1..~JI Costs by Consultant: Consultant shall, at its own risk and expanse, perform the personal services described above and, unless otherwise
specified, furnish all labor, equipment and materials required for the proper performance of such service.
2. Qualified Work: Consultant has represented, and by entering into this contract now represents, that all personnel assigned to the work
required under this contract are fully qualified to perform the service to which they will be assigned in a skilled and workerlike manner and, if
required to be registered, licensed or bonded by the State of Oregon, are so registered, licensed and bonded. Consultant shall also procure and
maintain a current City of Ashland business license.
3. Completion Date: Consultant shall start performing the service under this contract by the date indicated above and complete the service by
the completion date indicated above.
4. Compensation: City shall pay Consultant for service performed, Including costs and expenses, the sum of specified above. Once work
commences, invoices shall be prepared and submitted by the tenth of the month for work completed in the prior month. Payments shall be
made within 30 days of the date of the invoice. Should the contram be prematurely terminated payments will be made for work completed and
accepted to date of termination.
5. Ownership of Documents: All documents prepared by Consultant pursuant to this contract shall be the property of City.
6. Statutorv Requirements: ORS 279.312, 279.314, 279.316 and 279.320 are made part of this contract.
7. Indemnification: Consultant agrees to defend, indemnify and save City, its officers, employees and agents harmless from any and all losses,
claims, actions, costs, expenses, judgments, subrogations, or other damages resulting from injury to any person (including injury resulting in
death,) or damage (including loss or destruction) to property, of whatsoever nature arising out of or incident to the performance of this contract
by Consultant (including but not limited to, Consultant's employees, agents, and others designated by Consultant to perform work or services
attendant to this contract.) consultant shall not be held responsible for any losses, expenses, claims, subrogations, actions, costs, judgments, or
other damages, directly, solely, and approximately caused by the negligence of City.
8. Termination: This contract may be terminated by City by giving ten days written notice to Consultant and may be terminated by Consultant
should City fail substantially to perform its obligations through no fault of consultant.
9. Independent Contractor Status: consultant is an independent contractor and not an employee of the City. Consultant shall have the
complete responsibility for the performance of this contract. Consultant shall provide workers' compensation coverage as required in ORS Ch
656 for all persons employed to perform work pursuant to this contract and prior to commencing any work, Consultant shall provide City with
adequate proof of workers' compensation coverage. Consultant is a subject employer that will comply with ORS 656.017.

Dear Keith:
Thank you for inviting me to submit a proposal to conduct a study of space needs for the two
Ashland fire stations. I appreciate the time you took to give me a tour of both facilities prior to my
going out of town recently.
Since that time I have carefully reviewed the report prepared by Urban Planning Associates and agree
with many of their thoughts and recommendations related to both fire stations. Additional study will
be beneficial in further analyzing existing facilities and their value in satisfying program
requirements. It will also serve to solidify a direction the Ashland Fire Department should pursue in
order to assure that a growing community will have the service and protection it requires.
In my proposal I have outlined the various facets such a study should include. Essential to the study,
and any future building activities, is the measuring of existing facilities and preparing "as-built"
floor plans, and the development of a detailed program, both of which are included as elements of the
proposal.
Also included is a outline resume of my background as an architect. As mentioned during our visit,
I have developed programs and designed numerous buildings of a light industrial character. These
have included a fire station, service garages, shop/office buildings, and a building to house and clean
waste collection vehicles. Should you wish any additional background information I will be happy to
provide it for you.
If selected, I am confident my broad background and experience will provide you with the
architectural expertise necessary to evaluate the existing buildings and to prepare a meaningful study
to give direction to the needed improvements and/or replacement of existing facilities.
I look forward to responding to any issues or answering any questions. I am eager to work with you
and the Ashland Fire Department in the preparation of this study.

Ted Mularz will serve as the Principal Architect and team leader and coordinator to ensure that
client requirements are fully satisfied in the preparation of the study. Ted has designed and
completed more than 350 projects in his 32 year practice. From his initial fu-m in Colorado to his
five years of practice in Ashland, clients have recognized his skills through a wide range of
commissions including light industrial, civic and office facilities. Ted's exceptional commitment
as a citizen - professional to public service and architectural education has been honored by his
election as President of the National Council of Architectural Registration Boards in 1985 and to
the College of Fellows, American Institute of Architects.
He practices an architecture which benefits people and as a specialist in historic building res-
tomtion, he searches each client program for its most appropriate opportunities and solutions.

SERVICES
This proposal responds to the requirements outlined in the report prepaxed by Urban Planning
Associates and the letter of invitation to submit a proposal from Keith Woodiey dated April 7,
1995. It is important that the study include the various elements outlined to take the f~re station
modification, replacement, or expansion to the next logical step -- architectural design and
construction.
Following is an outline of the elements (phases) which are essential to the preparation of a
complete study. Since the project ceiling cost is $5,000.00, separate costs have been assigned to
each segment of the study in the event the study itself may need to be phased, preparing only
certain segments of it at this time.
- AS.BUILT DRAWING PHASE:
Field measure the existing buildings and prepare dimensioned floor plans. The buildings will
also be photographed for future reference and preparation of elevation drawings if needed.
This is an essential aspect of the study and vital to subsequent phases.
This work should be performed initially even if other phases are postponed.

II - PROGRAM DEVELOPMENT PHASE:
Verify program requirements outlined by Urban Planning Associates through meetings with
the Fire Chief, Fire Marshall, and Fire Captains. Pursuant to these meetings prepare a
derailed program of space requirements for both Fire Stations.

III- EVALUATE EXISTING FACILITIES PHASE:
Evaluate existing facilities, as related to the program space requirements to determine:
a.) Whether, and to what extent, the existing fn'e stations can accommodate program re-
quirements.
b.) Verify whether, as the Planning Associates Report recommends, Fire Station No. 1
should be demolished and replaced with an entirely new facility.
c.) Whether additional adjacent land is required to satisfy program requirements.

IV - CONCEPTUAL DESIGN PHASE:
Prepare conceptual floor plans and site plans of both fire stations showing how, and if
program requirements can be satisfied through space addition, modification, or building
replacement. (Elevations and Sections not included)

V - PROBABLE CONSTRUCTION COST PHASE:
Prepare a Statement of "Probable" Construction Cost to determine a construction budget for
each f~re station exclusive of land acquisition costs, if required.

VI - IMMEDIATE PRIORITIES:
If modification of facilities to accommodate program requirements must be postponed, then, in
cooperation with the Fire Chief, and pursuant to the Planning Associates report, prepare a
report listing priorities that require immediate attention to existing facilities in order to satisfy
ADA, OSHA, or health safety requirements.

Reimbursable Expenses For: blueline prints, telephone, FAX, photocopies, postage, authorized
travel, and other miscellaneous expenses, shall be in addition to fees outlined above.
Since Phases I through III total $4,480.00 it is recommended that that these
phases be pursued at this time since they are within the $5,000.00 allocation
for the study. The completion of these phases will be required prior to
beginning conceptual building design, site plan studies, and circulation.
It is essential that the City provide site plan "improvemenf' surveys of both fire stations. The
cost of such surveys is not included in this proposal and it is assumed that they will be prepared by
City of Ashland Engineering personnel.
Each site improvement survey should include:
· Property lines with dimensions and bearings
· Building locations with exterior dimensions
· Location of underground utilities
· location of important site features such as trees, paving, retaining walls, fences, etc.

property lines of adjacent sites which may be needed for expansion.
