drafts or other orders for the payment of money
withdrawing funds from any account of the City, when bearing or purporting to bear the
facsimile signatures of the persons listed in section one of this resolution whether such
facsimile signatures be made by stamp, machine, or other mechanical device. The Bank is
authorized and directed to honor and to charge the City for such checks, drafts, or other
onlers for the payment of money, regardless of how or by whom such actual or purported
facsimile signatures were made, provided they resemble the facsimile signatures duly
certified to and filed with the Bank by the City Recorder or other officer of the City.

council approve an ordinance deleting Chapter 6.38 of the Ashland Municipal
Code.
BACKGROUND
Finance Director Jill Turner approached Public Works with questions regarding
the airport business license fee, since less than $100 was being collected
annually. '!his fee was intended to offset the cost to the public of cnmrnercial
use of the airport.
In the last year, Airport connnission has developed a special permit process to
deal with itinerant small operators (one target of the licensing program), and
has developed land leases that better reflect specific commercial inpact costs
than the additional business license fee. The airport has in place "Aviation
Minimum Standards" that require ground leases and set commercial operation
standards.

since the Finance Director suggests that it is not cost effective to administer
the airport business license fee program, and since the cost to use the public
facility is better offset through the ground lease fees, deletion of AMC 6.38
was approved and recommended to Council by the Airport Commission at their
regular meeting of June 7, 1995.
